Economic impossibility to perform Change of circumstances in new Czech civil code The topic of this thesis is the institute of economic impossibility to perform, or respectively change of circumstances. This institute of civil law is a part of new Czech civil code. This code shall be in effect on 1st January 2014. Similar institute has not been codified in our legal systém before. The economic impossibility is an institute focused on dynamics of surrounding circumstances of a concluded agreement. It solves exceptional cases in which unexpected events occur that adversely affect the functioning or equitable balance of the agreement. The uncodified nature of the institute does not mean that the cases were not solved before. Actually on contrary. After the 1st and the 2nd World War, especially after the first one, the czechoslovakian courts had to decide many cases related to this matter. In the first chapter of this thesis I have defined economic impossibility and related terms. After that I have shortly presented a history of institute of commercial impossibility and in chapter three I have focused intensively on a doctrine of the Czech first republic (1918 - 1938). O trabalho propõe a tentativa e o fracasso como movimentação do fazer artístico. Por acreditar na experiência cotidiana com a força escritural, em seu caráter performático, investe na possibilidade de ativar o desenho latente no mundo. Ao investigar a palavra como tentativa de ordenação e como uma condição de possibilidade da arte contemporânea, discute-se (e, simultaneamente, pratica-se) o risco, o acidente introduzido pelo poético em seu caráter desestabilizador,a fim de debruçar-se sobre o aspecto não estável das relações prático-teóricas, entre o texto e a matéria plástica, entre imagens e palavras. A dissertação busca, (na tensão da) experiência, a reflexão inesgotável diante da energia gasta na convivência com a matéria-pensamento, com a palavra que é carne. O horizonte da pesquisa é a impossibilidade - dentro do texto do artista que tangencia seu próprio trabalho de colocar-se em movimento em direção a um fim que não seja o caminho. / The research is one of the possible development of the action of drawing as a requirement of the body. This work proposes the attempt - and the failure - such as the movement of making art. Believing in the everyday experience with the scriptural force in its performative character, invests in the possibility of activating the latent drawing in the world. By investigating the word as an attempt at ordering and as a condition of possibility of contemporary art, discusses (and, simultaneously, practices) the risk, the accident introduced by his destabilizing poetic character, to look into the not stable aspect of the practical-theoretical relations between the text and plastic matter, between images and words. The dissertation intent to, (in tension of) experience, reflect on the inexhaustible energy expended in the intimacy with the material-thoughts, with the word that is flesh. The horizon of the research is the impossibility - within the artists text who formulates about his own work - to puts in motion towards an end other than the path.
