Daňová konkurence v EU a možnosti eliminace jejích negativních dopadů

Dvořáková, Veronika January 2012 (has links)
Globalization and integration of markets gradually weaken not only the actual boundaries between states, but also tax limits. The growing interconnect-edness of national economies and markets causes tax competition, which may be advantageous for some states, but for others it may be a threat to undermine public budgets. While tax competition generally increases efficiency, it may also have undesirable consequences that may lead to a race to the bottom. Also, differences in the taxation of capital in different countries mean that there are capital shifts to the tax-favourable jurisdictions for the purpose of tax avoidance in the home country. The question therefore arises as to whether tax competition is not an obstacle to effective taxation of corporations, and whether and how governments should counter threats to undermine public finances. While some require mutual cooperation in the coordination and harmonization of direct taxation in the European Union, others argue that the most effective solution is market allocation and acceptance of tax competition. Opinion is divided over whether to maintain or remove tax competition and this leads to a discussion of whether it is really beneficial or harmful. The aim of the dissertation is to answer this question. The dissertation empirically evaluates the level of tax competition in the European Union and using panel analysis it verifies on a sample of 27 Member States over the period 1998 to 2010 that tax competition is not harmful, it does not lead to impoverished public budgets and to a race to the bottom in the EU-15. It also comes to the conclusion that the new EU-12 states do not cause harmful tax competition with the original EU-15 states. In connection with this the dissertation also focuses on the need to protect the tax bases of individual states. It deals with economic aspects of general and specific anti-abuse rules in national tax systems of the Member States and verifies why, in addition to general rules, states should implement specific measures in the form of CFC rules to defend themselves against tax evasion and tax avoidance.

And especially those which can be crucial for a foreign investor when contemplating about investing in Australia. The thesis is divided into 6 chapters. The first chapter introduces the topic of foreign investment and the thesis itself. The second chapter familiarizes with the key terms in international investment law, namely, investor (both a natural and legal person) and investment (in economic and legal sense). The third chapter describes the legal framework governing foreign investment in Australia. It provides an overview of domestic and also international legislation. The fourth chapter then deals with admission and establishment of investment in Australia. It covers how this issue is regulated in investment treaties and in domestic legislation, where the most important piece of legislation is Foreign Acquisitions and Takeovers Act. Further, this chapter describes the concept of foreign person and the national interest test. Plavec, Martin January 2016 (has links)
74 ABSTRACT This thesis deals with the private equity industry. Its aim is to coherently introduce private equity as a distinctive and integral part of today's economy, to provide relevant insight on the principles of functioning of private equity business model, and to analyse the mechanism of the most commonly used private equity transaction type. The thesis is structured into three chapters with each chapter being dedicated to one of the sub-aims. First chapter defines the notion of private equity and discusses the history of the industry and its economic performance. Private equity encompasses all types of equity investments into non-publicly traded companies. The industry itself has been gaining on significance since its emersion in the 1980s, mainly due to the fact that private equity investments have been consistently outperforming public markets in terms of realized returns. Second chapter is dedicated to the business model of private equity funds, their structure and lifecycle, as well as the investment process itself. Private equity funds take on the limited partnership legal form, which is managed by a professional private equity house while the investors' involvement consists solely in the provision of capital. A fund's lifetime is usually limited by a period of ten years and its lifecycle is...

Inkubační strategie vybraných druhů kachen / Incubation strategies of selected duck species

Klvaňa, Petr January 2010 (has links)
- 9 - Incubation strategies of selected duck species Summary of the PhD. thesis Avian incubation is an energetically demanding process. It holds true especially for uniparental incubators in which all incubation efforts are restricted to one individual. All ducks species breeding in northern hemisphere are representatives of birds with uniparental care. High demands of clutch formation and incubation make from ducks perfect model for testing factors influencing parent investment decisions. On the other hand parental investment to actual breeding attempt depends on many factors including breeding season duration, food supply, female's age, risk of predation or resilt of previous nesting attempt. So investigation of this complex problematic is extremely difficult. This thesis is focused on the most important phase of breeding cycle - incubation of clutch. Clutch incubation is associated with high energy cost to maintenance optimal temperature conditions for developing embryos. Morover incubation process can has large effect on female's body mass because of reduction of feeding time. Incubation strategy of success female include many partial tactic reducing predation risk of clutch and incubating female or eggs cooling. The incubation strategies of three ducks species were investigated in this thesis - Mallard...
