Regulating municipal water supply concessions: accountability in transitional China

 The past three decades have witnessed the fundamental achievements of China’s marketization. Through this process, state-owned enterprises have been restructured, monopoly is giving way to competition and private sectors are increasingly participating in public service provision. The concept of concession was first introduced in public utilities through the Circular on Questions Concerning the Ratification of Pilot Foreign Invested Concession Projects (1995), after which there were many experimental projects with BOTs and TOTs. In 2002, with the issuance of Opinions on Accelerating the Marketization of Urban Utilities, the concession system was officially introduced in public utility regulation. In the same year, the water pipelines were opened to foreign investment; concessions have since been extended into integrated municipal water groups. Concessions have become the major approach of public utility provision. In recent years, the accountability in concessions has raised wide concern. Problems exposed include fixed rate-of-return, state-owned assets losses, undue concession transfer, illegal concession award, unreasonable water tariff increase, and problematic service provision by private concessionaires. Commentators have claimed that an accountability gap exists in concessions. Taking water sector concessions as the subject of discussion, the author distinguishes three types of accountability: traditional bureaucratic accountability, legal accountability and public accountability. Through systematical examination of the problems, this dissertation attempts to achieve a better understanding of concession and its application in public utilities, and finds that the alleged accountability gap is attributed to traditional bureaucratic accountability and concession system per se. Four aspects of regulation in water concessions are considered: concessionaire selection; water pricing regulation; regulation by contract; and the regulatory framework. The findings suggest that under concessions, traditional bureaucratic accountability is neither adequate nor appropriate to hold the government accountable. Impact of urbanisation on municipal services delivery with particular emphasis on the provision of water in the Durban metropolitan area.

The main aim of this thesis was to explore the impact of urbanisation on the provision of water to the people of the Durban Metropolitan Area. The literature study revealed that urbanisation is proceeding rapidly and that the urban population in Durban will continue to grow and expand. Employment opportunities and enhanced service delivery in urban areas were two of the primary factors that attracted people to the city centres. The provision of water was identified as a growing priority in the new South Africa. It was found that whilst the privileged minority enjoyed first world lifestyles, the majority of people were poverty stricken and had little or no access to basic services. The literature as it exists reflects that local government is entrusted with a mammoth and crucial task in enhancing sustainable service delivery at affordable prices to impoverished communities. In light thereof, local government required a concerted strategy to address urban needs if it is to respond more effectively to its clientele and to the effects of urbanisation in the new millennium. The empirical study included the use of questionnaires to: - managers at the Urban strategy Unit; - managers at Durban Metro Water Services; and - two hundred subjects randomly selected from the Inanda/ Phoenix, Cato Crest / Cato Manor, Clare Estate / Reservoir Hills and Umlazi informal settlements. The data was analysed using both descriptive and inferential statistics. The findings illustrates that an increase in urbanisation patterns has caused a decline in job opportunities and has added pressure to the local government infrastructure. The data revealed that the major obstacles to water delivery was accelerated urbanisation, lack of finance, high construction costs, high population growth rates, shortage of skilled labour, violence and crime and inadequate community participation. The empirical study revealed that people of all ages resided in the informal settlements. The majority of people were unemployed, generally had access to primary or secondary education and occupied menial jobs which were poorly remunerated. There is a need to create a National Commission on Urbanisation Development which can serve as an advisory body to government. This provision is universally recommended by urban geographers and government officials. This study calls for central government to play a more meaningful role in service delivery by strengthening the authority of local governments to raise adequate revenues to meet rising urban service needs. Central government must also provide technical assistance and training to local officials in improving tax administration, collection procedures and increasing revenues from existing and new sources. Local authorities need to improve their own performance in service delivery. This can be achieved if it has the capacity to act effectively and efficiently. Administrative structures and practices should be designed according to the services to be provided and the policies to be implemented. The growing South African municipal water service delivery problem

