Vzorce legitimizace lobbingu v zemích Střední Evropy a její rozpory / Patterns of the legitimation of lobbying in Central Europe and their ambivalences

The paper examines attempts to professionalize and institutionalize lobbying in Poland and the Czech Republic from the beginning of the 1990s to 2016, from the point of view of the sociology of professions, the sociology of public policy-making and interpretative policy analysis. First, on the basis of an analysis of the professional paths of 80 Polish and Czech commercial lobbyists, it presents their common typology for both countries and shows how efforts to gain recognition and enhance their professional status, i.e. efforts to professionalize lobbying, are linked to their pursuit of political legitimacy. Then it shows lobbying as a specific way of constructing the political activity of private actors as a policy problem. It illustrates the conditions under which lobbying in both countries was constructed as a problem and set on the agenda. In doing so, the dissertation pays particular attention to the role of transnational actors in this process. Finally, lobbying regulation processes are analysed as arenas where the symbolic boundary between the public and private spheres is negotiated and redefined.

Private military companies have rapidly filled in many operational force capacities that national militaries now longer have the capabilities to fill natively. As such, PMCs have expanded their rosters as well as their services provided to fill in many roles, and have carried out many such roles such as logistics management, personal and site security, and some inherently state functions such as training indigenous security forces and interrogation of prisoners. This rise has impacted national militaries in many facets of their operations and abstract professional bases. The ability of the PMC to carry out operations at the same standard as regular soldiers but with higher pay has impacted how the regular soldier views their own place in the professional national military, and creates problems for the establishment as a whole. This thesis will discuss the Iraq War as a case study and the impact of PMCs on the war, as well as introduce the Huntingtonian theories of soldier professionalism and corporateness, and will also employ a critical Marxist perspective to analyse the role and impact of PMCs in the modern military convention and in civil-military relations.

A subject of this diploma thesis is a role of private military companies (PMCs) in security sector reform (SSR) in Iraq in a period from 2003 to 2011. The first chapter of the thesis focuses on goals and process of post-conflict SSR from a theoretical point of view because of an involvement of PMCs in post-conflict reconstruction which was taking place in Iraq. Part of the theoretical chapter is a SSR and steps which is the SSR process composed of. The second chapter concentrates on definitions and typologies of PMCs. This part of the thesis makes a distinction between mercenaries and private military contractors and PMCs themselves. Last but not least the second chapter encompasses discussion about a role of PMCs in a process of SSR in post-conflict countries. The third chapter is dedicated to a historical development of cooperation between PMCs and the US; it analyses roots of the US dependence on services provided by PMCs. A case study of Iraq elaborates on a role of PMCs in a process of Iraqi security reform. Aim of this chapter is to define advantages and disadvantages of usage of services provided by PMCs. By taking into account disadvantages employment of PMCs represents, steps that could help to avoid those in the future are suggested.

This thesis presents results of analysis of internet forum, which appeared under article from internet server aktualne.cz in 2006. The article is dealing with abusing of cage beds in context of on people with mental handicap and people with mental illness focused social care system. For qualitative research was used the method of coding inspired by methodological approach of "grounded theory". In theoretical part of this thesis I analyzed relevant theoretical concepts from area of disability studies and gender studies with special focus on critic of concept of liberal citizenship and social contract theory. The key theoretical concept of the thesis is dichotomy of private and public sphere. In next part of the thesis is I am describing context of causes of cage beds in Czech Republic and I am delineating the basic traits of debate here. In empirical part I am describing five key themes, axial codes. In framework of these themes I am defining the differences of people with mental handicap or people with mental illness. The themes are: space and isolation, efficiency, responsibility, stigmatization and care work. Right and good : Argumentation and Discourse of Czech Activists for Women's Suffrage Jitka Gelnarová Abstract The dissertation deals with the concept of suffrage within the discourse of Czech women's suffrage activists between 1897 and 1914. The aim is to define how the concept of suffrage was constructed by Czech suffragists within the context they lived in, how their notion of the suffrage was influenced by the fact that different women were positioned differently within the system of hierarchies based on gender, class and nation. The dissertation focuses on the hierarchies present in the discourse; the relation of "public" and private" in the discourse; the notion of "political representation" in the discourse; positions the suffragists spoke from and their representation of the enemy ("us/them"); the functions the concept of "Czechness" fulfilled in relation to the demand of female suffrage in the discourse; and the relation of "universality" and "particularity" to the demand of female suffrage in the discourse.

