A ciência política brasileira produziu explicações consistentes no que se refere ao funcionamento da democracia pós-1988. Os mecanismos de governabilidade e o processo decisório do sistema político brasileiro encontram-se amplamente discutidos pela literatura sob a rubrica do presidencialismo de coalizão. No entanto, duas agendas de pesquisa sobre nosso sistema político não foram suficientemente testadas, quais sejam: o estudo sobre as relações Executivo-Legislativo nas unidades subnacionais e os mecanismos de checks and balances em nossa democracia. O objetivo desta dissertação é analisar o ponto de toque ou mesmo a junção entre estas duas agendas: a dimensão de fiscalização e o controle nas unidades subnacionais brasileiras. Para isso, o desenho de pesquisa é composto pelo balanço do estado da arte das respectivas literaturas relevantes, juntamente à análise dos dados de 20 Estados da Federação Brasileira, na legislatura 2007-2010. / The Brazilian political science produced consistent explanations about the functioning of democracy in the post-1988 period. The mechanisms of governability and decision-making of the Brazilian political system are widely discussed in the literature under the rubric of coalition presidentialism. However, two research agendas on our political system have not been sufficiently tested, namely: the study of the Executive-Legislative relations in subnational units and mechanisms of checks and balances in our democracy. The goal of this dissertation is to analyze the touch point or even the junction between these two frameworks: the dimension of supervision and control in the Brazilian subnational units. To accomplish these objectives, the research design consists in the review of the relevant literature, along with the analysis of data from 20 states of the Brazilian Federation - from 2007 to 2010.

Previous issue date: 2014 / Resumo: Na presente tese explorou-se o Relatório da CPI do Narcotráfico como fonte de dados principal. Através do método indutivo da "Grounded Theory", pôde-se explorar, selecionar e se aprofundar na investigação de seis casos brasileiros que versavam sobre o próprio tráfico de drogas e crimes conexos que, por sua vez, levaram a um estudo sobre organizações do crime organizado. Esses seis casos foram analisados a partir da sociologia formal de Simmel que me conduziu a um estudo sobre as formas acionadas pelo crime organizado, até então inédito na Sociologia. Dentre as principais contribuições e descobertas é possível elencar 1) o uso de metodologias informacionais, como as análises de redes sociais, que permitiram a reconstrução organizacional (e das redes) acionadas pelos grupos estudados e com isso, ajudaram a alcançar um nível de abstração tal que permitiu pensar acerca dos tipos organizacionais acionados por esses grupos; 2) a descoberta do nível meso de análise alcançada através do uso de relatórios e investigações políticas; 3) a percepção sobre a existência de um terceiro tipo organizacional que transita entre as hierarquias e as redes, que denomino como híbrido. Essa tipologia foi percebida na quase totalidade dos casos estudados e, nacional e internacionalmente contextualizada, onde foram encontrados paralelos em casos chineses, canadenses, colombianos e mexicanos. Na tentativa de entender o desenvolvimento do híbrido nos casos estudados, levantei algumas hipóteses, dentre as quais destaco: as TIC¿s influenciam no desenvolvimento de organizações criminosas híbridas / Abstract: In this thesis the Drug Trafficking Report from the Brazilian parliament (lower house) Investigation Commission (CPI) is analyzed as primary data source. By using the inductive Grounded Theory methodology, I was able to explore, select and deepen the investigation into six Brazilian criminal drug trafficking cases and related crimes, resulting in a body of knowledge about the structures and organization of the organized crime. These six cases were analyzed throughout Simmel¿s "formal Sociology" lenses, resulting in a study of the forms employed by the organized crime, a novel result. Main contributions and discoveries in this thesis are: (1) the first reconstruction and abstraction of the organizational networks of Brazilian organized crime by using informational methodologies, (2) the first characterization of the organized crime networks at the analytical "meso"-level, by using a triangulation of methodologies, and (3) the identification of a third organizational class, called here hybrid - a merge between hierarchical and mesh organization. In special, the hybrid organizational type was detected in almost all cases studied and parallels were found to international cases (Chinese, Canadian, Colombian and Mexican). Faculty of Humanities / This thesis examines the status and role of parliamentary committees in democratic
theory with a view to critically assessing the performance of one such committee, the
South African version of the PAC, SCOPA. It advances a pluralist theory of popular
sovereignty according to which there is no single institutional complex or site, which
exclusively expresses the will of the people. The latter is the case in monist theories,
which reduce democracy to its practice in a single site. Rousseau and Weber are critically
examined in this connection. In the pluralist notion advanced in this thesis the popular
will is expressed and realized in a plurality of institutional sites and modalities of
exercise. On this perspective parliamentary committees perform a function vital to the
constitution of popular sovereignty itself. They are indispensable to the formation by the
people of an accurate perception by it of what the Executive is doing in its name. Their
investigative work is thus constitutive of the formation of a democratic subject and will.
Parliamentary committees are thus central to the satisfaction of the conditions of the
deliberative dimension of democracy. On this definition, parliamentary committees must
in addition themselves conform to the principles of deliberation in their own practice.
This specifically deliberative conception of democracy is then further delineated by
distinguishing it from the aggregation – majoritarian perspective and defending it against
a variety of criticisms, including that of Chantal Mouffe.
With this conceptual and normative framework in place, the British and American
committee systems are examined in order to establish some reference points in terms of
the institutional practice of parliamentary committees. The focus then shifts to the
parliamentary committees of the South African Parliament. The constitutional and legal
foundation for parliamentary committees (in the South African system) is examined with
particular reference to SCOPA itself and the first five years of the new parliamentary
committee system identified as a period during which several South African
parliamentary committees, including SCOPA, effectively exercised their “oversight”
function. Once the Government’s SDP entered the scene all things changed. This thesis
examines the formation of the JIT, paying particular attention to the exclusion of the
HSIU and the interventions of the Speaker, Hon Frene Ginwala. It identifies in close detail all the flaws in the SDP procurement process as well as the contradictions and
lacunae in the final JIT Report itself. These are of such a magnitude as to render
unreasonable any claim to the contrary and in endorsing the Report SCOPA thus clearly
failed in its essential function. The notion of a threshold concept of reasonable adequacy
is introduced as limiting the conditions under which committee decisions can legitimately
be taken via majority voting. The argument is advanced that these were clearly not met in
the case of the SCOPA decision under discussion. The implications of this “collapse” of
SCOPA for South African democracy more broadly are then identified and discussed in
terms of deliberative democratic theory.

Investiga os precedentes do mecanismo no Brasil e os modelos italiano e espanhol, que serviram de inspiração ao constituinte brasileiro. Busca, ainda, apontar as falhas de regulação interna, na Câmara dos Deputados e no Senado Federal, que têm impedido melhor aproveitamento do novo instituto legislativo como canal de deliberação alternativo aos respectivos plenários. / [en] The dissertation looks into the core elements of the new legislative procedure created by the Brazilian Constitution of 1988 that gives the decision power to approval and rejection laws to the committees. It investigates the precedents of the mechanism in Brazil and the Italian and Spanish models, which served as the base of inspiration to the Brazilian constituent. It also points out the flaws of the internal regulation of the legislative houses which have prevented better use of the new institute as an alternative channel for making laws.
