SUMMARY: MEDIATION OF COMMERCIAL DISPUTES - DOMESTIC AND INTERNATIONAL PERSPECTIVES Dr. Martin Svatoš This paper addresses the mediation and its use in the both domestic and international commercial disputes. The milieu that serves as a source of the problems to be resolved during mediation is a specific one. It demands quick, cost-effective and confidential resolution of complicated disputes involving several parties. In general, this cannot be granted by the traditional ways of dispute resolution - litigation and arbitration. Mediation is regarded as a cost-effective and quick extrajudicial resolution of disputes in civil and commercial matters through processes tailored to the needs of the parties. On the other hand, there are several legal and legal-related issues that have to be discussed. And thus, the question that remains to be answered is: Is mediation really as effective as it is told? And in the case of a positive answer - why it is not the most commonly used dispute resolution procedure? The main goal of this thesis is to answer these queries. The commercial and investment relations between Thailand and the Czech Republic are longstanding. Currently, the Czech Republic imports a number of agricultural products and food from Thailand, and Thailand imports industrial technology from the Czech Republic. As a result, there are opportunities for Czech companies to invest in and establish business cooperation with Thai businesses with agreements to guarantee stable commercial investment relations between Thailand and the Czech Republic. Because of this, the Bilateral Investment Treaty (BIT) between both countries facilitates further development. The dissertation deals with research about the Protection of Investments under the Bilateral Investment Treaty between Thailand and the Czech Republic. One of the key processes of IS/IT service provider is Service Level Management. IT service provider faces a problem how the services should be defined, how a balanced service portfolio should be set up and how the processes covering the service management should be designed to meet strategic goals of the organization. The thesis focuses on IS/IT service portfolio design and management with a particular focus on infrastructure services. General goal of the thesis is to support IS/IT service provider's activities directly linked with service level management, IT financial management and IT service portfolio design. The thesis puts together theoretical sources in the area of IT Governance, generally accepted methodologies and best practices, actual market trends and author's experience. The theoretical part maps current development in the field of IS/IT service management, summarizes relevant theoretical inputs, categorizes IS/IT services, gives an overview of the most commonly used pricing models and presents actual IS/IT market trends, such as SaaS or Utility Computing. The application part, which follows the theoretical part of the thesis, is built upon fundaments of key findings and conclusions of the theoretical part. Application section introduces a method of service level management transformation and a business model suitable for IS/IT service provider. Furthermore a process of IS/IT service portfolio design is introduced. The process is supported by an analytical tool, which enables analysis of provider's financial and infrastructure data. The output of the analysis is a set of scenarios of IS/IT service portfolio including revenue, costs and utilization of resources and technologies. Academic benefit is seen not only in the consolidation of relevant theoretical sources dealing with IT service design and management. The thesis also introduces frameworks for optimization of service level management process and a concept of a IT service provider's business model. A practical contribution of the thesis is seen in a process of IT service portfolio design supported by an analytical tool for provider's real data processing, covering demand, capacity, utilization and financials.

This work deals with problems of the termination of labor relation in the Czech Republic, as well as Slovak Republic. I approached this topic by comparing the currently valid regulations as stated in the Labor Codes of the Czech and Slovak republics. I consider thorough knowledge of this issue to be of great practical importance. I am convinced that labour is one of the most important attributes determining systemic functioning of the whole society. From the presentation of the labour as a basic means of production of any state system we can deduce a great amount of interesting information. The work is and always has been a prerequisite to our survival and is thus the foundation of any state system. My thesis is divided into six separate chapters, each of which deals with labor law from a different perspective. The first chapter deals with the subject, purpose and content of labor law. The second chapter describes the history of the labor law and is divided into two parts before and after 1989. Therefore it also describes the situation in Czechoslovakia, where identical laws were applied in all legal sectors. During the first republic, Hubert Ripka (1895-1958) was one of the most active democratic orientated journalists and closest colleagues of minister of foreign affairs and later president Edvard Beneš. His political and journalist beginnings are connected with national democratic group Mladá generace. What was crucial for Ripka's career was the split between left and right wings of Mladá generace in 1920, when he - after the victory of the right wing - withdrew. Antonín Pešl brought him to the Národní osvobození, which was associated with Československá obec legionářská and politics of Hrad. In the area of foreign policy he focused above all on monitoring political and cultural life in Jugoslavia, he became a secretary of Československo-jihoslovanská liga, member of Slovanský ústav, he contributed to the Jugoslavian periodicals and to the renovated Slovanský přehled. Ripka's most important lecture activity was associated with prestigious Klub Přítomnost. He worked in Lidové noviny since 1930, yet he still contributed to a lot of other periodicals. The thesis aims to analyse the content of the performance management of teachers at an elementary school. The theoretical part first defines basic terms of human resources and the latest concept of human resource management. Subsequently, the individual terms of the core area of performance management are introduced. A specification of the target organization concludes the theoretical part. The research section reveals the application of the individual components of performance management in a real environment of particular elementary schools. It was chosen the quantitative research for the research survey, particularly the technology questioning. It was used the method of semi-structured interviewing technique and the content analysis of school documents for consistency. The final section is devoted to a summary of results and the achievement of project objectives.

