The protection of domain names through trademarks The main purpose of my thesis is to define a status of domain names from a legal standpoint and also to analyze the possibility of covering the protection of domain names through trademarks. Assuming that a domain name fulfills conditions stipulated by a law it may become a subject to trademark laws and can be registered as a trademark in the register kept by the Industrial Property Office. The thesis is composed of five chapters. The first part of introductory chapter focuses on the technical aspects of domain names and institutions directly related to domain names. It focuses on history of the Internet, IP addresses and DNS servers. The second part of the first chapter is devoted to the structure and registration of domain names and also to foreign institutions directly related to of the Internet and its domain names. The second chapter describes the status of domain names in the Czech legal system and compares the legislation of Act no. 40/1964 Coll., The Civil Code and Act no. 89/2012 Coll., The Civil Code, relating to domain names as the subject of civil relations. Extensions to the self protecting object model to facilitate integrity in stationary and mobile hosts

M.Sc. (Computer Science) / In this dissertation we propose extensions to the Self Protecting Object (SPO) model to facilitate the sharing of information in a more effective manner. We see the sharing ofinformation as the sharing of objects that provide services. Sharing objects effectively is allowing the objects to be used in a secure environment, independent of their location, in a manner usage was intended. The SPO model proposed by Olivier [32] allows for objects in a federated database to be moved from one site to another and ensures that the security policy of the object will always be respected and implemented, regardless of its location. Although the SPO model does indeed allow for objects (information) to be shared effectively, it fails to address issues of maintaining integrity within objects. We therefore define the notion of maintaining integrity within the spa model and propose a model to achieve it. We argue that ensuring an SPO is only used in a way usage was intended does not suffice to ensure integrity. The model we propose is based on ensuring that modifications to an SPO are only executed if the modification does not violate the constraints defined for the Sf'O, The model" allows for an spa to maintain its unique identity in addition to maintaining its integrity. The SPO model is designed to be used in a federated database on sites that are stationary. Therefore, having addressed the issue of maintaining integrity within SPOs on stationary sites in the federated database, we then introduce the notion of a mobile site: a site that will eventually disconnect from the federated database and become unreachable for some time. Introducing the mobile site into the federated database allows us to propose the Mobile Self Protecting Object (MSPO) and its associated architecture. Because of the nature of mobile sites, the original model for maintaining integrity can not be applied to the MSPO architecture. We therefore propose a mechanism (to be implemented in unison with the original model) to ensure the integrity of MSPOs on mobile sites. We then discuss the JASPO prototype. The aim of the prototype was to determine if the Self Protecting Object model was feasible using current development technologies. We examine the requirements identified in order for the prototype to be successful and discuss how these were satisfied. Several modifications were made to the original spa model, including the addition of a new module and the exclusion of others, we discuss these modifications and examine why they were necessary.

Legal protection of domain names The main purpose of this thesis is to provide complex information about the topic of domain names. In the last fifteen years, domain names have become a very valuable estate, that can generate millions of dollars. The value of domain names have been a cause of various exploitations, namely speculative domain registrations of attractive domain names. These registrations are infringing third person rights, mostly trademark rights. The issue at hand with domain names seems to be the registration process. The first come, first serve principle that is associated with domain name registration can be a cause of various legal infringements. The thesis is divided into eight chapters. The first three chapters are an introduction into the world of domain names, providing necessary information about what domain names are, what is their definition and how they are categorised. The subject of the fourth chapter are the main organisations that have the most influence on domain names, where historical context and a summary of their functions are provided. Legal protection of domain names This diploma thesis provides overall introduction of domain names problematic, the topic which has witnessed stable rise of popularity over the last two decades, with special emphasis on its legal aspects and possibilities of legal protection. Mass expansion of the domain names over the years came hand in hand with some displeasing side effects, namely increasing occurrence of speculative behaviour residing in bad faith registration of attractive domain names. This practice, so called cyber squatting, rests in systematic abuse of key domain name registration principle first come first serve. As a result of increasing number of intellectual property infringements, namely trademark rights, the need for adequate techniques of domain name protection was highlighted. This task however was not going to be easy. From the legal point of view, domain names are very specific institution in a sense that explicit legal regulations are typically lacking and the rules of this exciting sphere are defined based on the soft law principles drafted by the nongovernmental domain names authorities. This treatise provides an overview of the procedures for the registration, regulation and protection of Internet domain names. An analysis of legal rules applicable to domain names and problems related to the protection of domain names in South Africa, United State, United Kingdom and internationally is undertaken. The problems includes cybersquatting, misuse of personal names, reverse domain hijacking, misuse of meta tags and keywords. The treatise established possible solutions applicable to South Africa by investigating how other countries have dealt with such problems, and further investigated the extent to which South African legislation is suited to deal with such problems. An investigation of the regulation in terms of the Electronic Communications and Transactions Act 25 of 2002 is briefly attempted, and proposals for the future on the South African domain name system suggested.

Domain names are much discussed issue these days yet not that well understood by Internet users. Diploma thesis Qualitative factors affecting the value of a domain name, as the title suggests, focuses on technical and marketing elements of the domain together with the content of websites and their influence on the value of domain names. In the first part there are different factors and their influence described in theory, the practical part then applies to a specific case for domain Nemovitosti.cz. This domain was compared in terms of market, competition and their technical and marketing site. To support factors related to website content, statistics put inside the website were used as well as freely available online tools. After evaluation of all factors Nemovitosti.cz domain, the author concludes that the domain is valuable in its field and its value in the future due to investigated factors will increase.
