Of nature and people : community-based natural resource management and land restitution at Makuleke

Thesis presented in fulfilment of the requirements for the degree of Master of Social Anthropology at the University of Stellenbosch / Thesis (MA (Sociology and Social Anthropology))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: This thesis is an exploration of how a new development culture has been cultivated at the end of the 20th century in reaction to the ‘crisis of development’ and the need to bring relief to impoverished communities in an environmentally sustainable manner. I uncover the key constraints on and opportunities for sustainable development and Community-Based Natural Resource Management that have emerged in land restitution claims in conservation areas in South Africa. I look at how inherited socio-political pasts poise actors and influence the relationships and interactions between them, how the current nature-tourism industry works to the detriment of some and the benefit of other actors in terms of gaining economic success and ultimately how these two factors influence conservation-based CBNRM projects. I examine three cases, namely: the Aboriginal community in Kakadu National Park, the Khomani San in the Kalahari Gemsbok National Park and the Makuleke in Kruger National Park. Through this examination I draw specific conclusions: the repercussions of racial segregation policies puts community actors at a disadvantage when engaging with their partners; specific dynamics of the tourism industry threatens the success of CBNRM projects because the expected substantial benefits are not always guaranteed; and the lack of sound local governance impedes sustainable development at community-level. / AFRIKAANSE OPSOMMING: Hierdie tesis is ‘n verkenning van hoe ‘n nuwe ontwikkelingskultuur gekweek is aan die einde van die 20ste eeu deur die ‘krisis van ontwikkeling’ en die noodsaaklikheid om verligting te bring aan verarmde gemeenskappe op ‘n omgewings-volhoubare wyse. Ek lig die beperkings en kerngeleenthede tot volhoubare ontwikkeling en Gemeenskaps-Gebaseerde Natuurlike Hulpbronbestuur uit wat in grondhervormingseise in bewaringsgebiede in Suid-Afrika na vore gekom het. Ek kyk na hoe die historiese sosio-politiese erflating rolspelers posisioneer en verhoudings en interaksies tussen hulle beïnvloed, hoe die huidige natuur-toerisme industrie tot die nadeel van sommige en voordeel van sekere ander rolspelers werk in terme van die verkryging van ekonomiese sukses en uiteindelik hoe hierdie twee faktore bewarings-gebaseerde GBNHB beïnvloed. The role of memory in urban land restitution : case studies of five families in Stellenbosch

Thesis (MA (Sociology and Social Anthropology))--University of Stellenbosch, 2011. / ENGLISH ABSTRACT: Limited academic work has paid attention to the memories generated by claimants engaged in the restitution process. My thesis thus sought to investigate the role of memory in urban land restitution, with specific focus on the Stellenbosch context. In my discussion, I highlight how claimant memories are not only generated by the restitution process but how the master narrative of restitution shapes the memories produced. I argue that claimant memories function and gain wider meaning within the collective memory, through which the master narrative of restitution shapes how they remember – and in so doing, how claimants reconstruct the place from which they were removed. My thesis elucidates how, through the individual narratives of removal and dispossession (and thus, the making of place), claimants position themselves as part of a particular and new form of “imagined community” of land claimants. The context of my research is focussed on the area previously known as Die Vlakte which was located in urban Stellenbosch. Dispossessed and displaced to the outskirts of Stellenbosch town in the early 1960s, the advent of democracy provided the former residents of Die Vlakte the opportunity to claim the land lost. The qualitative methodology of five selected case studies, sought to explore the following objectives of my study: Firstly, to examine how claimants remember and reconstruct the places from which they were removed (that is, the making of place); and secondly, to investigate whether these memories or individual narratives of place are shaped by the master narrative of restitution. By means of engaging prominent theorists and scholars on memory and the master narrative of restitution, my study analyses the various aspects of memory construction and reconstruction within the collective framework. The research points to the interdependent relationship between individual memory and that of collective memory. It is argued that individual memory can only function as part and in reference to the collective memory. Within the restitution process, research shows that the master narrative of restitution not only shapes but controls and organises memory on a collective and hence, individual level. My thesis argues that the individual memories of dispossession and removals of the claimants are similar to national narratives and hence, my thesis illustrates, that the five claimant memories of the place from which they were removed in Die Vlakte is shaped by the master narrative of restitution. Through relaying these narratives of removals and dispossession they thus draw on the master narrative of restitution (from which they derive legitimacy), in order to legitimise their own claim to land and in so doing, placing themselves within the “new” form of imagined communities of land claimants. / AFRIKAANSE OPSOMMING: Beperkte akademiese werk het aandag geskenk aan die herinnering wat deur eisers, wie betrokke was in die restitusieproses, gegenereer is. In my bespreking beklemtoon ek hoe eiserherinnering nie net gegeneer word deur die restitusieproses nie, maar hoe die meesternarratief van restitusie die herinnering wat geproduseer is, vorm. Deur hierdie narratiewe van verwydering en onteiening te vertel, ontleen die eisers aan die meesternarratief van restitusie (waaruit hul wettiging voortkom), om sodoende hul eie eis om grond wettig te verklaar, en deur dit te doen, hulself te plaas in die “nuwe” vorm van verbeelde gemeenskappe van grondeisers.

