Le contrat administratif, catégorie à laquelle sont rattachés les marchés publics de travaux, est caractérisé par son régime inégalitaire. L'usage de pouvoirs exorbitants du droit commun par le seule autorité administrative contractante, lors de l'exécution du marché, met particulièrement en évidence ce constat. Les recherches effectuées dans le cadre de cette étude confirment cette inégalité entre les parties, qui s'avère justifiée par l'intérêt général que défend l'administration maître d'ouvrage public. Pour autant, elles révèlent aussi que l'exécution des marchés publics de travaux n'est pas un droit de déséquilibre. L'étude démontre en effet que les normes et le juge garantissent l'équilibre financier du marché. La sauvegarde de cet équilibre conditionne le bon accomplissement des travaux commandés et assure donc la satisfaction de l'intérêt général. / The administrative contract, category to which the public works contracts belong, is characterized by its unequal system. The use of exorbitant powers by the sole contracting authority during the execution of the contract, especially highlights this fact. Research conducted in this study confirm this inequality between the parties, which is justified by the general interest that defends the public works authority. However, they also reveal that the execution of public works contracts isn't an imbalanced right. The study shows indeed that the standards and the administrative judge guarantee the contract's financial balance. The preservation of this balance determines the proper accomplishment of the ordered works and thus ensures general interest's satisfaction.

This article focuses on the concrete study of two forms of public infrastructure construction in our country: Public Private Partnerships and public works contracts, analyzing their characteristics, implications, differences and how they are regulated. Also, it realizes a critical analysis of the specific case of the contract of concession of the Chinchero’s airport and the signing of the respective addendum, concluding that the addendum meant the denaturing of the PPP and suggesting some proposals about this case. / El presente artículo se centra en el estudio concreto de dos formas de construcción de infraestructura pública en el país: las Asociaciones Público Privadas y los contratos de obra pública, analizando sus características, implicancias, diferencias y la forma como se encuentran regulados. Asimismo, se realiza un análisis crítico del caso concreto del contrato de concesión del aeropuerto de Chinchero y la firma de la adenda respectiva, concluyendo que la adenda significó la desnaturalización de las APP y planteando algunas propuestas en torno a este caso.

This master's thesis follows up a theme of budgeting for valuation of public construction contracts. It examines in details how to draw up a budget and optimize it to the concrete public construction contract. The thesis is structured in three fundamental chapters. The opening chapter describes theoretical grounds of public construction contracts from the contractor's point of view. Also basic methods how to draw up a budget are described in the first chapter. The second chapter covers a description of a systematic approach how to draw up a cost effective budget, throughout structural cost saving activities. In the third chapter the systematic approach is put in place on concrete public construction contract. The goal of the thesis is to draw up a competitive budget which won't be rejected from the competition for its exceptionally low price at the same time.

This thesis focuses on the issues related to the requirements of the contracting authority contained in the tender documents of public works contracts. In the first part, the basic concepts of public procurement are explained, where most attention is devoted to particular tender documents. The second part deals with the situation of public procurement in the Czech Republic, during the years following the opinion of the newly released energy efficient buildings. A case study is used to determine whether the use of economic net present value (NPV), as the evaluation criteria for the selected public order.

In this diploma thesis it is solved issue of determining the estimated value by public authority of works contract and determining price in the pre-investment phase of build-up. The work is based on a questionnaire survey, which is supplemented by practical examples of finished works contract.
