Suchomel, Jakub January 2016 (has links)
The purpose of this thesis is to provide an overview of the development, concept and rules of the exhaustion doctrine on the international and EU level. The issue of the exhaustion doctrine and its application in a digital age became topical after the unexpected judgement of the CJEU in case UsedSoft v Oracle, in which was for the first time broken the conventional link between the exhaustion doctrine and the distribution of works in a tangible form. Although this decision has been widely criticized by legal experts, some thoughts of CJEU highlight imperfection of current legal regulation in a context of an internet age. The first chapter defines basic terms the intellectual property and the copyright including its historical evolution. The second chapter describes the origins of the exhaustion doctrine in the judicature of the national courts as a clue for balancing ownership and intellectual property rights. The extensive third chapter deals with formation of the exhaustion doctrine in judicature of the CJEU. Concrete cases are used to describe basic elements of the exhaustion doctrine. In the fourth chapter is a brief overview of the legal regulation concerning the exhaustion of copyright on the international, EU and Czech level. Zdroje financování investic krajů / Sources of founding of regional investments

Nardelliová, Klára January 2013 (has links)
The thesis deals with the sources of funding of regional investments. Financing the investments by own resources is very difficult and maybe even impossible. Regions gained the opportunity to co-finance investments using European subsidies after the accession to the European Union. This thesis tries to find out what is the meaning of these subsidies to finance regional investments. The primary objective of this work is to determine the share of European subsidies on regional investments. Furthermore the thesis focuses on finding the common features of these investments and subsidies. The results of the analysis shows that proportion of European subsidies on capital expenditure is significantly different between regions. The amount of share is between 23-99%. European subsidies are mainly used for large investments, especially in investments in transport infrastructure. Regions usually utilize subsidies only from the regional operational programs. The conclusions of this work can be used in determining goals of EU regional policy.

Dopady rozsudků Soudního dvora EU na známkové právo s přihlédnutím k případům firmy L'Oréal / Effects of judgments of the Court of Justice of the European Union on trade mark law with further analysis of cases concerning the L'Oréal Group

Kubínová, Aneta January 2013 (has links)
This thesis analyses the effects of judgements of the Court of Justice of the European Union on a particular company represented by the French transnational corporation L'Oréal Group. In the first chapter I explain the system within which the protection of the intellectual property is realised. Firstly, I define the key concepts of the intellectual property, and then I introduce the means of the legal protection of the intellectual property on both national and international level. The analysis of the trademark law of the European Union follows in the second chapter where I examine its presence in both primary and secondary law, where I describe the roles of the Court of Justice of the European Union and the Office for Harmonisation in the Internal Market and where I introduce the most important judicature of the Court of Justice of the EU related to the trademark law. The third chapter is of the highest practical importance as it contains the discussion on the effects of judgements of the Court of Justice of the European Union on the L'Oréal Group in the form of a case study. Firstly I analyse the economic strategy of the group and I assess the importance of trademarks for L'Oréal, then I introduce the most important cases of the Court of Justice of the EU in which L'Oréal has been a party to the dispute. I conclude this chapter with the analysis of the effects of judgements of the Court of Justice of the EU on L'Oréal.

Role ASEM v euroasijských vztazích / The Role of ASEM in Eurasian Relations

Beroun, Vladimír January 2010 (has links)
The main objective of our doctoral thesis is to evaluate the role of the Asia-Europe Meeting (ASEM) and its political, economic and socio-cultural pillars as a political process in interregional (multilevel) governance in Eurasian relations. We have conducted a unique case study that is based on a holistic qualitative interpretation by means of a postpositivist perspective and discourse analysis. Given the transitional and multidimensional nature of interregionalism as a political process, we are applying the (neo)realist balancing with elements of (neo)liberal multilateralism and social constructivism as the basic theoretical approach. Based on this structure, we have come to the conclusion that (1) ASEM as an interregional policy framework is too flexible (in terms of its scope and agenda-setting) and too inclusive (in terms of its enlargement). (2) Given the inability of ASEM to actively respond to various challenges and to implement properly its policies through its currently available instruments, this Eurasian interregional process cannot be regarded as a fully-fledged contribution the global (multilevel) governance. (3) Therefore interregionalism as part of the ASEM process will not lead to a creation of an "Eurasian Century", despite the undeniable need to identify corresponding supranational political regimes that will efficiently promote a balance of power between Europe, Asia and America. (4) Interregionalism as a political approach cannot be demoted to a loose and informal interaction of nation states or regions only because the current challenges in international relations require an organized and results-oriented framework for cooperation. (5) Additionally, the existing bilateral relations between individual countries in Asia and Europe will continue to be the key and most efficient form of solving various issues and challenges between the states.
