Bankovní záruka / Bank guarantee

This thesis deals mostly with regulation of bank guarantee in Czech law, as well as with regulation on international level. The main aim of this work is to provide a complete perspective on bank guarantee, definition of its typical elements and its subjects and relations between the subjects, and to make classification of different kinds of bank guarantees. The work is divided into 12 main chapters and a great number of subchapters. Chapter one deals with a risk that is closely connected with bank guarantee, as bank guarantee is mostly used to secure risks. Chapter two is dedicated to historical development of bank guarantee and to previous regulation in the Code of International Business. Chapter three is focused on legislation of bank guarantee both in the Commercial Code and in other laws that regulate its use in the Czech Republic. This chapter is also concerned with the international law - mostly rules issued by the International Chamber of Commerce in Paris. Chapter four is mostly focused on characteristics of essential elements of bank guarantee, its differences from guarantee and its practical use. The purpose of this thesis is to analyse the status of the EU Charter in the system of EU law and its application by Member States. EU fundamental rights in the EU can be perceived as controversial, because they can be regarded as a means of control of Union institutions, but also as a way of expansion of EU competences. In this context I will explore the EU Charter. The thesis is composed of 5 Chapters. In the First Chapter I will explain why human rights protection was not included in the Founding Treaties; furthermore I will elaborate on the case law of the Court which gave rise to EU fundamental rights as general principles of EU law. I will also explain why human rights are a sensitive issue between the EU and Member States. Chapter Two examines the development, content and the legal effects of the EU Charter. It also explores the parallel regime of the EU Charter and EU fundamental rights as general principles after the Treaty of Lisbon. Chapter Three is the core of this thesis. It explains the scope of application of the EU Charter by Member States. Procesní aspekty občanského soudního řízení / Procedural aspects of civil procedure

The main theme of this thesis is the issue of the procedural acts of judicial proceedings (focused mainly on aspects of delays), in the code of civil procedure as part of the legal order of the Czech Republic. The theoretical part defines the procedural aspects of civil procedure. The main focus is on the delay of court proceedings on the part of the participant and subsequently the defence against delays in the proceedings caused by the court. The thesis contains the statutory documents of the legal order of the Czech Republic. The essential part of the theoretical thesis is the rights for the protection of citizens' rights, which are embedded in the Charter of Fundamental Rights and Freedoms and in the European Convention for the Protection of Human Rights and Freedoms. In this section main sources of information were the Code of Civil Procedure, the Civil Code, the Charter of Fundamental Rights and Freedoms and other laws that are closely related. The practical part of this thesis is focused on the issue of the frequency of court proceedings in the divorce rate and, consequently, on the amount of agenda of the court, statistically maintained by the executor of the judicial process, in this case by the District Court of Kolín (i.e.court of first instance). Statistics of divorces involve the years 2012, 2013, 2014 and 2015. There are even specific cases from judicial practice.

The diploma thesis deals with local government municipal politics in the city of Písek. The work is focused on the development of local government in the period after 1989 to the present. The subject of the work is an analysis of the local political system as well as its activities in the field of municipal development. The work is divided into theoretical practical. The theoretical part explains the basic concepts that are related to local government and communities alone, such as municipal government, municipal elections controversy. The practical part then characterizes Sand historical, demographic socio-economic perspective. It also focuses on communal politics in this city, dealing with local political entities running the council controversies that arise here. The practical part includes analysis also municipal elections between 1994 and 2014 and describes the development of local government after the last elections in 2014.

Vývoj místní samosprávy v obci Podlesí / The Development of Local Government in the Municipality of Podlesí

The thesis deals with the development of local government in the village of Podlesí. The village of Podlesí is situated in the Central Region, approximately two kilometers from the town of Pribram. On December 31, 2015, it had a population of 1 097 inhabitants. The main objektive of this study was to identify factors that influence the character of the local political process in the village of Podlesí. This is a case study that shows the development of the local political process here from 1990 to 2014. Working initially in the theory explains the concepts related to public administration, local authorities, the function of elections and electoral systems, municipal electoral systém and the local political process. The practical part describes the village of Podlesí. This description includes Podlesí´s history, its development of demographic characteristics and social amenities. After that an individual comparison of individual results of municipal elections from 1990 to 2014, personal interviews with local political figures and defined the character of local political processes in the village of Podlesí.

The main task of this thesis is to summarize the diplomatics material of guild corporations at Havlíčkův Brod area into integrated form. Bacause of broad topic, the selection was only focused on the textile craft occurring in this region and especially in deeds. In the introducion the work presents history of the guilds from their beginning to the final downfall - focusing on textile production. It summarizes the genaral situation of the surviving monuments. The edition which is created from deeds issued by these corporations and also by publishers for mentioned guilds - this is the main core of the thesis. The deeds are arranged chronologically according particular guilds and towns. They are completed by diplomatic analysis of internal and external signs and by the final study, which summarizes all the research.

This thesis deals with the fundamental right to the protection of personal data as enshrined in Article 8 of the Charter of Fundamental Rights of the European Union ('the Charter'). An analysis of the case law of the Court of Justice of the European Union (CJEU) on Article 8 of the Charter reveals an intriguing paradox: although this provision has been repeatedly invoked in order to enhance protection of personal data and has featured prominently in several far-reaching judgments (Digital Rights Ireland, Google Spain or Schrems), there is considerable uncertainty as to the substantive scope of the right to the protection of personal data. The relationship between the right to privacy and the right to data protection has proved difficult to untangle, and the autonomous nature of Article 8 of the Charter has not always been respected. The aim of the thesis is to analyse the purpose and content of this fundamental right with reference to the CJEU's case law and recent academic debate. This thesis is divided into four chapters. in English This thesis deals with the right to personal data protection as enshrined in Article 8 of the EU Charter of Fundamental Rights (the Charter) and its relationship with Article 7 Charter, the right to respect for private and family life. Since both of the rights have immediate relevance for EU data protection, their coexistence in the Charter necessitates an explanation as to their relationship, interaction and the merit of adding an independent right to personal data protection. However, such explanation is difficult to trace. International human rights instruments have traditionally safeguarded the protection of personal data by the right to privacy. The common constitutional traditions of the Member States differ significantly in the enactment of data protection and the EU legislation in force is likewise treating data protection as a privacy subset. The thesis firstly attempts to assess whether the right to personal data protection is capable of autonomous standing, detached from the privacy right and secondly, whether the CJEU allows the right to personal data protection to stand as an autonomous right in reality. Úprava azylového práva po vstupu Lisabonské smlouvy v platnost / The regulation of asylum law after the Lisbon Treaty entered into force

The aim of the thesis is to analyse asylum law of the European Union with focus on the changes, which introduced the Treaty of Lisbon. The paper describes development of the EU asylum law, establishing of the Common European Asylum System (CAES) and changes that Lisbon Treaty introduced in comparison with the former regulation. The text also deals with the right to asylum, which is established in the Charter of Fundamental Rights of the EU. The thesis is divided into 7 chapters. In the first part of the paper the author follows historical development of the asylum law of the European Union and beginning of the harmonization until adoption of the Amsterdam Treaty. The second chapter is dedicated to the establishment of the CAES, which more than 10 years ago became main priority of the asylum policy of the EU and which aims to harmonize asylum laws of the Member States and therefore ensure a unified application not only of international, but also of European legislation from this area.
