Limity a rizika rozvoje PPP projektů / Limits and Risks of Public-Private Partnerships Development

Objective of this diploma thesis is to identify risks and barriers connected with expansion of using the Public-Private Partnership concept, fractional objective is to identify limiting factors which affect still not very developed PPP projects in the Czech Republic. The theoretical part of the thesis is dedicated to definition of PPP concept and explanation of its specific characteristics in providing of public goods. The practical part is focused on chosen projects. On this sample are limits of expansion of using PPPs identified and analysed using the method of partial generalization. On the basis of analysis of available literature and qualitative research made there are suggested possible solutions.

Význam komunálního lázeňství na příkladu lázeňského města Třeboň

Diplomová práce se zabývá charakteristikou lázeňství jako součásti zdravotnictví, specifické formy cestovního ruchu a významného faktoru sociálně-ekonomického rozvoje měst a regionů. Analyzuje současný stav lázeňství v České republice a charakterizuje úlohu a aktivity klíčových subjektů v lázeňství. Praktická část práce se zabývá podrobnou analýzou komunálních lázní v Třeboni. Na tomto konkrétním příkladě jsou ukázány důsledky obecných trendů, evropské a národní politiky na rozvoj lázní a lázeňského města. Jsou zde charakterizovány aktivity a úloha obce v lázeňství a význam spolupráce subjektů soukromého a veřejného sektoru. Závěr práce se zabývá konkrétními důsledky rozvoje lázeňství v Třeboni v oblasti zaměstnanosti, podnikání, sociálních dopadů na místní obyvatelstvo, životního prostředí a hospodaření města.

The diploma thesis is focused on assessment of changes in tax law arisen in connection with private law recodification. The first part is focused on private law development in the Czech Republic because the new Civil Code follows historical private law regulation in many ways. The second part is focused on description of possible situation that could occur if the tax law has not been adjusted to private law recodification. The key issue is the assessment of tax solution of chosen recodification changes with pointing out possible obscurities in the tax law.

The European international private law has undergone a dynamic development during the last twenty years. It can be assumed that this development will continue con-sidering the increasing need for dealing with the legal relations involving a cross-border element, which arise thanks to the exercise of the freedom of movement of goods, capital, services, and people in the frame of the European Union. The experts in international private law discuss the directions of its future development. Should it continue the same or similar direction as until now, i.e. the unification of individual in-struments and conclusion of international agreements (limited with the EU competen-ces), or should it take the direction of a comprehensive codification of the European conflict of laws? The last considered direction is the adoption of a comprehensive common code on private law, i.e. a code of the private substantive law rules. Neverthe-less, this possibility deals with the diversity of the law cultures and the law orders among the EU member states.

This thesis aims to describe and evaluate actual state of author's moral rights legislation in Czech republic especially with reference to civil law recodification. The author's moral rights represent a complex of basic juridical institutes, which is the whole copyright structure, derived from. The thesis has an ambition to contribute in a long term discussion about the future development of copyright by a relevant detail analysis, description and evaluation of basic copyright system elements related to author's moral rights. Selected method is based on systematically mapped normative linkage of author's moral rights within international treaties, constitutional law and unit acts. The thesis endeavours to point out some less obvious connections between author's moral rights and other juridical institutes to achieve as complex image of recent state of legislation as possible. Other purpose of this work is to analyse problematic or unclear relationships between copyright and new civil code legislation such as e.g. conception of a work protected by copyright in light of new definition of material and immaterial matter or shared principles of moral rights . Daň z nemovitých věcí po rekodifikaci soukromého práva / Real property taxes after recodification of private law

The aim of my thesis is to introduce the legislation related to real estate tax in the Czech Republic, to offer its critical evaluation and suggestions for its modification in the future. The work is divided into two parts, a theoretical part, which includes four chapters and a practical part, consisting of six chapters. The general part is devoted to the process of recodification of private law in the Czech Republic. It describes recodification in a broader context, it identifies legal institutes connected to real property tax and summarizes selected changes in terminology. In the next chapter is summarizes general theoretical introduction of taxes, with an emphasis on property taxes and briefly described elements of the tax structure. Fifth chapter and the next ones deals specifically with the real estate tax. First, the tax is described in general terms, then the amended changes are summarized and the scheme of the Act is introduced. The sixth chapter provides a complete analysis of the land tax, seventh chapter the tax of buildings and units. In both chapters the thesis consistently addresses all elements of aforesaid taxes. Ekonomické aspekty PPP projektů / Economic aspects of PPP projects

Thesis is focused on the analysis of the application Public Private Partnership within the financing of public infrastructures projects. Public infrastructure financing has traditionally lain in the domain of public sector. A tightening of many countries' budgets recently has led to an exploration of alternative resources for financing transport infrastructure as e.g. PPP. The aim of the thesis is to compare or evaluate which form of financing (PPP or using only public finance esp. issue of public bonds) is more effective. The thesis is separate into 2 important parts, theoretical and practical. The theoretical part of the thesis provides the general description of PPP projects, international experiences and about the legal and institutional framework within the EU and Czech Republic. Practical part of the thesis is focused on the main advantages and disadvantages of PPP projects. Here is also part devoted to the financial models using for the comparison which form of financing (PPP or traditional public procurement) is more efficient. Conclusion of the thesis summarizes the gained findings and also assesses which form of financing is more efficient.

The thesis is focused on an overall assessment of the appropriateness of the provision of public goods in the Czech Republic in the form of Public Private Partnership (PPP). The theoretical part of the thesis deals with the general issue of providing public goods and characteristics of PPP as an alternative to the institute of public contracts. This theme is further developed by analysis of the possible forms of PPP projects with financial assistance from the Structural Funds. The practical part is devoted to analysis of the implemented municipal PPP project of construction and operation of parking house. For the project effectiveness evaluation are used outputs from the calculated financial model which are supplemented by the application of theoretically possible co-financing from EU funds.

Practical part of the Thesis describes the development of PPP projects in the whole Europe. Current pilot PPP projects in the Czech Republic are also analyzed. Real PPP project, D3 highway, and its economic availability are being analyzed and evaluated in the final part of the Thesis.

This diploma thesis is a comprehensive and up-to-date review of public private partnership (PPP) infrastructure projects at the municipal level in Germany. Public private partnerships use the know-how and the skills of the private sector for the construction and operation of infrastructure and for the long-term provision of public services. The overall goal of this thesis is to discuss the municipal government's approach to PPP infrastructure projects. The theoretical part of this thesis includes informations and fundamental characteristics of public private partnership project types and the most widely used financial instruments in Germany, as well as the obstacles, challenges and prospects of success for the PPP Programme. The thesis further deals with the legislation and the institutional framework of this cooperation, including the establishment of the Partnerschaften Deutschland und other PPP units in central and local government to promote and manage projects. In particular we focus on the possibility of the involvement of private partners in public private partnerships to clear the backlog of investment and to satisfy local authority investment needs. The empirical part of this work describes the efficient, beneficial and cost-effective delivery of what is currently one of Germany's biggest PPP projects in the field of public- sector building construction: refurbishing, financing and operating the 90 schools in the district of Offenbach in the south of Hesse.
