Resümee Das Ziel dieser Diplomarbeit ist eine komplexe Zusammenfassung und Analyse des Begriffs Kindesunterhalt für Minderjährige nach der Neukodifizierung des Privatrechts in der Tschechischen Republik und Wiedereingliederung ins Bürgerlichen Gesetzbuch, zusammen mit der Einführung des Begriffs Kindesunterhalt in den historischen Kontext und mit der Bewertung der Einflüsse der vorherigen Regelungen. Diese Diplomarbeit wird sich außer der Vorstellung dieses Begriffs in der tschechischen Rechtsregelung auch mit den Rechtsregelungen der Slowakischen Republik, der Bundesrepublik Deutschland und der Republik Österreich beschäftigen. Das erste Kapitel wird der Rechtsregelung der Tschechischen Republik gewidmet. Nach der allgemeinen Abgrenzung des Unterhalts und seiner historischen Entwicklung folgt die Regelung der Unterhaltspflicht und des Kindesunterhalts für Minderjährige. This master's thesis is concerned with an issue of the crime of Evasion of Alimony Payments under s. 196 of the Criminal Code. Next to this primary provision is this issue included in the next following provisions of the Criminal Code, namely under s. 196a of the Criminal Code, regulating still relatively new provision of punishment, and under s. 197 of Criminal Code, special provision relating to Effective Repetance. The main aim of this thesis is a comprehensive explanation of all aspects of this crime, increased attention has been paid to potential decriminalization or partial legal regulation of this crime into the future. Purpose of the crime of Evasion of Alimony Payments is interest of the society of proper fulfilment of the statutory duty to maintain subsistence between the family members. With the reference to appearing of this crime entirely in connection with evasion of the statutory duty to maintain subsistence toward the childern, emphasis was put on this part of issue during the writing this thesis. RÉSUMÉ This master's thesis presents a detailed study on the topic of maintenance obligation in international private law, especially on maintenance obligation from parents towards children. This thesis examines the origins of maintenance order regulations, in particular we present analysis of "Haag Protocol of 23 November 2007 on the Law Applicable to Maintenance Obligations". This thesis also deals with "Council Regulation (EC) No 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations" and how this protocol relates to the Haag Protocol of 23 November 2007. The first chapter examines the sources of the regulation of the term "maintenance obligation" in private international law, especially on conflict of law rules. The conflict of law rules are covered - on the state level by law "91/2012 Sb.", about international law private, on the european level in "Council Regulation (EC) No 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations", and on the international level in Haag Protocol. Tabulky pro stanovení výše výživného - role a efektivita v soudní praxi / The Table for Determination of Alimony - the Role and Efficiency in Judicial Practice

Three years ago, the Ministry of Justice in the Czech Republic stated in judicial practice a recommending table whose intention was to unify the decision-making practice of courts in determining of alimony. The table should rectify a vague treatment of the maintenance obligations, guarantee a legal certainty for all participants and predictability of decisions. The alimony often covers only a part of all costs for a child under conditions that it is paid. The situation is even more problematic because the single-parent families with minors usually belong to the households which are mostly threatened by poverty. These families are most often headed by woman, who bears the brunt of caretaker and breadwinner roles. Their role is also influenced by the disadvantageous position at a labour market. The result of all these factors is usually a feminization of poverty and transmission of the standard of living from a mother to a child. My research interviews were focused on the fact if the table is used in practice. I evaluate its efficiency and represent modifications suggested by the courts. The analysis showed that not all courts use the table or use it at different levels. It is a consequence of reading of the word "recommending". L'articulation entre solidarité familiale et solidarité collective / The articulation between family solidarity and social solidarity