A public participation perspective of the process of post-settlement support in Elandskloof

Magister Administrationis - Madmin / Since the dawn of South African democracy in 1994, extensive laws and policies have been introduced to facilitate transformation in the political, social and economic spheres. While South Africa has been lauded world-wide for its detailed and sophisticated constitution, many cases attest to the challenges of implementing the stipulations of the constitution, laws and policies. Arguably, constitutional rights and entitlements do not automatically result in a better life for ordinary citizens post-apartheid. Moreover, restitution processes towards addressing the atrocities of apartheid are fraught with challenges. The process of land restitution is an example that illustrates the numerous challenges in implementing laws and public policies in South Africa. Restitution is one of the three pillars of land reform - the other two are land redistribution and land tenure reform - that were introduced by the African National Congress (ANC) -led government to secure land rights to black people in South Africa. Land reform is essential to bring about political and economic development and the South African government has committed itself to transforming land ownership to reflect the democratic realities and to redressing the history of dispossession and exclusion suffered by the black majority of South Africans. While the transfer of land and settlement of claims have been processed gradually, growing evidence shows that this does not simply translate into development, poverty reduction or reconciliation.

The impact of the Land Restitution Programme on the livelihood of rural communities : a case study of Ga-Makgato Community in Limpopo Province of South Africa

Dev.) --University of Limpopo, 2014 / This study aimed to assess the impact of the Land Restitution Programme on the livelihoods of the rural communities of Ga-Makgato village in the Molemole Municipality, Limpopo Province. As a basis of assessment, the primary and secondary data were collected and analysed. Electronic and non-electronic sources were used to collect secondary data while primary data were collected through pre-tested questionnaires. The study found that both males and females who are 38 in number participate in the land restitution programme. Of this number, 8% was found to be the youth, while the elderly and adults population of the beneficiaries of the CPA constitute 92%. Females constitute 47%, while the percentage of their male counterparts stood at 53%. In terms of the level of literacy, 11% of the total number of beneficiaries could not read or write and this is a serious concern of this study. Analysis of number of jobs created was also carried out. It was found in this study that the CPA managed to create on 38 jobs. In as far as income generating ability of the CPA is concerned, R1,5million was generated during the period under review. Of this amount, R710 000-00 came from the sales of Nguni cattle while the Bonsmara generated R650 000- 00. The following challenges were established in this study, i.e., lack of sufficient grazing space, lack of access to adequate funding, lack of technical and financial management skills, lack of sufficient government support, lack of access to adequate water sources, lack of access to markets, high electricity bills and lack of proper record keeping systems. 4 The following recommendations are provided:  The CPA should review the lease agreement;  LEDA should in consultation with other financial institutions assist the CPA in accessing funding;  The Department of Agriculture should provide the CPA with technical assistance;  The Department of Water Affairs and Agriculture should ensure supply of water and infrastructure;  The Department of Agriculture and LEDA should provide the beneficiaries of the CPA with market infrastructure and information;  The Molemole Local Municipality should provide subsidy for electricity bills; and  Policy makers should consider implementation of the job creation model provided in this study. If these policies can be successfully implemented, the land restitution programme in the Capricorn District, particularly at Ga-Makgato and surrounding villages, can become a major strategy for improving the livelihoods of the rural poor.

