The Canada-United States Safe Third Country Agreement : a constitutional analysisBorovan, Nicole A. January 2006 (has links)
This thesis examines the Safe Third Country Agreement between Canada and the United States from the perspective of Canada's obligations vis-a-vis asylum seekers under the Canadian Charter of Rights and Freedoms. The Safe Third Country Agreement requires asylum seekers to lodge their refugee claims in the first country of arrival, as between Canada and the United States. Asylum seekers on the United States side of the border who are seeking to enter Canada for the purpose of claiming refugee status will be deflected to the United States to lodge their claims there. By deflecting asylum seekers in this manner, Canada effectively conscripts the United States to carry out its obligations under the Charter to furnish procedural and substantive protections to asylum seekers. This thesis examines certain features of the United States asylum system to which asylum seekers deflected under the Safe Third Country Agreement would be subjected, in order to determine whether, according to relevant Charter jurisprudence, deflection constitutes a deprivation of security of the person under section 7 of the Charter and whether such deprivation can be justified under section 1.

Knowledge, attitudes, and behavior regarding organ donation among Ball State University studentsHawker, Jennifer L. January 2000 (has links)
The purpose of the study was to provide a descriptive data analysis for program planners on knowledge, attitudes, and behavior regarding organ donation among undergraduate students enrolled at Ball State University. An 84-item questionnaire was administered to undergraduate students. The subjects were obtained from a convenient sample.The data were analyzed using mean and Pearson's r to answer the research questions. The overall attitudes of the subjects were positive (M=20.88 out of a possible 26). The knowledge of the subjects toward organ donation was low (M=9.98 out of a possible 22). About one half of the subjects indicated that they are organ donors, by indicating on the survey that they have signed an organ donor card or a similar document. Attitude regarding organ donation (r =.232) was found to be a greater influence on willingness to become an organ donor than was knowledge about organ donation (r = .106). Recommendations are to submit results to program planners to help create more effective organ donation recruitment. / Department of Physiology and Health Science

Section 504 : the attitudes and perceptions of high school principals in IndianaCaddell, Tracy A. January 2007 (has links)
This research study was designed to determine the attitudes, and perceptions of Indiana high school principals concerning implementation of Section 504 of the Rehabilitation Act of 1973. The sample consisted of Indiana high school principals who held membership in the Indiana Association of School Principals. There were 222 high school principals who were requested to complete an on-line survey; 105 principals responded, which generated a response rate of 47 %.The Section 504 on-line survey was modified from an instrument in California in which the researcher studied the attitudes and perceptions of elementary school administrators (Williams, 2003).The data were analyzed, depending upon the variable, with a standard analysis of variance (ANOVA) or t-test design. Demographical data and survey responses were subjected to statistical analyses based upon the research hypothesis being examined. Demographical data collected from high school principals were degree earned, type of license, years of experience, gender, size of the school, whether the principal was responsible for implementing Section 504 plans, and if the principal categorized his school as rural, suburban, or urban.Results showed significance for high school size and whether the high school principal was responsible for implementing Section 504 plans. As high schools increased in the number of students, there was a need for principals to have additional training in implementing Section 504 plans. Another significant finding was that principals believe students with disabilities benefit educationally from having Section 504 plans at minimalcosts to their school corporations. However, principals also have a slightly negative attitude towards implementing Section 504 plans. Possible reasons for these results were discussed and a need for further research was offered. / Department of Educational Leadership

The goal of this thesis is to advance understanding of the ways in which discourses of reading, literacy and culture were used to reify class stratification in mid-twentieth-century America. This project uses the examples of The Reader’s Digest magazine and Classics Illustrated comic books to assess the adaptation and the ideologies surrounding textual form. It examines the efforts of self-proclaimed cultural elites to identify and denigrate middlebrow reading habits through dismissive critiques of texts and audiences as one moment in an on-going historical process of domination and exclusion. These avenues of exploration will reveal the complexity and variance of class definition in a pluralist democracy which, it turns out, are still very much a part of contemporary culture. The purpose of this study was to analyze the differences in the criteria utilized and the criteria desired by various types of institutions for granting appointment, reappointment, merit salary increases, promotion in rank, and tenure, and to propose criteria based upon this analysis. This study reveals that institutions differ according to the criteria which they utilize and desire for appointment, reappointment, merit salary increases, promotion in rank, and tenure. For example, two-year and four-year private colleges and universities consider age, health, personal appearance, and religious activities while two-year and four-year public colleges and universities disregard religious activities and place little emphasis on age, health, and personal appearance. In addition, four-year public and private institutions stress more than two-year public and private colleges degrees from prestigious universities, research, publications, and the Ph.D. in English. Furthermore, four-year private schools give more attention than four-year public institutions to student evaluations, classroom visitations, curriculum development, academic advisement, and supervision of student activities The study also reveals that as four-year public institutions increase in size, their interest in research and publications increases proportionally.

