Medicate to execute constitutional and ethical considerations

The United States Supreme Court has not yet examined several aspects of the death penalty. One aspect is the ability for the state to forcefully medicate an incompetent inmate, which may result in the inmate appearing competent for execution. While the Supreme Court' ruled that it is unconstitutional to execute an inmate who is incompetent, inmates who would have had their executions vacated due to mental illness are executed because the state can put them on an involuntary medication regimen. According to many experts, involuntary medication regimens mask the affects of their illness instead of providing a cure. Experts often refer to this practice as the "chemical straitjacket." Because the effects of antipsychotic medication, inmates may be sedated to a point where they appear competent, but in reality, they are sedated to a point where their mental illness is still present yet undetectable. As a result, placing condemned inmates on involuntary medication regimens has the possibility to violate the inmate's Fifth, Sixth, Eighth and Fourteenth Amendment rights. The intent of this thesis is to examine whether the Supreme Court has successfully upheld its duty to promote a fair judicial system by allowing the medicate to execute scheme to continue. Through the analysis of case law, law review articles, and the American Constitution, this thesis will evaluate the treatment of condemned inmates who show signs of incompetence. Through analysis, this thesis aims to raise awareness to an issue that, in the opinion of this writer, deserves the attention of American courts and other governing bodies.

O império revisitado: instabilidade ministerial, Câmara dos Deputados e poder moderador (1840 - 1889) / The revisited Empire: ministerial instability, House of Representatives and moderating power (1840-1889)

Este trabalho tem por propósito central investigar as razões da instabilidade ministerial no Segundo Reinado (1840-1889), bem como o papel desempenhado, na produção desse fenômeno, pelas relações entre o governo e a Câmara dos Deputados. A partir do exame de todos os episódios de substituição de gabinetes no período histórico mencionado, elabora-se uma classificação das razões de retirada dos ministérios, com foco na eventual atuação política da Coroa e da Câmara dos Deputados nesses eventos. Ao contrário do que supõe a literatura convencional, que salienta o papel autônomo da Coroa na substituição dos governos, o trabalho constata que conflitos, efetivos ou potenciais, entre gabinetes e o Poder Legislativo, em especial a Câmara, foram os principais fatores associados à rotatividade governamental no Segundo Reinado. Explora-se, a partir daí, a hipótese de que a introdução de regras eleitorais distritalizadas, no sistema político da época, a partir da década de 1850, em substituição ao regime prévio de listas, ao alterar os incentivos a que estavam submetidos os principais agentes políticos imperiais, desempenhou um papel central na geração daqueles conflitos, concorrendo, assim, para explicar o fenômeno da instabilidade governamental inicialmente referido. / The main purpose of this work is to investigate the reasons of the ministerial instability in the Second Empire (1840-1889) as well as the role played in the production of this phenomenon by the relations between the Government and the House of Representatives. From the studies of all episodes of cabinet replacements during the historical period mentioned, a classification of the reasons that motivated its withdrawals were elaborated, focusing on the eventual political action of the Crown and the House of Representatives in these events. To the contrary of what is believed by conventional literature, which highlights the independent role of the Crown in the substitution of the governments, this text notices that real or potential conflicts between the cabinets and the Legislative Power, in special the House, were the main factors associated with government turnover during the Second Empire. It explores, from there, the hypothesis that the introduction of district electoral rules in the political system of that time, starting from the 1850s, in substitution of the former regime of slates (chapas), changing the incentives which the main imperial political agents were submitted, played a leading role in those conflicts, contributing thus to explain the instability mentioned before.

La mémoire prospective : implication des processus mnésiques et de contrôle / Prospective memory : memory and control processes involvement

La mémoire prospective (MP) est la capacité de se souvenir d’exécuter une action dans le futur. La MP se distingue de la mémoire rétrospective (MR) notamment par le fait que la récupération du souvenir doit être auto-initiée alors qu’on est occupé par une autre tâche. L’objectif principal de cette thèse est de mieux comprendre la communauté et la spécificité des processus mnésiques et de contrôle impliqués dans les situations de MP par rapport aux situations de MR comme une tâche de reconnaissance. La démarche est d’imbriquer une action planifiée dans des tâches dont la demande mnésique et la difficulté sont contrôlées. Nous étudions ainsi l’interférence réciproque entre la MP et la MR. Nous étudions également les stratégies de maintien en fonction de la présence ou non d’un indice d’exécution. Les données comportementales montrent que l’action est exécutée plus rapidement sans indice d’exécution qu’avec indice, ce qui suggère un maintien actif sans indice. La MR interfère avec les performances de MP. Les mesures du modèle DPSD de la MR montrent qu’imbriquer une action planifiée dans une tâche de reconnaissance module le contrôle de la décision de reconnaissance et que le maintien actif interfère avec la familiarité. Enfin les résultats électrophysiologiques montrent une positivité pariétale modulée à la fois par la récupération d’une action planifiée et par une tâche classique de reconnaissance. Ces résultats suggèrent 1) une communauté des processus mnésiques en MP et en MR, mais 2) qu’être dans un mode de fonctionnement plus contrôlé est une spécificité de la MP, et que 3) le maintien actif est une caractéristique importante de la MP. / Prospective memory (PM) refers to the ability to remember to perform an action at some point in the future. Prospective memory is distinct from retrospective memory (RM) particularly because retrieval of the memory must be self-initiated while being engaged in an ongoing task. The main goal of this thesis was to better understand shared and specific memory and control processes involved in PM situations compared to RM situations (e.g., a recognition task). Our approach was to use tasks whose memory demand and difficulty were controlled and in which an intended action was embodied. This allows to study the mutual interference between PM and RM. We also studied maintenance strategies while manipulating the presence of an execution cue. Behavioural data showed that execution of the intended action was faster without than with a cue: this suggests active maintenance without an execution cue. RM interferes with PM performance. Measurements of the DPSD model showed that the embodiment of an intended action in a recognition task influences the control of the recognition decision, and that active maintenance interferes with familiarity. Finally, electrophysiological data show a parietal positivity modulated by the retrieval of an intended action and by a recognition task. These results support the idea that 1) PM and RM share common memory processes, but 2) that PM specifically forces a more controlled operating mode, and that 3) active maintenance is an important characteristic of PM.