Implications of land reform on spatial planning and development in the Tzaneen Local Municipality / I. Henning

A thorough investigation of legislation involved in the land reform programme was conducted. This includes the Constitution of South Africa, as well as the legal frameworks that manage the land reform process. Many of the unintended results are because of misunderstandings. This study sought to clarify those misunderstandings and confusing language. The South African land reform process was excellently planned. The process is managed in three phases, namely land restitution, land redistribution and land tenure. There are some successes and failures due to the way those programmes were implemented. In order to implement and manage the land reform programmes and spatial planning on national, provincial and district level, the following plans were introduced: National Level: Pro-active Land Acquisition Strategy (PLAS) & Area-based Planning Provincial Level: Limpopo Growth and Development Strategy (LGDS) District Level: Mopani Integrated Development Plan Local Level: Greater Tzaneen Municipality Integrated Development Plan & Spatial Development Framework The study area, the Tzaneen Local Municipality, was chosen because it is home to some of the first land reform projects in South Africa, it is the district with some of the highest intensity of land claims and it offers a complete menu of land reform programmes in an advanced state on a small area. The impact that land reform has had on the spatial development in the Tzaneen Local Municipality has been studied in more detail. As the study progressed, it was realised that the impact not only stops at spatial development. The influence was much bigger than that. The local economy was affected, as were job opportunities, tourism, food security, the retail industry and even the mining industry. Such an impact is also not restricted to the Tzaneen Local Municipality. In order to control the land reform process, the government should involve the private sector in the land reform process. The moment this happens, the skills and experience locked in the private sector are transferred to the government for the benefit of all people involved in and influenced by the land reform process. An Integrated Land Reform Action Forum (ILRAF) must be established that manages the land reform process on national, provincial and local level. This ILRAF has to fulfil much the same purpose as the former Joint Monitoring Committees (JMCs) accomplished. The ILRAF must consist of all role-players within the land reform process. These include, national, provincial and local government officials, commercial farmers, key role-players from the private sector, farm worker representatives, Agri-SA, professionals such as town and regional planners and transfer attorneys, farmers? associations, commercial banks and the media to ensure transparency. In order to correct past mistakes and to ensure that the next five years of the land reform process goes off without a hitch, it is important to involve all role-players and ensure transparency throughout all decision-making processes. The impact of the land restitution programme on poverty

The state of poverty in South Africa dictates how social policies should intervene to make an impact on poverty alleviation. Government formulated the three pillars of Land Reform Programme i.e. the Land Restitution Programme, Land Redistribution Programme and the Security of Tenure Programme. The Land Restitution Programme was utilised, through which people were given the opportunity to choose their preferred option ranging from original land, alternative land, financial compensation and involvement in development projects. The Programme aimed to reduce the unequal distribution of land amongst the racial groups of South Africa and alleviating poverty. During the process of land restitution the subjective impacts were debated more than the objective impacts, which were exacerbated by the experience of Zimbabwe as one of South Africa’s neighbouring countries. To date, little empirical evidence exists concerning the actual objective and subjective impact of the Land Restitution Programme. The aim of the study was to evaluate the objective and subjective impacts of the Land Restitution Programme on poverty. A quantitative research approach was used to conduct an impact evaluation study. Data was gathered by means of self-administered questionnaires. Respondents included land restitution applicants, namely: the claimants who were dismissed because they did not meet the acceptance criteria, the claimants who rejected the offer of financial compensation and the claimants who accepted the land restitution offer of financial compensation and eventually became the beneficiaries of the Land Restitution Programme. The research findings revealed that the Land Restitution Programme has both objective and subjective impacts on poverty. The subjective and objective impacts have both positive and negative impacts. The positive objective impacts were revealed to include the improvement in the aspects of quality of life as individuals and as communities, reconciliation at an individual, family and community level, and personal development such as improvement in community participation, empowerment and capacity building. The line, however, between the subjective and objective impacts was found to be very thin. The greatest impacts were amongst the accepted land restitution claimants and the least impact was amongst the dismissed and refused claimants in comparison with the accepted land restitution beneficiaries. The findings confirmed the hypothesis of the study, namely that if the poorest of the poor beneficiaries receive the land restitution compensation their levels of poverty decreases, compared to those that are refused or dismissed for land restitution compensation. The study revealed that the negative impact of the Land Restitution Programme is on its ability to acquire title to land. The claimants and beneficiaries of the Land Restitution Programme still regarded the programme as effective even though it has challenges in terms of addressing poverty alleviation. The study concluded that the Land Restitution Programme should be implemented within a Framework for Poverty Alleviation. Such a framework needs to go beyond the legalistic framework that is provided by the Land Restitution Act no 22 of 1994 which currently do not address approaches to poverty alleviation, strategies for alleviating poverty and aspects of quality of life that are measurable. The study recommended the implementation of a Land Restitution Programme Framework for Poverty Alleviation, which include elements of measuring poverty and aspects of quality of life and poverty alleviation approaches such as the livelihood approach, asset vulnerability approach, compulsory asset redistribution approach, and social development strategies. An evaluation of urban and rural land use change, conflict and competition

