Overlaps of intellectual property rights are a phenomenon that is not yet fully understood and analyzed; yet it is an increasingly important issue due to development of new hybrid technologies that defy the established structure of the system. Despite the potential adverse effects this phenomenon can have on the integrity of the system, the problem of overlaps has been neglected in judicial and scholarly analyses.
This research presents the thesis that all uses of intellectual property rights should be viewed in light of their purposes. In other words, the phenomenon of overlapping intellectual property rights is not a problem per se; instead, it is the use of the rights for incompatible purposes that may be considered objectionable. The analyses use the concept of balance of rights as the measuring rod for assessment of the consequences resulting from use of the overlapping rights. Thus, the dissertation investigates how use of intellectual property rights associated with one segment of the system can affect carefully crafted balance of rights of various stakeholders in an overlapping segment and whether effectiveness of this segment to advance its purposes will be impeded by such use.
The analyses are also done with the aim to formulate a uniform answer to identified and potentially objectionable uses of overlapping rights in an attempt to provide the judiciary and law practitioners with analytical framework for resolving disputes involving overlaps in the intellectual property system. An adequate response to the challenge posed by improper use of overlapping intellectual property rights can be found in a properly construed doctrine of misuse of intellectual property rights. Because overlaps in the intellectual property system are a phenomenon that probably cannot be legislated in practical terms, this dissertation advocates adoption of a judicially created doctrine of misuse based on purposive analysis of intellectual property rights.

Nustatėme minimalias užlaidas, esant bazinių paviršių ir apdirbamų paviršių tarpusavio padėties paklaidoms, taip pat įvertinome pjovimo įrankio dilimo ir temperatūrinių deformacinų įtaką. / The subject of the work: The influence of geometric and other errors for overlaps and idle measurement. The object of the research: The calculation of overlaps constituent and minimal idle measurement. The aim of the research was to revael the influence of the geometric and other errors for overlap details and idle measurements. What is the change of the aspect of minimal measurement after manufacturing when the surface of the detail is convex on concave. The research has defermined the minimal overlaps, when there are errors of the base and manufactured surface inter – position, also the influence of the cutter decrease and resilience was determined.

Analýza tečení materiálu při kování vačky / Analysis of Material Flow During Cam ForgingKopečný, Adam January 2020 (has links)
The diploma thesis deals with the optimization of final position of overlaps on a forged cam. This part is manufactured in Šroubárna Kyjov, spol. s r.o. The cam is made from ČSN 14 109 (100Cr6) steel. The thesis is focused on the optimization of overlaps arising due to pressed burrs on the edges of the semifinished forging. Currently, the final position of these overlaps is very close to the edge of the pre-forged hole of the cam. Undesired chipping of material occurs during machining of the hole to the exact dimension. The final position of the overlaps is optimized by using the numerical simulation in Simufact Forming 15.0, including a verification simulation for optimal parameter settings. Various diameters of semifinished products, turned tools, and modification of shapes of the tools are tested in the thesis to prevent occurrence of the overlaps in undesired positions.