Reasonable accommodation under the Americans with Disabilities Act of 1990Dell, Jodi B. 26 July 1993 (has links)
The Americans With Disabilities Act (ADA) of 1990 requires that employers provide "reasonable accommodations" for qualified individuals who have a disability, provided that doing so does not result in "undue hardship". There are several guidelines that employers have been given to evaluate the reasonableness of job accommodations. Unfortunately, these guidelines have been criticized as being vague and ambiguous.
Specific factors considered when determining whether or not to grant an accommodation under the ADA have yet to be examined in psychological research. The current study evaluated the impact of cost of accommodations, position level of the employee, and attitudes of raters for their effects on judgements of the reasonableness of requests and on subjects' likelihood of honoring requests. Results showed that accommodations were rated as more reasonable and were recommended to be honored more often for higher level positions than for lower level positions. Measures of attitudes toward disabled persons, both in general and in the workplace, did not have many significant correlations with the dependent measures. Implications of the findings and ideas for future research are discussed.

Exotic others : gender and refugee law in Canada, Australia and the United StatesSimm, Gabrielle Anne 11 1900 (has links)
In this thesis I argue that race, culture and imperialism intersect with gender at the site
of refugee law to produce 'racialized and exotic others.' These exotic others are
refugee women whose differences from refugee decision makers in destination
countries are made crucial to their refugee claims by refugee lawyers, decision
makers and the system of refugee determination. I use a comparative methodology to
examine the gender guidelines for refugee decision makers and selected key cases
from Canada, the United States and Australia.
The gender guidelines represent a human rights approach to refugee law. I critique the
guidelines and relevant cases from an anti-essential ist perspective informed by
postcolonial, feminist and critical race theory. My discussion is organized by
contrasting 'exotic harms,' transgression of social mores and female genital cutting,
with treatment of 'familiar harms', domestic violence and sexual assault. I aim to
show how the distinctions between the exotic and the familiar are founded on
orientalist notions about other women in other places. I seek to suggest strategies for
refugee advocates, decision makers and academic lawyers to avoid perpetuating
orientalist notions of other countries and other cultures. I conclude, however, that
refugee law is a limited project whose solutions to the problems faced by refugee

Public Research Universities as Gendered Organizations: Institutional Rewards and the Faculty Salary GapJohnson, Jessica Ann (Higher education researcher) 05 1900 (has links)
Gendered organizational conditions create the context for persisting differences between men and women in the workplace. Within, higher education, this manifests as a salary gap between male and female faculty members. The academic capitalistic policy environment creates the conditions for increasing competition for external funding, especially in the areas of research and science and engineering. The change in the academic climate may sustain or intensify the gendering of universities as organizations. Universities with the highest level of research activity were chosen for this study and formed the 130 public institution sample. This study used fixed effects panel regression analysis to explore the relationship between the faculty gender salary gap and institutional emphasis on research as well as science and engineering. In addition, the relationship between institutional emphasis and the faculty gender salary gap was explored over time with the inclusion of a time trend and temporal interaction terms. Results showed that the higher the percentage of female faculty members, the greater the faculty gender salary gap for assistant professors. In addition, science and engineering emphasis over time had a significant impact on the professor salary gap with a decreasing effect both at the mean and one standard deviation above the mean, but with an increasing effect on the salary gap for institutions one standard deviation below the mean. When taking action to increase gender equity, it is important for universities to recognize that the faculty gender salary gap occurs in an organizational context impacted by institutional-level conditions.
