Právní formy zaměstnávání a jejich důsledky pro zaměstnance / Legal Forms of Employment and their Implications for Employees

Submitted thesis Legal Forms of Employment and their Implications for Employees deals with the problems of employment legal relations and subsequent forms of employment in connection with labour law of the Czech Republic. The first (theoretic) part of the work describes basic employment legal relations (working ratio and the agreement outside the employment relationship) in the relation to the labour code. In this part of the work are described the most famous non traditional flexible forms of employment of the Czech Republic, defined in their legislation, including a comparison of the advantages and disadvantages of these forms of employment both for the employees and for the employer. The practical part of the thesis comes from the testimony of ten of the respondents, who are acquainted with their opinions and experiences with different forms of employment. On their basis are developed case studies with commentary that evaluates the experience of the respondent and compares it with the relevant labour legislation. In this part is also statistical evaluation which deals with the comparison of the used forms of the employment relations between the European Union and the Czech Republic. The evaluation of the results and conclusion of the thesis summarizes the whole issue and presents the proposal to solute the negative consequences weighted employees using non standard flexible forms of employment.

This dissertation is focused on transportation of hazardous substances and on procedures of units of integrated emergency system during a traffic accident. It covers issues such as valid legislature, drivers´ training, obligatory documents, compulsory spares and checking of vehicle by the Police of the Czech Republic. The cooperation of units of the integrated emergency system / firefighters, policemen, emergency healht care/ starts as a common action at the very moment all rescue and protection units arrive at the place of the trafic accident of a vehicle transportating hazardous substance. Main attention is paid to the police work. The empirical part is relating to the research of knowledge in the field of transportation of hazardous substances through the use of the questionnarie . It is divided into three parts. The first part of the questionnarie contains collected basic information about the informants. The second part is focused on general knowledge about transportation of hazardous substances. The third part is aimed to the knowledge of procedures and activities at the place of accident. The conclusion of this dissertation mentions some of the accident advised forms of how to improve the transportation of hazardous substance by land and the preparatin of procedure of the Police of the Czech Republic in joint operations.

The thesis ``Causes of Accident Occurrence in Transporting Dangerous Substances{\crq}q is aimed at the topic of road accidents in transport of dangerous substances, which is one of its inseparable parts on which extra stress is placed and cannot be classified as common transport. Road transport of dangerous substances is subject to the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR). Although the safety of road transport of dangerous goods is broadly secured in the sense of ADR there are still numerous factors affecting the transport course itself, which may lead to a road accident. Road accidents of vehicles transporting dangerous goods often involve leaks of dangerous substances and subsequent threat to human lives and health, damage on environment and property. This is why transport of dangerous substances definitely belongs to activities with higher risk rate. The fact that the time and place of accident occurrence cannot be determined in advance even escalates the danger. The thesis is aimed at surveying the situation in the field of causes of accident occurrence in transporting dangerous substances, discovering the level of awareness of the problems of dangerous substance transport and the causes of road accidents among traffic participants and proposing concrete preventive measures. Quantitative research was performed to gain information necessary to confirm my hypotheses. Secondary analysis of the data from the Police of the Czech Republic archives was used as the method for confirmation of hypotheses. A questionnaire survey was used for determination of the level of awareness among traffic participants. The hypotheses set in the thesis, that the causes of accident occurrence in transporting dangerous substances have direct influence on accident frequency and common road traffic participants do not have sufficient knowledge of the problems of dangerous substance transport have been confirmed.

The purpose of this thesis is to present the main features of out-of-court dispute resolution (alternative dispute resolution) with mediation in civil and commercial issues under Directive No. 2008/52/EC, Act No. 202/2012 Coll., on Mediation and Change Some Laws ("Medition Act"), and Spanish Act No. 5/2012 on Mediation in Civil and Commercial Matters. The thesis purpose is definition of ADR and types of ADR, mediation and its relationship with international law and legislation in the Czech Republic and Spain. The thesis is divided into five basic chapters. The first chapter explains the term ADR and its advantages and disadvantages, its methods, such as mediation, arbitration, early neutral evaluation, conciliation, minitrial, expert determination and ombudsman. The thesis also explains some hybrid methods of ADR, such as med-arb and arb-med. The second chapter is devoted to the mediation. OF DIPLOMA THESIS IN ENGLISGH LANGUAGE The matter of accession of the European Union to the European Convention on Human Rights has been for decades a hot topic of legal and academic discussions. On the 18th December 2014, the Court of Justice of the European Union issued its long awaited Opinion 2/13 where the CJEU ruled that the Draft Accession Agreement is not compatible with EU law. In my diploma thesis I deal with the issue of accession of the EU to the ECHR. My aim is to provide with: 1) a complex analysis of the accession procedure, 2) an analysis of the Opinion 2/13 itself and 3) to outline the potential development of future steps. I particularly focus my attention on the CJEU reasoning in the Opinion 2/13 and I emphasize some facts showing the position of the CJEU from the different point of view. The first part of my diploma thesis provides an overview of development of the idea of the EU accession to the ECHR. Moreover, in the first part I deal with reasons for the accession, issue of legal basis for the accession and finally, I focus my attention to the negotiating process. The European Union is negotiating a free trade agreement with Japan since 2013. The subject of this diploma theses is to analyze how this agreement can influence either automotive industry. In order to understand the agreements possible influence, classical, neoclassical, contemporary and alternative theories of international trade and international trade policies are being examined. It is then analyzed what the agreement aims to accomplish in context of the Japanese macroeconomic, the history of trade relations and development, the current trade situation, production and demand on both markets. Finally, the agreement is compared to an existing agreement with Republic of Korea which is in a similar scenario. The result is that an increase of luxury cars being imported by each side is the most likely outcome.

The aim of the work is a detailed analysis of EU legislation (e. g. orders and regulation, direction and their transposition to the czech law) concerned with working conditions of drivers, enterpreneurs and all other persons operating in international road transport. A special emphasise is placed on the latest regulation form in this sphere (EU order number 561/2006), which brought the current changes. The work provides a comprehensive overview of the current legislative and shows the impacts of the new changes in practice. Beyond, it demonstrates and explains some concrete situations and problems from the working routine, that are dealed daily by the drivers, forwarding agents, transporters and the proprietors of transport companies as well.

The only discussed topic in the current round of negotiations are geographical indications and the creation of multilateral system for notifying and registering geographical indications for wines and spirits. Moreover, the thesis deals with the work of the TRIPS Council and several disputes related to TRIPS fulfillment.

The diploma thesis deals with the transport of dangerous goods in courier services. It is divided into three parts. The first part explains the term dangerous goods and its interpretation in different legal standards. In this part selected articles of the ADR Agreement and IATA DGR Regulations for road and air transport of dangerous goods are described. After the theoretical part the practical part begins, which deals with the practical aspects of transport of dangerous goods by selected courier companies and the service provided. This part also tries to identify the incidents which may happen during the transport of dangerous goods. The third part of the diploma thesis examines the transport possibilities of a particular shipment, vaccine of the fox against rabies produced by Bioveta, a.s. company. This part suggests two possible ways of transporting the vaccine, describes the necessary formalities to be followed and compares the price offers of the surveyed companies for this transport.