Processes and patterns of responsiveness to the world of work in higher education institutionsGarraway, James January 2007 (has links)
Philosophiae Doctor - PhD / The rationale for the topic flows out of education policy and societal pressures worldwide which are calling for an ever greater responsiveness from higher education to the workplace in the twenty-first century. Responsiveness to Work (i.e. the world of work) requires collaborative and integrative work between communities of academic and non-academic practitioners. Differences between knowledge and
practices at Work and within the academy are broadly acknowledged in the literature, yet the ensuing nature and complexity of interactions between these two communities in curriculum design 'on the ground' is poorly understood. A key point is to recognize that integration as such cannot be the goal: the differences remain, but have to be turned into productive collaboration and joint development, for example, of a curriculum. Productivity here is not used in the sense of the ratio between output achieved and inputs needed, but rather refers to the activity theorists' concept of zones of potential development between two different, interacting activity systems (their way of conceptualizing communities of practice). Productivity is then a measure of the extent to which new hybrid knowledge emerges in the interactive zone with positive outcomes for both systems. Ideally, the integrated curriculum elements look to both Work and academic knowledge. Such productivity involves the acknowledgement of pre-existing boundaries and differences between types of knowledge and the subsequent actions of actors in crossing these boundaries. After sketching the policy backdrop to the issues of responsiveness to Work "on the ground", the first part of the thesis discusses theories of curriculum development, and of boundaries, differences, boundary crossing and maintenance. Inspired by the work of Nooteboom, a model is outlined for optimal difference allowing for innovative and productive curriculum development. The processes and patterns of responsiveness of higher education to the needs of 2 re studied empirically at two interconnected levels: The meso-level of the design of curriculum units; and the micro-level of face-to-face interactions between
representatives from Work and the academy as they negotiate how to implement responsiveness. The curriculum units examined are those in which universities have attempted to design units which include aspects of Work. The face-to-face interactions are those between lecturers and Work representatives as they attempt to negotiate what sort of knowledge should be taught in the academy to meet both Work needs and those of the academics. At the meso-level, different cases (in different countries) were studied which together spanned the spectrum of differences between academic knowledge and workplace knowledge. At the micro-level, the focus was on the actual boundary work, and how it might set productive developments in motion. The processes involved are those of the mutual presentation of knowledge difference
between work and the academy followed by knowledge transformations. These transformations are in tum enabled by the representatives' actions and their mobilisation of structures to enable bridging between the different types of knowledge. Difference between work and academic knowledge matters. Firstly, difference needs to be recognised and identified, not as a stumbling block to further developments, but as a resource. Secondly, an optimal degree of initial difference, rather than no difference at all, is an enabling factor, in concert with actor strategies, in the development of hybrid work/academic curriculum objects. The insights in micro-interactions can be combined with the analysis of meso-level curriculum development to create a model for productive work towards integration of Work and higher education. This model is supported by the literature discussed in the first part of the thesis, and can actually be used more broadly, for example for
productive development and implementation of policy (in this case, for responsiveness to Work).

Vocalisation and turn-taking in interspecies communication between dogs and humansNilsson, Erika January 2020 (has links)
Dogs and humans have through domestication and co-evolution established a close relationship and can communicate and understand each other. The objective of the present study was to deepen the understanding of the communication between dogs and humans, with focus on the vocalized communication. The study was based on video and audio recordings of dog-human communications from a total of 36 dogs in their home environment. The mean gap size in the communication ranged from 0.651.16 seconds and the overlap in communication had a percentage range of 14-50 %. These results are within the frame of other species communication with turn-taking. With these considerations, it clearly indicates that turn-taking occurs in interspecies communication between dogs and humans. The present study suggests that dogs intentionally communicate through vocalisation with their owners to gain the attention of the owner. In addition, age and sex of the dog influence their communication with their owners.

The main theme of this work is the detection of overlaps in NGS data. The work contains an overview of NGS sequencing technologies that are the source of NGS data. In the thesis, the problem of overlapping detection is generally defined. Next, an overview of the available algorithms and approaches for detecting overlaps in NGS data is created. Principles of these algorithms are described herein. In the second part of this work a suitable tool for detecting approximate overlaps in NGS data is designed and its implementation is described herein. In conclusion, the experiments performed with this tool and the conclusions that follow are summarized and described.

Computer Simulations of Dilute Polymer Solutions: Chain Overlaps and EntanglementsDrewniak, Marta 08 1900 (has links)
Chain conformations and the presence of chain overlaps and entanglements in dilute polymer solutions have been analyzed. The fundamental problem of existence of chain overlaps in dilute solutions is related to the drag reduction phenomenon (DR). Even though DR occurs in solutions with the concentration of only few parts per million (ppm), some theories suggest that entanglements may play an important role in DR mechanism. Brownian dynamics technique have been used to perform simulations of dilute polymer solutions at rest and under shear flow. A measure of interchain contacts and two different measures of entanglements have been devised to evaluate the structure of polymer chains in solution. Simulation results have shown that overlaps and entanglements do exist in static dilute solutions as well as in solutions under shear flow. The effect of solution concentration, shear rate and molecular mass have been examined. In agreement with the solvation theory of DR mechanism, simulation results have demonstrated the importance of polymer + polymer interactions in dilute solutions.
