The Shared Custody Experience: The Adult Child's Perspective on Transitions, Relationships and Fairness

Shared custody has risen to the fore as one of the most contentious issues facing family law justice systems. Ongoing efforts to implement or contemplate legislative reforms to prescribe a rebuttable presumption for shared custody have been central. Drawing on in-depth, retrospective qualitative interviews with 28 young adults between 18 and 25 years of age, this researcher conducted a thematic analysis and examined children’s perspectives and motivations regarding transitions into and out of shared custody, relationships with parents, and their sense of fairness around decision-making. The dissertation research is presented in a ‘publications format’ and contains an introduction, three self-contained journal-ready publications and an overarching discussion. The introduction provided an overall review of the literature and presented a developing model for tying together the complex strands of existing theoretical and empirical literature. Paper one focused how and why transitions into and out of shared custody happen. Drawing on the metaphor of alchemy, the analysis illustrated that shared custody is not a short-cut to a successful custodial arrangement or parent-child relations. Shared custody blends together complex interactions among elements related to the child’s living situation, maturation and changing notions of fairness, flexibility, the push and pull of relationships, and in some instances, rigid enforcement. The second paper highlighted how participants’ utilized the business strategy of “managing-up” and illustrated how children are active agents in navigating post-separation family relations finding ways to exert their agency to help and protect siblings, manage parental conflict, maintain shared custody to shield their parents and siblings from emotional hurt and initiate contact to maintain parent-child relationships. Including children’s voices in custodial decision-making is predicated on a rights-based doctrine that children ought to have input on decisions that affect their best interests. Participants felt that young children (13 years or less) should have input in how their arrangements were constructed, but not the final say about the type of custodial arrangement. There was general consensus that adolescents (about age 14), should have considerably more input. A final overarching discussion chapter integrated the three papers with the model presented in the introduction and suggests implications for policy and practice.

Skilsmässans negativa konsekvenser för barn : En litteraturstudie / The negative consequences of divorce for children : A literature study

Den aktuella litteraturstudien som är en scoping review syftar till att identifiera,värdera och syntetisera forskning om vilka negativa konsekvenser för skilsmässobarn som uppkommer till följd av föräldrars separation samt vilka omständigheter som bidrar till dessa. Totalt 15 artiklar publicerade mellan 2017 och 2022 identifierades. Utfall och omständigheter kunde urskiljas genom en narrativ samt en variant av en tematisk analys. Skilsmässobarnens konsekvenser till följd av föräldrarnas skilsmässa visade sig i form av psykisk ohälsa, minskat välbefinnande, fysisk ohälsa, försämrad skolanpassning, försämrad relation till föräldrar samt försämrad anpassningsförmåga. Utfallen visade sig bero på omständigheter såsom barnets stigande ålder, om man var flicka eller pojke samt föräldrarnas grad av konflikter. / The current literature study, which is a scoping review, aims to identify, evaluate, and synthesize research on the negative consequences for children of divorced parents that may arise as a result of parental separation, along with the circumstances that act as contributing factors. A total of 15 articles published between 2017 and 2022 were identified. Outcomes and circumstances were established through a narrative and also a variant of a thematic analysis. Seemingly, the consequences for children that experience parental divorce appear in the form of mental and physical illness, reduced well-being, impaired adjustment in school and deteriorating relationships with the parents. The outcomes turn out to be due to circumstances such as the child’s rising age, if the child was a girl or a boy, and the level of parental conflicts.

The work deals with Parental Alienation Syndrome and connects it to the separation of parents or in their process of a breakup. It also deals with selected work options, specifically work with parents in the conflict and the actual work with the family in the presence of this syndrome. The theoretical part is a chapter of parents'separation and a chapter of Parental Alienation Syndrome. The practical part includes a description of the research, evaluation and conclusions. The main objective of the research is to analyze the situation of the family, giving rise to the syndrome from the perspective of the alienated parents. Parental Alienation Syndrome is a high risk for society and its occurrence or consequences are not negligible. Topicality is given to the large number of separations and divorces in our society.

