The aim of this thesis is to analyze the claims of owners of land in the comprehensive land consolidation in terms of restrictions on property rights in the cadastral Kaplice and Zdar at Kaplice. Analysis of the new land organization in terms of restrictions on land ownership and to evaluate the impact of these limitations on the course of land consolidation. These are mainly focus on the state before land consolidation in a given area and conditions after the land consolidation. The result of this work is graphic and textual comparison of inputs and outputs of the land consolidation. Influence on its course and overall comparison of these two territories.

This thesis deals with the human rights of children living in families and children in foster education accordance with the legislation in the Czech Republic. In this thesis I present the structure and evolution of socio-legal protection of children and the laws that govern it. In this thesis my aim was to make comparison with selected European states and the countries of the European Union and propose recommendations de lege ferenda protection of human rights of children in accordance with Czech law and in accordance with international legal standards. To achieve this, I used the analysis of these documents. Based on the comparison and based on the data have been proposed recommendations leading to the observance and respect for the rights of children in the Czech Republic.

The Transfer of Membership Rights and Obligations in Cooperatives The aim of the thesis is to analyse legal relations arising from the transfer of membership rights and obligations in cooperatives. I chose this topic, because Czech legal regulations of the transfer are very often ambiguous and inaccurate. In the thesis I have summed up the current Czech legislation, pointed out some practical problems and tried to solve them. The thesis is composed of three chapters, each of them dealing with different aspects of the subject to be analyzed. The first chapter defines general terminology concerning the transfer of membership rights and obligations in cooperatives. I have tried to explain the different terms used in the Czech Commercial Code and to describe their mutual relations. Chapter two focuses on detailed description of the transfer in all types of cooperatives in the Czech Republic. The first part of this chapter describes the legislative evolution of the transfer as a legal institute. Next parts of this chapter investigate the contract of transfer and its constituent elements. To reach the self-contained description, the final part describes how by-laws of the cooperatives deal with this juridical institute. The thesis is called The Perception of Rights by Children with Mild Mental Retardation and is composed of the theoretical and practical parts. In the first part I deal with the characteristics of mental retardation, its cause, classification, history, the education of these children and their relations with others. The second chapter is focused on significant documents concerning the rights of children and adults with mental retardation. The third chapter concentrates on the research of children{\crq}s rights at the Faculty of Health and Social Studies, South Bohemian University. The theory is followed by the practical part containing the results and discussion with authors. The research was carried out by the method of directed interview (partly standardized method), by means of a questionnaire, which was created by Professor Gary Melton and his team in South Carolina in Columbia. Through this method and also the methodology of A. Saporiti the researches of legal awareness in children of school age, Roma children and the children in institutional care have been in progress since 1999. The research of legal awareness and perception of rights has not been carried out in children with mental retardation yet. The questionnaire contains identification questions (age, sex, and grade) and twelve model situations, where an individual adjudicates rights or not. The interviews were carried out in 116 respondents from three special schools (Havlíčkův Brod, Třeboň, Soběslav). I compared the results with the research of Mgr. Jany Stejskalové, carried out in 2005. The objective and the hypothesis were stated. The objective was to find out the perception of rights by children with mild mental retardation. The objective was fulfilled. The hypothesis was: The legal awareness of children with mild mental retardation increases with the increasing education of their parents. The hypothesis was not proved.

Internet and computer criminality Summary This thesis, as its name indicates, deals with the problems of our times associated with computers and the Internet, which make it possible to commit all sorts of crimes. Computers are part of our daily life and the sphere of information and communication technologies are constantly and rapidly developing, which gives space to potential perpetrators to find new approaches. The thesis is composed of eight chapters. The opening chapter of this thesis describes the basic concepts related to computer and Internet criminality. It includes the definitions of computer criminality, cybercrime, cyberspace, as well as basic technical concepts such as computer, hardware or software. Approximation of this terminology is essential to understanding the issue. Next chapter is devoted to some illegal activities in cyberspace, which are then legally assessed. The third chapter forms the most important part of the whole thesis because it describes in details the issue of copyright violations in connection with computers. The thesis analyses shareholders' agreements in limited liability and joint stock companies. In a broader sense, both the agreements concluded by shareholders outside the articles of association or bylaws and the provisions of the constitutional documents which are not attached to shares but only bind the individual shareholders can be classified as shareholders' agreements. The thesis consists of a general and a special part. The objective of the general part is to describe the legal nature, effects, usual content and practical use of shareholders' agreements. Particularly, I intend to detail the main legal issues surrounding shareholders' agreements included in the constitutional documents and to suggest the methods of coping with these problems in the legal practice. Further, I will describe the corporate advantages of the shareholders' agreements as separate legal documents as well as their limits. The objective of the specific part of this thesis is to characterize the selected types of shareholders' agreements in terms of their practical use and legal regulation. I put special emphasis on different kinds of shareholders' voting agreements.

The aim of this thesis is to analyse the issue of horizontal effect of human rights, i.e. whether and how they affect the fundamental rights and freedoms of individuals in private law relationships. With the development of society associated with expansion of the catalogue of human rights and with strengthening of their protection, we are witnessing infiltration of human rights into other legal areas than they were present in previously. This raises many questions about their application in such areas, especially questions about the holders of the obligations resulting from those rights. The thesis is divided into three chapters. In the introductory chapter the author describes the theoretical basis of human rights, the concept, development, and especially their specific nature and function compared to conventional legal norms, which is relevant for subsequent correct understanding of their application in horizontal relationships, which is the theme of the second chapter of the thesis. ní'' poskytuje rozbor tří oblastí zákonné úpravy ochranných známek včetně použití související judikatury jednotlivým oblastem. Diplomová práce se věnuje institutu ochranné známky jako takové, možnostem její ochrany a úpravě vymáhání práv k části diplomová práce podrobně popisuje institut ochranné známky a její historii, funkce ochranné známky, zatřídění v rámci duševního a průmyslového vlastnictví, rostoucí význam ky a rozšiřující se okruh druhů ochranných známek. V následující části diplomové práce je detailně rozebráno registrační řízení u ÚPV, a to od podání přihlášky až po jednotlivá fakultativní řízení, která mohou v rámci její ochrany nastat, až po případný zá do rejstříku ochranných známek. Podrobně je rozebráno připomínkové řízení a zejména námitkové řízení. V námitkovým řízením jsou důkladně popsány osoby oprávněné podat takové námitky a rozebrány možné důvody v práce se dále zaměřuje na prostředky ochrany poskytované nejen ÚPV, ale i soudy a dalšími orgány, kterými je ochrana vhodně doplněna i v spotřebitele, čímž je poukázáno na to, jak velký význam ochrana v této oblasti má. The purpose of the thesis is to analyse the phenomenon of parallel imports, define the pros and cons of parallel trade for respective entities and also society as a whole as well as describe how the trademark law may influence parallel importation of trademarked goods. In addition, the thesis analyses individual means of legal protection against parallel imports identified as illegal. After the introduction summarizing why it is appropriate to deal with the parallel importation phenomenon, the second part of the thesis describes the basic concepts in the context of parallel import issues: trademarks, parallel imports and exhaustion of trademark rights. The second part also describes the positive and negative impacts of parallel trade and why the doctrine of exhaustion of trademark rights appears to be the most appropriate way how to solve the difficulties in the relationship between trademark owners and parallel importers. The third part of the thesis aims to provide a reader with the basic sources of law which affect the phenomenon of parallel importation from the trademark law's point of view.
