Josef Hrstka: Alternatives to unconditional imprisonment Abstract The main purpose of this thesis called "Alternatives to unconditional imprisonment" lies in the evaluation of the current alternatives to unconditional imprisonment in the Czech penal law focusing mostly on the substantive aspects of alternative punishments in the narrower conception. Author tried to present proposals based on studying literature, laws, judicial decisions and comparison with foreign legislations, which could lead to improving Czech legal regulation in this area. The thesis is composed of 8 chapters. In the introductory chapter readers are informed about content of the thesis, purpose of the thesis and methods used. Next three chapters deal with topics related to the purpose and functions of punishment, the benefits of alternatives to imprisonment and factors, which counteract against the efforts to reduce prison population. Author deemed necessary to analyze purpose of punishment, before he examined specific alternatives. Author tried to show that some conception of the purpose of punishment supports the use of alternatives to imprisonment, but attention must be also paid to social and economic conditions of offenders. Euthanasie a její právní úprava / Euthanasia and its legislation

The aim of this thesis is the analysis of domestic legislation affecting euthanasia and analysis of such adjustments abroad. The author questions the appropriateness of such adjustments in the Czech Republic. The current legal regulation does not regulate euthanasia in any way, and so the adoption of such regulation is appropriate. Domestic experts criticize this fact for a long time. In the first part the author deals with the most comprehensive definition of the subject of euthanasia and its development abroad and, particularly, in the Czech Republic. Other parts, using the historical-empirical methods, deal with the legal arrangements and their analysis in the Benelux countries, where the euthanasia is legal under certain given conditions. They describe not only the current treatment, but also the path that led to it. In the last section the author assesses the non-legal aspects of euthanasia and outlines two basic directions, which the domestic legislation could take in the future.

The crime of theft according to section 205 of Czech Criminal Code Abstract This diploma thesis deals with the crime of theft according to section 205 of Czech Criminal Code. The aim of this report is to analyse the crime of theft and to describe its features, in order to provide its comprehensive knowledge. The work is divided into six chapters, which are then divided into individual subchapters. The first chapter deals with property criminality, whose phenomenon is theft. It is pointed out to the high frequency of theft in property criminality and also for some types of theft to the relatively low level of clarity. The second chapters deal with historical view the historical view of theft in Czech lands. The description begins in the oldest period and ends in year 1989. More space is devoted to the period after year 1945, where it is pointed out to the existence of two types of thefts, which were introduced after year 1945. The third chapter provides a view on the institution of property, which is closely related to theft. The space is mainly dedicated to the protection of property, which takes place on several levels. The main subject of this Master's thesis is the analysis of the principle of subsidiarity of criminal repression in the Czech legal order, both in historical context and the context of current legislation. This work is analysing the principle of subsidiarity of criminal repression with its relating principle 'ultima ratio' and its concept in the Czech, or more like Czechoslovakian criminal substantive law since the first half of the twentieth century till today. The principle is defined both in theoretical legal terms and the practical legal terms in the context of the Czech higher court case law analysis. In the first chapter of the presented work, the author is discussing the historical point of view at already mentioned principle which is described in more of a detail as it comes to its criminal law codexes accepted in the years 1950 and 1961.This chapter is meant to highlight the fact that a criminal act itself in this period of time - obviously taken the differences in the political arrangments of Czechoslovakia - was treated differently than it would be today, which decreased the legal reassurance of Czechoslovakians, who were 'looked after' mostly by the institute of former so-called social endangerment. Padronização do Direito em tempos de grande encarceramento: os influxos da nova ordem global / Law standardization in large incarceration times: the inflows of the new global order.

