Vznik a vývoj práva sociálního zabezpečení na území českého státu / The formation and development of social security law in the territory of the Czech statePawlita, Lukáš January 2012 (has links)
The main theme of this thesis is to capture formation and development of the social security system that provides hedging of individuals against illness, invalidity and old age. The first modern form of the social security within the area of Czech state appeared at the end of 18th century in the form of so called Theresian and Josephinian pension normals. These normals were designed to secure retired state officers against poverty. In the late 19th century were adopted two important norms - law concerning accident insurance and law about sickness insurance for workers. Pension insurance program for workers, the largest social group, was established as late as 1924. The Social security system was split among several offices, also insufficiently hedged by steady incomes in wage-workers and miners insurance; as a consequence it led to indebtedness of the system. During the occupation period, the financial funds were devaluated, appeared some organization changes and the new way of conviction about suitability of whole-society pension and sickness insurance was applied. Modern law about national insurance from year 1948 was canceled during the totality era. The reason was to apply soviet model of social security. The diploma thesis deals with the topic of the professional past of managers in social services and its influence on the performance of managerial profession. In my thesis I'm dealing with those workers who are currently working in managerial positions and previously worked as social workers. I am interested about how their professional past influenced the performance of their managerial function and how these managers get new managerial competencies. In the theoretical part, I mainly deal with the competencies of social workers, the competencies of managers and then I compare them. I also deal with the acquisition of managerial competencies. In the practical part, I describe the methodology of research surveys and present the results I have reached. The main method is a qualitative research survey using a semi-structured interview. A supplementary method is a quantitative research survey using a questionnaire. In the discussion, I compare these results with available resources. Finally, I reflect the fulfillment of the goals of my thesis and make recommendations.

Equal treatment and prohibition of discrimination in employment relations and social security systems in Czech and European law Abstract The dissertation deals with equal treatment and prohibition of discrimination in employment relations and social security systems in Czech and European law. In the introductory section the historical context of anchoring the principle of equality into the legal regulation is outlined. The attention is paid on one hand to the social changes in the first half of the 20th century, which led to the protection of equality in Europe, and on the other to the legislative initiatives and the role of justice in the second half of the 20th century. The second part explains the concepts of equality, discrimination, employment relations and social security systems, which are the central motifs of the dissertation. It analyses how these concepts were viewed in the past, how they evolved, and in what forms and manifestations we can come across them today. The third part introduces the Czech and European legislation, which constitute the current Anti-Discrimination law. Emphasis is placed on the assessment of the Czech Anti- Discrimination Act with regard to its almost ten years of effectiveness in the Czech legal order. Social security is an important part of the state social policy. The social security development depends upon many factors and their interaction and interpretation changes in historic context. Historic sources of social security development show a strong and urgent need of the state to deal with these questions. Chapter 1 contains a continual historical overview of social security in Czech Republic. The development of this important part of the state economy is closely connected to political and economical situation and the need of valid legal enactment implementation. The social security concept is inspired by proven models of other countries, especially Sweden. The basic system principles have to be respected simultaneously. Chapter 3 follows the fundamental problems which have been monitored since 2000. Their particular form is summed up in seven principal paragraphs. As the Czech Republic is now a part of the European economic space I find very important to treat the basic principles and objectives of social policy in European countries, however in general terms. Efektivní daňové sazby daně z příjmů fyzických osob v zemích EU / The effective tax rate of personal income tax in the EUStaňková, Zuzana January 2010 (has links)
This diploma thesis explores effective tax rates of personal income tax in the European Union. It analyzes the tax policy of newer and older EU member states in relation to personal income tax and social security. Structural elements of this tax play an important role in taxation of natural persons and differ vastly in individual states of the EU. The discrepations among the taxation rates can cause serious problems in the functioning of the single market of the EU. The EU aims to coordinate and harmonize the direct taxes, which would remove the obstacles to the single market functioning. The taxation of natural persons shows apparent mutual differences among the states -- not just regarding rates of this particular tax -- resulting from cultural customs. These differences do not, so far, enable the approximation of individual states in natural persons' taxation and create space for possible tax competition.

This diploma thesis is dealing with social work theories and their usage in practice of social workers. Theoretical part describes their historical evolution until actual crisis of social work. Afterwards it is aimed on specific model, task centred approach. This approach has in Czech environment exceptional position, because it shows parallels with Act on social services and Standards of social services quality. Conclusion of theoretical part is dedicated to relationship between how social workers use in their practice social work theories and how this state is reflected in their professionality. Practical part is processed in form of qualitative research in which ten social workers took part. Through half structured interview were mapped if and which way social workers are using in their practice social work theories, and their experiences with task centred approach. Results of research, which are more closely elaborated within final discussion showed suppressed importance of theories. Social workers usually in their practice are not using specific theory (nor task centred approach), but they more rely on "their own theories" or internal rules of organization where they work.

In 2006, there were changes in the social security system through the adoption of Act No. 110/2006 Coll., about subsistence level and living wage, Act No. 111/2006 Coll., On assistance in material need and Act No. 435/2004 Coll. on employment. The aim of the newly adopted laws was greater motivation of unemployed persons to find employment as soon as possible and thus to reduce the number of long-term unemployed individuals. At the same time the advantage of individuals who actively solve their situation compared to those who are passive recipients of benefits. With the adoption of these laws was to strengthen the incentive function of the social system, the transition from passive to active solidarity, impaired access to social benefits and avoiding the misuse of social benefits.

In this thesis was created a medium-term draft of actions for the local development needs of village Staré Město pod Landštejnem based on economic, social and organizational possibilities that the village has. This draft was based on the analysis of themes from a questionnaire survey among residents of the village, interviews with local actors, existing development documents related to the community and the author's own ideas. A part of this thesis is the geographical characteristics of the village area and the analysis of literature dealing with the countryside, especially its local and regional development, spatial planning and territorial development of rural settlements and the surrounding landscape, including the analysis of materials prepared for the municipality. Another important output of the thesis is to summarize and supply the existing principles for spatial and landscape planning in the village.