The sustainability of South Africa municipal water services provision is being challenged by the desire of government to extend high quality services from a relatively small portion of the population to the whole. Evidence of failures in delivery are mounting and many reasons for this have been identified, including a lack of political will at local government levels, low budget priority, insufficient capital, lack of capacity and skill and flawed tariff and accounting structures. This study generates new perspectives by surveying selected but representative, South African municipalities in their capacities as water service authorities (WSAs) on a range of financial sustainability issues – including cost burden on users, cross sub-subsidisation and cost calculations to set tariffs. The study is part of a wider investigation into the setting of tariffs that cover costs and satisfy demand, funded and advised by the Water Research Commission (WRC). The conclusions and recommendations of WRC Project K3/2087 (Hosking, 2011b) are to address: 1. The choice of water service provider, including the private utility option; 2. Market vulnerabilities in water service provision under alternate models of supply; 3. The determination and realisation of full cost recovery; 4. Demand responsiveness/sensitivity of local government supply; 5. The increasing block tariff (IBT) tariff structure; and 6. Abuse of dominance in the market process. Given the limited perspective (i.e. a focus on WSAs), some important national water sustainability issues are given less prominence, e.g. raw water availability and national government capacity to subsidise water service delivery. The key water service sustainability elements on which attention was focused in this study are: • Backlogs in the water service coverage and infrastructure rehabilitation and maintenance. • Standard of water service indicators. • Relative importance of the provision of water services in water service authorities’ strategy and implementation (including budget and risk). • Adequacy of skills to provide a sustainable water service. • Budgeting and planning for the sustainability of the water service. • Adequacy of the costing and tariff setting nexus, with particular attention paid to method and principle. A survey was used to elicit information from selected municipalities (Chapter Four). The municipalities which formed part of the sample and were surveyed were: 1. Nelson Mandela Bay Metropolitan Municipality; 2. Ekurhuleni Metropolitan Municipality; 3. eThekwini Metropolitan Municipality; 4. Cape Town Metropolitan Municipality; 5. Buffalo City Metropolitan Municipality; 6. George Municipality; 7. uMhlathuze (Richards Bay) Municipality; 8. Steve Tshwete (Middleburg) Municipality; 9. Kouga Municipality; 10. There are numerous factors influencing water demand and therefore influencing the prediction thereof. The effect of each of these factors on the water demand is called the elasticity of that factor. The main aim of this study is to determine area and income elasticities of demand. This will enable the reader to predict water demand by taking stand size (area) and income into account. The stand value of each user was used as a surrogate for the income of that user. Another aim of this study is to compare average water demands for different cities and towns in Gauteng, South Africa with each other. Over 190 000 users' data were used for this study.

Optimal design of municipal and irrigation water distribution systems

In two-dimensional flow, the point of flow separation from the surface coincides with the point at which the skin friction vanishes. However, in three-dimensional flow, the situation is much more complex and the flow separation is rarely associated with the vanishing of the wall shear stress except in a few special cases. Though the effects of cross-plane separation are substantial and have been recognized for some time, the phenomenon of flow separation over three-dimensional bodies is still far from being completely understood. The flow is so complex that no completely satisfactory analytical tools are available at the moment. In an attempt to logically identify the various effects and parametric dependence while simultaneously minimizing configuration dependent issue, the flow over a 6 to 1 prolate spheroid, which is a generic three-dimensional body, is investigated. For the identification of the general flow pattern and better understanding of the flow field, surface-oil-flow visualization tests and force and moment tests were performed. The angle of attack effect and Reynolds number effect on the separation location are studied with natural transition. Forces and moments tests, surface pressure distribution measurements as well as the surface pressure fluctuations, and mini-tuft flow visualization tests were made to document the flow characteristics on the surface of the body with an artificial boundary layer trip. / Ph. Urban water security in the city of Windhoek

Africa particularly has been experiencing the world’s most rapid rate of urbanization and cities are faced with the resulting pressure on natural resources. Water is one of the resources under pressure and the provision thereof is complicated by the deteriorating quality and quantity thereof. This study takes a brief look at the water situation in a water scarce region in Africa and concentrates on the urban water supply sector. It takes an in depth look at the measures used to secure water supply to a city in this very dry part of the world. The area under study is Windhoek, the capital of Namibia, situated in the southwestern corner of Africa. Namibia is the driest country in Sub-Saharan Africa and is characterised by a semi-arid nature, which results in a very hot and dry climate with erratic rainfall patterns. Windhoek has a low average rainfall associated with very high evaporation rates. No permanent water bodies exist near the city and the bulk of Windhoek’s water supply comes from storage dams quite a distance from the capital. Most of these sources of supply have been developed and are nearing the limit of their potential. A desperate need therefore exists to develop reliable additional water resources to secure the water supply especially during periods of prolonged drought. The case study gives examples of the initiatives taken by water authorities to improve the security of supply and keep up with the growing demand in the city. These initiatives include a dual pipe system for the distribution of semi-purified sewage for irrigation, reclamation of domestic sewerage, aquifer recharge and the implementation of Water Demand Management principles. An analysis of the most efficient and cost-effective means of supply augmentation namely aquifer recharge, have been balanced against the potential water savings of Water Demand Management in the city. The study also takes a brief look at the principles of Integrated Water Resource Management and how it is incorporated in the strategies used to augment supply to the city. The research found aquifer recharge as the most efficient and cost-effective means to augment supply to the city and together with Water Demand Management creates an approach complying with the goals of Integrated Water Resource management. The study concludes by identifying gaps in demand management in the city. It also suggests relevant recommendations on how to increase the effectiveness of Water Demand management. / AFRIKAANSE OPSOMMING: Verstedeliking is ‘n komplekse verskynsel en ‘n tendens wat regoor die wêreld voorkom. Die hoogste voorkoms van verstedeliking vind in Afrika plaas wat groot druk plaas op die natuurlike hulpbronne van stede. Water is een van die hulpbronne onder druk en die voorsiening daarvan word bemoeilik deur die verswakking van die kwaliteit en die beskikbaarheid daarvan. Hierdie studie konsentreer op die watersituasie in ‘n waterskaars streek in Afrika en die stedelike watervoorsieningssektor. Dit behels ‘n in diepte ondersoek na metodes wat gebruik word om die watervoorraad van die stad te verseker in hierdie droogte gesteisterd deel van die wêreld. Hierdie pogings sluit in,‘n dubbele pyplynsisteem vir die verspreiding van halfgesuiwerde rioolwater vir besproeiingsdoeleindes, herwinning van huishoudelike rioolwater, herlaai van ondergrondse watervoorraad en die implimentering van wateraanvraag bestuursmaatreëls. Die geskiktste en mees koste-effektiewe metode van verhoogde watervoorsiening naamlik die herlaai van ondergrondse waterbronne, is ontleed, en die voordele opgeweeg teen die potensiële waterbesparing deur die Bestuur van Wateraanvraag in die stad. Daar is ook kortliks gekyk na die beginsels van Geintigreerde Water Bronne Bestuur en hoe dit by bestaande strategieë ingelyf is om uitbreiding van voorsiening aan die stad te verseker. Die navorsing het bevind dat die herlaai van ondergrondse waterbronne as die geskikste en mees koste-effektiewe metode beskou kan word om die verhoogde aanvraag van die stad die hoof te bied. Die studie word afgesluit deur die tekortkominge in die Water Aanvraagbestuur van die stad te identifiseer. Relevante aanbevelings word gemaak van hoe om die effektiwiteit van hierdie betrokke strategie te verbeter.

