The purpose of this study is to explain the development of real estate registration in Bohemia and Moravia from the very beginning belonging to the 11th century to the last stage of development prior to the current arrangements. Thanks to this study should be easier to understand the current treatment of real estate cadastre in all its complexity. Thus, including the principles and tools from which it is based. The whole historical development is no less interesting areas, where the development of real estate registration, always reflect the current major historical events. Some events can interfere with the subject more and some less, but this issue, which is intersecting virtually the entire period of Czech Statehood, can't be investigate without the knowledge of the historical circumstances specific to each developmental period. This study is divided into two chapters. The first chapter deals with public books, which are instruments in which they were written ownership rights to real property for the purpose of ensuring and strengthening the rights of the owner against foreign interference in its ownership. 1 Abstract The purpose of this thesis is to illustrate problems that arise in the transfer of ownership of real property using purchase agreement. The main reason for my research in this field is the undeniable importance of purchase transfer of ownership of real property and its economic significance. The thesis is divided into introduction and conclusion with five different chapters in between, each chapter dealing with a different characteristic or problem that might arise while concluding purchase agreement. Chapter One is introductory and defines purchase agreement on real property transfer in general and is subdivided into five parts. Part One describes historical evolution. Part Two deals with its modification in connection with Act No. 89/2012 Coll. (hereinafter "New Civil Code"). Part Three describes main characteristics of purchase agreement on transfer of real property. Part Four in its three sub-parts deals with essential requirements of purchase agreement on transfer of real property, which are subject, purchase price and identification of contracting parties. The land are for society irreplaceable and limited estate. For this reason legal order requires planty of requests for their conveyancing, which consist two phases. In the first phase is concluded the assignment of real estate contract, for which are required tightened formal and contentual elements. Second phase take place in Land Register, alternatively in Regional Court and consist in the record of property rights in the Land Register. During the process of transfer of title to land collide the law of obligations with propriety rights, just as private with public law, which produce plenty of specific charactersitics for this process.

Records of rights and other data in the Land Registry should be considered as very actual topic because of the new Act No. 89/2012 Sb., Civil Code. This Act contrary to the previous legislation brought out a lot of changes, which had to be integrated in to the legislation of the Land Registry. Changes consits from different definition of the immovable thing, and from raising of various rights newly registered in the Land Registry including rights with the character of the obligation. Major change is in the reinforcement of the principle of publicity material of the Land Registry, which make it possible to acquire the right of ownership and other rights in rem from somebody, who is not really an owner, if the conditions of the law are met. With the reinforcement of the principle of publicity material the Act No. 89/2012 Sb., Civil Code, brought out also tools for real owners and other entitled persons from others rights in rem to defend themselves before the principle of publicity material, which was also necessary to project in to legislation of the Land Registry.