The first chapter of this thesis discusses the recent development of climate change law. It explores the reason as to why it is at the centre of a global debate, which is predominantly due the increasingly pronounced consequences of climatic changes on human society and the environment. Furthermore, it describes the most important requirements in tackling the issues presented by international climate change treaties. This includes the United Nations Framework Convention on Climate Change, acting as a base for the whole international climate change regime, the Kyoto Protocol as a legal tool with specified emission targets and most recently, the Paris Agreement, which serves as an independent international treaty however is still under the guidance of the framework convention. The author predicts that the Paris Agreement will determine the future direction of this legal field and therefore puts particular focus on this treaty in the first chapter of the thesis. The paper aims to uncover its weaknesses - questioning the enforceability of some of the measures that rely on the autonomy of states to implement and the lack of ambition in some of its targets. In my diploma thesis, I provide an analysis of the Munich Agreement and the Czechoslovak crisis from the perspective of the United States of America. My aim is to create comprehensive picture of bilateral relations between Czechoslovakia and the United States before and after the signing of the Munich Agreement. Thesis focuses on the diplomatic and economic relations between Czechoslovakia and United States in the period 1936 -- 1938/1939. The introductory part of the thesis is devoted to the phenomenon of isolationism and its influence in shaping the U.S. foreign policy. The main point of the analysis is the attitude of the American public to the Czechoslovak crisis and the Munich Agreement itself. The main hypothesis consists in the assertion that the United States played a major role in the Czechoslovak crisis that preceeded the signing of the Munich Agreement. I am seeking answers to these questions: How did the American public perceived the Czechoslovak crisis? What was the reaction of the U.S. government to the Czechoslovak crisis and the subsequent the Munich Agreement? How did president F. D. Roosevelt perceived the Czechoslovak crisis? In order to find answers to my questions I am using the issued and unissued sources, specialized literature and especially the contemporary press. The thesis has proved that the United States took part in the events that preceded the signing of the Munich Agreement.

Vnitropolitické souvislosti Hodžova plánu / The responses in domestic politics to Hodza Plan 1935-1936

Abstract The thesis is about the reaction of Czechoslovak political scene to Milan Hodža's Danubian plan. Milan Hodža was Slovak Agrarian and economist who introduced his plan in the second half of 1935 at the time when he was Prime minister of Czechoslovakia. Author emerged from broader considerations of Czech and Czechoslovak ideas about economic and political developments in Central Europe, according to Palacký "space between Germany and Russia." In this context author accepts Palackys beliefs about the indispensability of the Danubian Hapsburg Empire as the counter imperialist expansion's bumper of both the continental powers and efforts of political parties Mladočeši and Staročeši who tried to reform and maintain the country. He also describes the interwar projects of Czechoslovak sovereign foreign policy, where Czechoslovaks tried to take on an inspirational leadership role of Central European economic and political cooperation which was based on Little Entente. Author of this thesis thinks that Hodža's Plan is just one of these projects. And as all the previous projects Hodža's plan had no opportunity to be implemented in the new internationally-political and internationally-economic context. Had Milan Hodža prepared his plan for economic and potentially political cooperation between Danube region countries from the national economy point of view? Did he start the wider discussion about the possibility of Danube region cooperation in Czechoslovakia? These are the basic questions that the author asks and he answers them in the last chapter of his work: Milan Hodža never made any concrete national economic statement for his plan. His attempt for the realization had never gone out of the diplomatic detection. Likewise he did not evoke any specific reaction of Czechoslovak political parties not even in party periodicals.