Water, Economics, and Policy in Developing Countries

Water is essential for life, and access to sources of safe water and sanitation facilities is a first-order concern for economic welfare and general well-being. While the majority of residents in developing countries have access to improved water and sanitation services, many parts of the developing world lag significantly behind in this vital infrastructure. This dissertation studies policies aimed at increasing access, quality, and efficiency of improved water and sanitation (WS) services in developing countries. In the following three chapters, I focus on non-technological methods for improving service by eliminating the economic, political, and institutional barriers to safe water and sanitation provision. Chapter 1, “The Buck Stops Where? Federalism and Investment in the Brazilian Water and Sanitation Sector”, shows how weak institutions can undermine public goods service when multiple levels of government share responsibility of provision. In particular, I study how legal ambiguities regarding degrees of governmental authority can lead to systematic underinvestment in public utilities. I examine the Brazilian water and sanitation (WS) sector, which presents an natural experiment of shared provision between state and municipality entities. I look at a legal reform that clarified the relationship between municipalities and states in a quasi-experimental, difference-in-differences framework, using an administrative, municipality-level panel dataset from 2001-2012. I find that when expropriation risk by state companies diminished - self-run municipalities almost doubled their WS network investment. This increase in investment led to a significant increase in access to the WS system in these municipalities. The analysis provides strong evidence that reforms that strengthen residual control rights and eliminate the threat of intra-governmental expropriation can lead to large increases in public goods investment. Chapter 2, “The Role of Basic Sanitation Plans on Service Provision: Evidence from Brazil”, investigates non-technological methods of increasing access to improved water and sanitation (WS) in developing countries. In particular, it presents evidence of the efficiency gains that can be achieved in municipal water provision through the act of formulating and carrying out basic sanitation plans. I exploit the staggered roll-out in implementation of basic sanitation plans throughout municipalities in southern Brazil from 2007-2013. I find that, in the three years after the enactment of sanitation plans, municipalities increased the efficiency of their respective water systems through the tightening up of “leakages" in the system, both in terms of water distribution and bill payment. However, I find no significant increases in the degree of individual access to the systems, suggesting that in the relatively short-run, providers focus on improving the existing system as opposed to building out new infrastructure. Chapter 3, “(Not So) Gently Down The Stream: River Pollution and Health in Indonesia”, addresses the fact that waterborne diseases are the leading cause of mortality in developing countries. We emphasize a previously ignored cause of diarrhea - upstream river bathing. Using newly constructed data on upstream-downstream hydrological linkages along with village census panel data in Indonesia, we find that upstream river bathing can explain as many as 7.5% of all diarrheal deaths. Our results, which are net of avoidance behavior, show no effect of trash disposal on diarrheal infections. Furthermore we find that individuals engage in avoidance behavior in response to trash disposal (visible pollutants) but not river bathing (invisible pollutants). We conduct policy simulations to show that targeting upstream individuals could generate substantial environmental and health savings relative to targeting downstream individuals. This provides a potential road map for low- and middle-income countries with limited resources for enforcement of water pollution.
