Land Restitution in Colombia: Progressive Policy and Political Opportunity?

This paper studies the policy changes that have led to the design and early implementation of the land restitution program in Colombia. I use the land reform literature to frame land reform efforts in Colombia within the larger ideological discussion on land reform. The study maps out the roles of the main actors that influenced the actions of government regarding land reform and their role in shaping the present policies affecting land restitution. The paper argues that although the land restitution program provides an opportunity to initiate a peace building process and should be seriously considered as a measure to compensate the victims of the armed conflict, the present rural development model is an impediment to its success. Although, the more progressive coalition was able to achieve the approval of the land restitution program, the success of the program relies entirely on the wider rural development model being currently embraced in the country. The present rural development model puts an emphasis on the exploitation of extractive resources and other mega projects responding to global market demands; while illicit crops continue to provide an easy and profitable livelihood opportunity for many in the countryside. Such development does not support the livelihoods of returnees and thus does not compliment the land restitution program. The success of the land restitution program thus remains in doubt. The reason is that powerful actors support a neoliberal development model that continues to dominate the political agenda.

Administration of land problems and disputes in peri-urban areas surrounding Gaborone, Botswana

Abstract Peri-urban areas experience many land related problems and disputes because of rural-urban migration and increasing demand in land. The purpose of this thesis is to identify and describe the land problems and their related disputes that exist in two peri-urban areas surrounding the capital of Botswana, Gaborone. Two land boards administering these areas are studied in order to draw conclusions if there are any improvements that can be made to make the administration of land more effective.   The methods used in this thesis include: a literature review on previous made research to gain sufficient background and knowledge in the subject and a multiple case study to identify the most occurring land problems and how these are handled in the villages of Mogoditshane and Tlokweng. The case study included qualitative interviews with land board officers and experts within the studied subject.   The result from the literature review and the case studies shows similar result when it comes to land problems faced in Mogoditshane and Tlokweng. Common problems such as illegal occupations and multiple transfers lead to disputes over the right to land. The administration of handling these problems differ between the studied land boards as well as the approaches to resolving disputes that arises. For instance in Tlokweng they patrol the village in order to reveal illegal occupations. In the same land board they have also adopted the approach with alternative dispute resolution to reduce number of disputes entering the legal process.   It seems that one of the main causes for the land problems that occur in these areas is poor record keeping. Besides the improvements regarding record keeping, that is already in progress, this study has reached the conclusion that there are several measures that can be taken to make the management of land problems and related disputes more effective. The problem with shortage of land, which is another cause for land problems, could be reduced by an effective and unanimous land allocation process. Further we believe that by training both officers and board members in alternative dispute resolution methods and adopting an approach to try to resolve disputes before becoming a legal matter, will reduce costs as well as save time in the land administration.

Municipal Landownership and Housing in Sweden : Exploring links, supply and possibilities

This thesis comprises a number of studies, all directed at different linkages between municipal landownership and housing in Sweden. In all, the thesis consists of four papers. Of these, initial Paper I targets the emergence of the municipal landownership that still today are of crucial importance for the Swedish housing market. The main functions of the municipal landownership from the beginning of the 20th century and up until present time are retrospectively investigated and its role within Swedish housing during different times is elaborated upon. Paper II thereafter redirects focus to present time solely, and studies the management of the municipal land from particularly a housing perspective. More concretely, the disposal procedure – or land allocation practice – of the municipal land aimed for housing is investigated empirically, based on current practice in more than 25 municipalities. Paper III builds on preceding Paper II, but with a narrowed focus to a fundamental sequence of the disposal procedure – namely the developer selection. Accordingly, four different assigning methods, all derived from municipal practice, are discerned and their individual strengths and weaknesses are systematically discussed. Lastly, Paper IV attempts to illuminate an often overlooked dimension of the municipal landownership – as a potential and powerful instrument to counter polarizations between different social-groups, within the built environment. Necessary prerequisites in order to enable this are presented and an empirical study investigates whether this, somewhat concealed, potential in the municipal landownership seems to be utilized in practice. / <p>QC 20161103</p>

Land Cover Change Analysis of the Mississippi Gulf Coast from 1975 to 2005 using Landsat MSS and TM Imagery

The population, employment and housing units along the Gulf Coast of Mississippi have been increasing since the 1970s through the 2000s. In this study, an overall increasing trend in land cover was found in developed land area near interstates and highways along all three coastal counties. A strong positive correlation was observed in Hancock County between developed land and population and developed land and housing units. A strong negative correlation was observed between vegetation and housing units. Weak positive correlations were found in Harrison County between developed land and population, marsh and population, and marsh and housing units. A weak positive correlation was found in Jackson County between bare soil and population. Several study limitations such as unsupervised classification and misclassification are discussed to explain why a strong correlation was not found in Harrison and Jackson Counties.

<p>This thesis concerns the management and administration of tribal land in Botswana. The administration processes that are practiced today are neither effective nor suitable for present and future needs. Existing problems relates to registration, archiving and order among the ownership rights. A solution to these problems would promote a system that secures the right of each individuals land.</p><p>Our aim is to recognize the processes and work methods that are the reason for the mentioned problems in administration of tribal land. We want to find suggestions for solutions to these problems. To be able to recognize the existing difficulties a thorough literature review has been made as well as interviews with persons with dissimilar positions at three different land boards. Interviews were made at the Mogoditshane Subordinated Land Board, Tlokweng Main Land Board and Mochudi Subordinated Land Board. Questions asked concerned the Tribal Land Act, practice of land allocation and location of plots, appeals, recordkeeping and compensation.</p><p>We have also looked into how a pilot study regarding land adjudication directed by the LAPCAS-project, which is a five year running project in cooperation with Swedish Lantmäteriet and Ministry of Lands and Housing in Botswana, can act as one solution to the many problems that exists.</p><p>Our conclusion is that tribal land tenure in its own meaning is not a problem, the problem concerning tribal land lies in the administration thereof. Some common regulations for all land boards are needed to implement routines and structures that will improve the administration of tribal land. These kinds of routines can be learnt from involvement and close work with the LAPCAS-project.   </p>

The conflict between residential land and agriculture land in China is increasingly sharpened, especially when some urban development began to sprawl to the suburban and rural areas. In order to plan land resources properly, land suitability assessment is often conducted to determine which type of land use is most appropriate for a particular location. <br /><br /> The main objective of this study is to examine how land suitability assessment methods could be used in land planning processes in the Dianchi Drainage Area (DDA) in Southwest China to identify where future residential development should be located. The 1991 Toronto Waterfront Plan and the more recent 2005 Ontario Greenbelt Plan are examined and used to develop a framework which describes the potential for land suitability assessment in the DDA. Data limitations did not permit a suitability analysis to be completed for the DDA, however a description of methodologies for conducting residential land suitability analysis and required data are presented based on a review of relevant literature. The paper concludes with a discussion of the feasibility of land suitability in the DDA and other areas in China and also suggests opportunities for future research.