L’aggravation des besoins en matière de vieillesse, de dépendance, de handicap, d’isolement et d’exclusion en général, exacerbe les tensions entre solidarités familiales et solidarités collectives. Partout, la crise des solidarités inquiète : crise des solidarités familiales d’une part, en raison de l’individualisme et de la liberté qui fragilisent les responsabilités familiales, crise des solidarités collectives d’autre part, au regard des difficultés économiques et sociales de l’État-providence. L’articulation entre la solidarité familiale et la solidarité collective est une question centrale des politiques sociales et familiales menées par les États modernes. Le discours contemporain témoigne d’une redécouverte des solidarités familiales et d’une mise en valeur de la fonction économique de la famille, au travers des institutions juridiques de l’obligation alimentaire et de la transmission du patrimoine. L’attention portée aux solidarités de proximité vise à pallier la fragilisation des dispositifs de protection issus de la solidarité collective, ici entendue comme l’ensemble des aides sociales et des prestations non contributives de sécurité sociale. L’articulation de la solidarité familiale et de la solidarité collective interroge le législateur sur la place respective à assigner à la famille et à l’État dans la prise en charge de la personne dans le besoin. Cette étude propose de mettre en évidence le glissement d’un système d’articulation édifié sur la subsidiarité de la solidarité collective par rapport à la solidarité familiale vers un modèle fondé sur la complémentarité de la solidarité familiale et de la solidarité collective. Dans cette perspective, la thèse se propose d’étudier l’impact sur les solidarités familiales, des recours et des récupérations exercés par la collectivité contre les débiteurs alimentaires et les transmissions patrimoniales. / The increasing needs related to old age, dependency, disability, loneliness and more broadly exclusion leads to a tension’s exacerbationbetween family solidarities and collective solidarities. The solidarity crisis is a matter of concern as we observea familial solidarities crisis created by individualism and freedom leading to a weakening of familial liabilities and a collective solidarities crisis created by the welfare state’s economic difficulties. Thus, balance between familial and collective solidarities is a key issue regarding social policies conducted by modern States. The contemporary vision brings up the idea of a rediscovery of familial solidarities and an increasing role given to the economic role of the family through legal institutions such as the maintenance obligation and the assets transmission. The attention given to local solidarities tends to correct the weakening of collective solidarities, defined as the set of social supports and free social security benefits. The balance between familial solidarities and collective solidarities brings lawmaker to re think the role of State and family in regards of a person in need. This study demonstrates that solidarities are drifting from a system balanced by the subsidiarity between collective solidarity and familial solidarity to a new model based on complementarity between familial and collective solidarity. From that perspective, this thesis assesses the impact of familial solidarities, remedies and recoveries used by collectivities against food debtors and transmission of assets.

Fattigvård och folkuppfostran : liberal fattigvårdspolitik 1903-1918 / Poor relief and moral education : Liberal poor relief policies in Sweden, 1903-1918

The present study treats liberal poor relief policy in Sweden between 1903 and 1918. In using institutionalist theory and Yvonne Hirdman's gender theory, along with qualitative analysis, the author interprets the motives of the actors, distilling from them both the values, attitudes and norms they themselves represented, and those they wished to communicate to the poverty-stricken through poor relief. This study shows that the liberal reformers, with the liberal, "help-to-self-help" idea as their basic ideological foundation, wanted to shape poor relief institutions so that those who came into contact with poor relief authorities would be taught to assume responsibility for their own lives. Poor relief was intended to develop the individual's will and ability to support him/herself and his/her family. Maintenance obligation was a central element here; those who neglected this obligation were therefore apprehended as criminals, and toughened regulations for neglecting the maintenance obligation were introduced into the poor relief law of 1918. Poor relief was also to be formed so that it would have a deterrent effect. Unchecked charity would be counteracted and the individual prevented from becoming dependent upon receiving welfare. This would be effected through preventive measures for the conscienious recipients, and moral education for the unruly ones. In order that the right measures be taken in each individual case, the liberal reformers advocated an individualized system of poor relief whereby poor people were judged to be either "worthy" or "unworthy", according to a moral yardstick. However, in the legislation it is apparent that the male is considered to be the norm, since it was the inability to secure gainful employment that gave one the right to receive poor relief. This employment criterion disregarded the fact that it was most often the husband who was the family provider, while the wife most often worked in the household. The poor housewife was made invisible and thus found herself relegated to a no-man's land somewhere in between the "worthy" and "unworthy" poor. The female reformers, warders and the poor women themselves lived within the confines of a gender system where the man represented the norm. However, there existed sub-systems side-by-side and on different levels of society, with class differences acting as the watershed. The progressive middle- and upper-class women and the female warders lived in a system of separation of the male and female spheres which allowed them to take the step out into the public arena — within certain boundaries — while the poor women lived in a system constructed with men foremost in mind. 1 Maintenance duty between parents and children and ancestors and descendants Resumé The topic of my thesis is the maintenance obligation between parents and children and ancestors and descendants. After the introduction, I addressed the history of maintenance obligation in family law focused on the legal regulation of maintenance obligation. Act No. 265/1949 on Family Law changed the institute of the power of a father to the institute of the power of parents. Father and mother had and have until now the same rights and the same obligations in the upbringing and nutrition of children. First, the law established maintenance obligation for mothers. The said Act did not make difference between a child born to the marriage and a child born outside of marriage. This Act was progressive. The Family Act No. 94/1963 Call. related to the economic change which had an influence on the vast changes of our legal order. The said Act has been amended for several times. Since January1,2014, maintenance obligation has been regulated by the Civil Code, Act No. 89/2012 Coll. into which the family law is incorporated.
