A construÃÃo da moldura argumentativa em sentenÃas judiciais / The construction of the argumentative frame in judgments

Este estudo tem como objetivo principal analisar as construÃÃes argumentativas em sentenÃas judiciais. As sustentaÃÃes teÃricas para a pesquisa englobam a Teoria da argumentaÃÃo de ChaÃm Perelman e Lucie Olbretchs-Tyteca e a Teoria da EnunciaÃÃo de Jacqueline Authier-Revuz com os postulados sobre as nÃo-coincidÃncias do dizer interlocutivas, interdiscursivas e as figuras do bem dizer â o dizer como ato pessoal e o dizer de acordo com as leis do dizer. A junÃÃo dessas teorias se deu pelo fato de a primeira apresentar liÃÃes sobre o processo argumentativo, como um princÃpio de um discurso, que visa influenciar o auditÃrio, por meio de tÃcnicas argumentativas; a segunda teoria foi convocada para se localizar, nas estruturas argumentativas, as marcas do heterogÃneo e suas respectivas funÃÃes. O corpus desta pesquisa à formado por dez sentenÃas judiciais, de duas unidades judiciÃrias â a Vara de ViolÃncia DomÃstica e Familiar contra a Mulher e o 5 Juizado Especial CÃvel â todas pertencentes ao Tribunal de JustiÃa do Estado do MaranhÃo, da Comarca de SÃo LuÃs. As anÃlises das construÃÃes argumentativas foram realizadas na fundamentaÃÃo e na conclusÃo das sentenÃas. Os resultados comprovaram que a articulaÃÃo das tÃcnicas argumentativas com as marcas do heterogÃneo causa maior persuasÃo Ãs teses defendidas; tambÃm revelaram a presenÃa do nÃo-UM nos argumentos e um sujeito enunciador preocupado em restaurar o UM sentencial. / This study aims to analyze the argumentative structures in judgments. Theoretical supports of the research include the Argumentation Theory of ChaÃm Perelman and Lucie Olbretchs-Tyteca and the Enunciation Theory of Jacqueline Authier-Revuz, with the postulates on the interlocutive and interdiscursive non-coincidences of saying and figures of the well saying â the speech as a personal act and in accordance with the laws of saying. These two theories were brought together for the following reasons: the first theory brings lessons about the argumentative process as a principle of a speech aimed at influencing the audience by means of the use of arguments and argumentative techniques; the second one is used to find the heterogeneous marks and their respective functions in the argumentative structures. The corpus of this research comprises ten judgments of the State of MaranhÃo Justice Court, from two judicial instances: the court of Family and Domestic Violence against Women and the Fifth Special Civil Court, both located in SÃo LuÃs, Brazil. The analyses of argumentative constructions were done within the reasoning and conclusion of the sentences. The results showed that the articulation of argumentative techniques with the heterogeneity marks make the defended theses more persuasive; they also revealed the presence of both the no-ONE in the arguments and an enunciator subject worried to restore the sentencial one.