Il presente progetto di ricerca si occupa degli interventi di gruppo per figli di genitori separati, con la finalità di operare una riflessione di stampo metodologico sui dispositivi che sono stati analizzati e studiati in letteratura, per poi approfondire alcuni aspetti dell’intervento Gruppi di Parola, attivo in Italia. L’articolazione in tre studi, di carattere qualitativo, ha permesso di avvicinare l’oggetto di ricerca secondo prospettive e metodologie differenti. Il primo studio coincide con una rassegna sistematica narrativa, condotta al fine di sistematizzare la letteratura di livello internazionale relativa agli interventi di gruppo per figli di genitori separati che sono stati analizzati attraverso un impianto di ricerca rigoroso. Gli altri studi approfondiscono rispettivamente due aspetti del dispositivo Gruppi di Parola: gli elementi teorico-pratici che lo fondano attraverso una prospettiva etnografica focalizzata (secondo studio) e le dinamiche interattive messe in movimento durante una specifica fase rituale del processo (l’accoglienza) per mezzo di una metodologia osservativa complessa (terzo studio). / The present research project deals with group interventions for children having separated parents. Its aim is a methodological reflection about the programs analyzed and studied in the literature in order to later deepen some aspects of the Italian intervention Gruppi di Parola. The organization in three qualitative studies has allowed the researcher to approach the research object according to different perspectives and methodologies. The first study corresponds to a Systematic Narrative Review, carried out in order to systematize the international literature about the group interventions for children having separated parents which have been analyzed through a rigorous research design. The other studies respectively deepen two aspects of the intervention Gruppi di Parola: the theoretical and practical underpinnings through a focused ethnographic perspective (second study) and the interactive dynamics activated during a specific ritual phase of the process (welcoming) by means of a complex observational methodology (third study).

Il est connu que de nombreux enfants vivent la séparation conjugale de leurs parents. Suite à cette séparation, les enfants vivent majoritairement avec leur mère (parent gardien), tout en maintenant des liens avec leur père (parent non gardien). Bien que les principes de droit suggèrent que l’enfant ait le droit de préserver des liens avec chacun de ses parents à la suite de la séparation conjugale, ces liens ne sont plus assurés sur une base quotidienne et peuvent être affectés. Vivant la séparation de ses parents, l’enfant peut être exposé aux conflits parentaux puisque la séparation peut augmenter leur intensité. L’objectif de ce mémoire est de mieux comprendre la perception des parents non gardiens de leur lien avec leur enfant dans un contexte où les conflits parentaux perdurent à la suite de la séparation conjugale. Un sous-objectif est de documenter les facteurs qui influencent les liens entre les parents non gardiens et leur enfant à la suite de la séparation conjugal. Pour ce faire, des entrevues individuelles semi-directives ont été effectuées auprès de huit parents non gardiens. Une analyse de contenu thématique concernant leur perspective sur l’objet de recherche a été effectuée. Selon la perspective des parents non gardiens, les résultats montrent que la qualité de la relation entre eux et leur enfant se maintient positivement. Le facteur le plus prédominant est les conflits parentaux post-séparation. Il en ressort qu’ils alimentent d’autres facteurs, tels que les modalités de garde d’enfant et droits d’accès, la fréquence de contacts entre les parents non gardiens et leur enfant, les comportements des enfants à l’égard de leur parent non gardien, l’engagement parental des parents non gardiens ainsi que la relation parentale post-séparation. / It is known that many children are living with parents who are conjugally separated. With this in mind, following the separation the children mostly live with their mother (resident parent), while maintaining contact with their father (non-resident parent). Although the principles of law suggest that the child has the right to maintain ties with both parents after marital separation, these visits are not always done on a daily basis and the qyality of their relationship can be affected. Living the separation of his parents, the child may be exposed to parental conflict because the separation can increase their intensity. The objective of this thesis is to better understand the perception of the non-resident parents and their relationship with their child in a context where parental conflict persists after marital separation. A fundamental objective is to document the factors that influence the relationship between non-resident parents and their children after the marital separation. In order to achieve these objectives, eight non-resident parents were interviewed using individual, semi-directive interview techniques. An analysis of the thematic content pertaining to their perspective on this research subject was then conducted. From the perspective of the non-resident parents, the results have shown that the quality of the relationship between them and their child remains positive. The most dominant factor is post-separation parental conflict. It appears they feed on other factors such as, child care arrangements and access rights. Also, the frequency of visits between the non-resident parents and their child, the child's attitude towards their non-resident parent, the parental involvement of non-resident parents and the parental relationship post-separation, all have an impact.
