Cette thèse se situe dans le domaine de l’informatique orientée service. Elle propose un ESB (Enterprise Service Bus) autonomique, c’est-à-dire capable de s’autogérer sur un ensemble d’aspects. Cet ESB, nommé Cilia autonomique, permet de construire des applications de médiation sensibles au contexte.Précisément, la version autonomique de Cilia, que nous proposons, permet l’optimisation de l’utilisation des ressources de la plate-forme d’exécution et l’adaptation dynamique des chaînes de médiation au niveau de la configuration et de la topologie. Notre framework permet également de présenter à tout moment un modèle simplifié des phénomènes liés à l’exécution des chaînes et, ainsi, de faciliter le raisonnement et la prise de décisions d'adaptation.Les travaux de cette thèse ont été validés dans le cadre de l’informatique pervasive. En particulier, Cilia autonomique a été utilisé et instrumenté pour la mise en oeuvre d’applications de maintien à domicile et de suivi de la santé des usagers. Les résultats sont disponibles en open source. / This PhD work takes place within a broader context of service-oriented computing. Precisely, it defines an autonomic Enterprise Service Bus (ESB) with self-management ability regarding certain aspects. This ESB, named autonomic Cilia, allows the simplified development of context-aware mediation applications. Autonomic Cilia permits the runtime optimization of resources used by its execution machine and the dynamic adaptation of mediation chains, regarding configuration and topology. Our framework can also retrieve at any time a simplified model of the mediation chains execution. Such models enable reasoning and decision making easier to implement for mediation developers. The work presented in this thesis has been validated in the context of pervasive computing. In particular, autonomic Cilia has been used and instrumented to implement healthcare applications in smart homes. The autonomic Cilia framework is available in open source.

This (diploma) thesis aims to introduce alternative dispute resolution within international business relationships and it subsequently focuses on one of them, which is mediation. This topic was chosen with regards to its recency and an evolving trend of alternative dispute resolution both in Czech Republic, and abroad. The thesis is divided into eight chapters. Introductory chapter introduces the issue of ADR, their characteristics, advantages and the division. The second chapter focuses on the definition of business relationships, international business relationships and suitability of application of ADR in these cases. The third chapter is dedicated to the characteristics of individual types of ADR such as negotiation, conciliation, collaborative law, arbitration, med-arb, medaloa, minitrial and expertise and their mutual comparison. The fourth chapter is devoted to the legislation of ADR within Czech Republic and subsequently to the international legislation of ADR. The fifth chapter focuses on mediation, its characteristics, definition, its forms, history and both national, and international legislation. An Experimental Investigation and Conditional Process Analysis of the Role of Catastrophizing in the Pain — Working Memory NexusProcento, Philip Matthew 12 1900 (has links)
Indiana University-Purdue University Indianapolis (IUPUI) / There is a well-documented bidirectional relationship between pain and cognitive dysfunction, especially working memory. Despite this extensive body of research, the pain–working memory relationship is poorly understood. Pain catastrophizing – exaggerated negative cognitive and emotional responses towards pain – may contribute to working memory deficits by occupying finite, shared cognitive resources, but this has yet to be investigated. The present study sought to clarify the role of pain catastrophizing (assessed as both a trait-level disposition and state-level process) in working memory dysfunction. Healthy undergraduate participants were randomized to an ischemic pain or control task, during which they completed verbal and non-verbal working memory tests. They also completed measures of state- and trait-level pain catastrophizing. Mediation analyses indicated that state-level pain catastrophizing mediated the relationships of pain group to both verbal and non-verbal working memory, such that participants in the pain group (vs. the control group) catastrophized more about their pain, which then resulted in worse verbal and non-verbal working memory performance. In moderated mediation analyses, trait-level pain catastrophizing moderated this mediation effect for both verbal and non-verbal working memory. Those participants in the pain group who reported greater tendency to catastrophize about pain in general exhibited greater catastrophizing in-the-moment during the pain task, thereby leading to worse verbal and non-verbal working memory performance. These results provide evidence for pain catastrophizing as a putative mechanism and moderating factor of working memory dysfunction in pain. Future research should replicate these results in chronic pain samples, investigate other potential mechanisms (e.g., sleep), and develop interventions to ameliorate cognitive dysfunction by targeting pain catastrophizing.

Acorns of the resolver : are there identifiable characteristic traits within the leading UK mediators and is there a correlation between these characteristics and their position as the pioneers of ADR?Hudson-Tyreman, Aaron D. January 2017 (has links)
Despite the extensive literature regarding mediation, there remains very little empirical and objective research that gives regard to the characteristics of the Mediator as a neutral third party to a dispute. There is a substantial body of work that discusses the merits of mediation and the skills required to be a good or successful mediator. There are observational studies carried out on a small number of mediations mostly carried out by mediators who tend to see their role through a rather tinted world view. These neutrals hold a very peculiar position within the theatre of law, they have no definable regulatory body, no prerequisite for academic qualification and yet the majority of the work is carried out by a small number of individuals who by and large have been the 'leaders in the field' since they brought mediation to the forefront of dispute resolving as a protocol of the procedural rules. Utilising both self-reflection and psychometric models, 50 of the UKs leading commercial mediators submitted to a series of evaluative surveys to establish whether they had defining characteristics outside of the norm. Using the five factor model of personality (FFM) measured through the workplace test 'ORPHEUS', the subject group of 32 males and 18 females, were tested to establish whether there were any statistically significant traits. Across the five major and seven minor domains it was found that as a group the commercial mediators scored significantly lower than the mean along the major scale of Conformity, suggesting higher than average Creativity. The females group scored significantly lower across the domain in comparison to the males group. Within the minor trait scales, the group scored significantly higher than the mean across; Work Orientation, Fair-Mindedness and Initiative. However, the role is dominated by white, male lawyers of sixty-one years of age. They are Christian and have at a minimum undergraduate qualification in law, they will practice commercial mediation on a full-time basis and be accredited by at least one accrediting body, most notably CEDR. On average they will have practiced mediation for 20 years and carry out in excess of fifty-five mediations per year. They are mildly introverted creative types with higher than average initiative with a strong work ethic and a fair-minded approach.

An Investigation of the Roles of Temperament and Approaches to Learning on Head Start Children's School ReadinessMunis, Pelin 25 April 2008 (has links)
The current study examined the relation between temperament and school readiness in preschool children. Two research questions were of interest: 1) Do approaches to learning behaviors mediate the relation between temperament and school readiness and 2) Does temperament moderate the relation between approaches to learning and school readiness? Data were collected on 195 Head Start children. Teachers assessed children's temperament styles as undercontrolled, resilient, or overcontrolled, as well as their approaches to learning behaviors. Trained research assistants directly assessed children's school readiness. The results showed a gender by temperament interaction effect for overcontrolled children with boys performing the worst on all outcomes and girls performing either the best or as well as resilient girls and boys. Mediation and moderation analyses were conducted separately for girls and boys. For girls, temperament did not predict school readiness and therefore, there was no effect to mediate. For boys, competence motivation and attention/persistence partially mediated the relation between temperament and school readiness for overcontrolled versus resilient boys. For both girls and boys, temperament did not moderate the relation between approaches to learning and school readiness. These results and the implications of this research will be discussed.