O presente trabalho pretende analisar alguns reflexos da incorporação dos influxos da nova ordem globalizada e do neoliberalismo na ordem jurídica nacional. Será demonstrado que os valores sugeridos ainda que essa sugestão tenha caráter quase cogente pelo Banco Mundial, por meio de sua atividade paranormativa, são incorporados pela ordem legal brasileira através de reformas processuais que priorizam a justiça quantitativa. Essas reformas, somadas a outros fatores tais como o aumento das demandas levadas ao Poder Judiciário, a influência da economia na análise do Direito, a utilização equivocada, irrefletida e mecânica de discursos de fundamentação prévia, a pobreza do ensino jurídico e a submissão dos juízes ao que ditam os tribunais, resultam em um patamar de jurisdição padronizada. Paralelamente a esse processo, a população carcerária brasileira cresce em acelerado ritmo, o que pode ser relacionado com o avanço dos valores neoliberais e da retração do estado do bem estar social.Diante desse quadro, é proposto, como forma de aproximação da teoria jurídica com a prática forense e de maneira a proporcionar abertura do direito penal ao mundo dos fatos, a dogmática funcional redutora, de modo que o Direito Penal atue como dique de contenção do estado de polícia que subjaz a cada estado de direito. Ademais, propõe-se que essa adoção se dê nas salas de aula dos cursos de direito, utilizando-se, tanto quanto possível, de diversos recursos didáticos para tornar mais palpáveis e inteligíveis os conceitos e ideias propostos. / This study aims to analyze some consequences of the new global order and the neoliberalism influence inBrazilian legal system.It will be demonstrated that the values suggested even though this suggestion is, in fact, an obligation by the World Bank, through his paranormative activity, are incorporated by the Brazilian legal system through changes in procedure law, which focus only in quantitative justice. These reforms, added to others factors, such as the growth in the number of cases led to the judiciary, the economy influence in law analysis, the equivocate, unreflective and mechanic comprehension and use of the previously set foundation of judicial decisions, the poor quality law education and the judges submission to the Courts, result in a standardized jurisdiction. Simultaneously, the encarcerated population has grown swiftly, phenomenon that can be related to neoliberalism values widespread and to the weakening of the welfare state.Considering this scenario, as a way to approximate theory and practice of the law and to allow the opening of penal law to exterior facts,it is proposed reductive functional penal law dogmatic, so that penal law can act like a dike that holds the police state that hibernate within every constitutional state. Moreover, it is proposed the use of this theory initiates in law courses, using, as much as possible, several didactics resources to make easier to understand these concepts and ideas.

My thesis is focused on crime related to the abuse of addictive substances. It is a broad topic, because the abuse of addictive substances brings with it a whole range of social, health and economic problems and binds a wide range of criminal activities. The aim of my thesis is to analyze the body of each drug offence, related case law and current issues of the drug problem in the Czech Republic. The first chapter defines the basic terms associated with drug issues. The following chapter deals with the classification of drugs and their effects. It classifies drugs as legal and illegal, and lists their most harmful psychological, social and health risks. This chapter helps us to make a picture about the most commonly abused drugs in our country. The third and fourth chapters provide a general introduction to the topic of drug offences and describe the background of their current legislation. The merit of my thesis is contained in chapters 5 - 9. Each chapter focuses on a specific drug offence, as they are enshrined in sections 283 - 287 of the Criminal Code. All atributes of the facts of the crimes and qualified facts of the crimes are described in this chapters. The tenth chapter discusses the common provisions of the section 289 of the Criminal Code and the reasons for its recent partial annulment...

The purpose of my thesis is to analyse crime relating to the abuse of addictive substances. This is a very broad topic that affects many non-legal areas such as health care or economy. It is also associated with many criminological questions. However, in my thesis I focused on drug offences stated in the Czech Criminal Code. This topic was already processed several times, yet it still remains topical since the drug scene is constantly evolving, especially thanks to advanced technologies. The thesis is composed of seven chapters and the first chapter is aimed on defining the basic terms, which I consider crucial for the understanding of the issue. In this chapter I also define the basic terminology used in the thesis. The next chapter deals with the history of the legal regulation of the abuse of addictive non-alcoholic substances. I focused especially on the national legislation and to the limited extent also on international treaties. The first act I mentioned is "Břetislav decrees" from 1039 and gradually I'm getting to the current Criminal Code. One part of the chapter is devoted to the previous Criminal Code no. 140/1961 Coll. The merit of my thesis is contained in the chapters 3 - 7. Each chapter describes one of the drug offences, which are found in the articles 283 - 287 of the Criminal Code....
