LL.M. (International Commercial Law) / The passing of risk in the United Nations Convention on Contracts for the International Sale of Goods (CISG) is being regulated by Chapter IV, Articles 66-70. These provisions will regulate the passing of risk between the contracting parties unless they have chosen to deviate from it by way of Article 6 of the CISG. Article 6 provides that: “The parties may exclude the application of this Convention or, subject to article 12, derogate from or vary the effect of any of its provisions.” The most important purpose of Articles 66-70 is to determine who will bear the risk when the goods are lost or damaged due to an accidental event. “Risk” is not specifically defined in the CISG. The accidental loss in this case means that neither the seller, nor the buyer can be held responsible for the loss that occurred. Accidental loss in this context may also include acts of third parties.

Obviously none of that would have been possible without the arbiter’s performance, who is the most important figure in the procedure, and, given their essentiality, has specifics duties and qualities. These duties and qualities do not always come free of questions, which is why they will be analyzed in this study. Moreover, considering the fact that arbitration presents, as a guiding principle, the freedom of will of the parties, who must be aware of everything, there’s another question to be answered, equally important: working on the premise that all acts are practiced under the agreement of the parties, could any liability be applied to the arbiters, when exercising their judging function? Also, could the arbitrational agency, which usually manages the activities in the procedure, be responsible for anything as well? This is the purpose of this study, which aims first to approach the scope of the duties conferred to the arbiters and to the arbitrational agencies, and then the possibility of their civil liability / O instituto da arbitragem se constituiu, ao longo do tempo, como instrumento legítimo e alternativo à jurisdição, tendo servido para solucionar conflitos das mais variadas ordens. Obviamente, nada seria possível sem a atuação do árbitro, figura mais importante do procedimento, e que, dada sua essencialidade, possui características e deveres próprios em relação ao modo de atuação. Tais características e deveres nem sempre se veem livre de questionamentos, razão pela qual serão objeto de análise no presente estudo. Além disto, pelo fato da arbitragem apresentar como princípio norteador a autonomia de vontade das partes, que de tudo deverão ter ciência, surge uma outra questão, igualmente relevante: partindo-se da premissa de que todos os atos são praticados sob a anuência das partes envolvidas, possuiria o árbitro, no exercício de sua função de julgador, responsabilidade civil pelos seus atos? Igualmente, possuiria o órgão arbitral, que comumente gerencia as atividades do procedimento a mesma responsabilidade? Esta é a finalidade do presente estudo, que se propõe, inicialmente, a abordar os deveres conferidos ao árbitro e às câmaras de arbitragem, para então identificar a possibilidade da responsabilização civil na arbitragem