The subject of this thesis are now almost extinct brick and mortar video rental stores that were a crucial film distribution window between theatre and television premiere only a few decades ago. The research focuses on the arrival of video rental stores run by small private entrepreneur in Prague 1990-1995 right after the country reinstalled its market economy. The text tries to reconstruct, describe and analyse six particular places of business via interviews with their owners and further archive materials - and in addition maybe ascertain reasons of their closure / continuance after 1995. Part of the thesis is also a list of 90 addresses of Prague video rental stores from around that time and basic figures of their arrangement.

The dissertation deals with the relationship between sport and the law, in conjunction with private international law. For more than a century sport passed through an important period of development. Many sports have been successfully forgotten, some have survived, and many can be included as the new sports with a tradition of several years or decades. Legal theory and legal practice so far took no particular need to take the issue of sports opinion. Sport is an objectively existing category in nature regardless the law. However, questions regularly associated with sports injuries and their resulting consequences emerged. The growing need for legal regulation of sport industry is primarily related to risks that sports bring to their surroundings and also to athletes. In the foreground there is the application of civil law, which affects compensation for damage to health and sports injuries. Clear solution has not been found to this day. The main goal of this thesis is to evaluate the current state winter sports legislation with an emphasis on skiing. The main topic of the dissertation is responsibility for damages in connection with ski injuries. Electronic commerce from a private international law perspective The objective of this thesis is to study how the United Nations Convention on Contracts for the International Sale of Goods (CISG) is applied in the field of electronic commerce and compare it to the United Nations Convention on the Use of Electronic Communications in International Contracts in regard to the prevailing tendency to remove legal barriers to electronic commerce. The comparison is made in terms of geographic and material scope, forms of contract and how contracts are formed. An analysis of conditions and obstacles to the application of the CISG within the field of electronic commerce represents the core of the work. The thesis is based on the assumption that the Convention on the Use of Electronic Communications in International Contracts is an instrument which helps to overcome identified obstacles. The thesis formulates a conclusion on overcoming just one of the obstacles on the basis of the principle of technological neutrality, and it further demonstrates that the requirement of being in written form may remain an obstacle. As such, the thesis is a response to the question of why the Convention is signed and ratified by a relatively small number of states.

In today's world, where globalisation and internationalization becomes part of our daily life, international entrepreneurship turns into a more actual and important issue. The role of law in this system is to set borders and give directions, which reflect the current state of global society. The aim of the diploma thesis Personal status of legal entities in private international law is both to clarify the actual legal situation of determining the personal status of legal entities and to find out the current grade of global legal integration in these aspects, that either encourages or prevents legal entities from international activities. In order to achieve that, firstly, a theoretical definition of the historically evolved theories for determination of personal status of legal entities is given. Subsequently, their main be- nefits and drawbacks are analysed. The first part is concluded with a definition of the scope of the conflict between the two main theories - incorporation theory and real seat theory. Additionally possible ways, how to solve this conflict together with their potential impact, are sought. The aim of the master thesis named Valuation of the company Bankovní akademie - Gymnázium a Střední odborná škola, a.s. is to estimate market value of the company as at the date of August 31, 2015. The common valuation methods are used in the process of determination of the value. At first, the company is being shortly introduced, which is followed by a strategic and a financial analysis in order to examine the companys financial soundness and assess the perspective of the companys future. The conclusions of the analysis are used for value drivers prognosis and financial plan elaboration, which is followed by valuation of the company. Taking into account the good prospects of the company I choose the DCF equity method to determine its value. The comparable transactions method is used as a supplemental valuation method.