Department of Geography amd Geo-Information Sciences / PhDGEO / This study set out to evaluate the extent of land use change, competition and conflict in Polokwane city and in selected land restitution areas of Limpopo province. The methods of data collection and analysis included document analysis, triangulation of quantitative and qualitative survey methods, use of Geographical Information Systems (GIS) techniques and field observations. The restitution studies relied on information from the regional land claims commission regarding land dispossessions, land claims and post settlement activities which were analysed using content analysis. Land use maps and data from department of land affairs were obtained covering different time periods from 1994 to 2002 and GIS analysis was used to document land use change, competition and conflicts. A questionnaire survey involving a sample of 240 residents, 164 business people and 16 government officials was conducted and analysed quantitatively to establish perceptions and experiences with land use changes. In-depth interviews with key informants were also conducted and information analysed qualitatively. The researcher also engaged in extensive field observations in the city and surrounding land restitution areas. The study found that both Polokwane city and the surrounding land reform areas were characterised by rapid land use change, competing interests, conflict, disputes and tensions related to access, control and use of land resources historically and currently. Other key findings include the fact that the structure of Polokwane area is a result of apartheid planning. It has a distorted spatial pattern, the result of political factors that can be identified as: a legacy of apartheid; land use policy; competition among potential users; inadequate legislation and planning; low provisions for land use control and rezoning; land use speculation and lack of adequate public participation in the planning processes. Polokwane interaction with the rural areas is inadequate and does not support development of these areas leading to persistent service delivery issues. A management strategy is recommended with the following features: Capacity building, Conflict resolution, Stakeholders participation and Governance. Adequate land use control mechanism need to be put in place; public policies should minimise conflicts between alternative land development strategies; existing policies and procedures applicable to land management should be reviewed. An effective national land reform programme is required to drive development; public participation is key in all planning activities. Mediation is essential because it is a more efficient and less costly means of concluding land use conflicts. Polokwane needs to play a greater role in managing land use, changes, competition and conflicts both in the capital city and in the surrounding rural areas.

South Africa, emerging from the yoke of colonialism and imperialism embarked on an ambitious land reform programme during the 1990’s. It was anticipated that land reform would take place effectively and sustainably. However, evidence to date revealed that land reform has been a failure and the cause thereof can be attributed to the lack of post settlement support. The focus of the research was to find out whether post-settlement support is the reason behind successful projects and if so to highlight the necessity of post-settlement support in land reform projects. The methodology used was through review of literature, legislations and policies on land reform and analysis of case studies. Outcome of the research indicates an intricate relationship between land reform and post-settlement support. The transfer of land to land reform beneficiaries must go hand in hand with the effective provision of post-settlement support for projects to be success and sustainable. / College of Law / LL.M
