Abbeville v. the State of South Carolina: A Case Study

Abbeville v. the State of South Carolina (2005) is the latest lawsuit in a long line of cases addressing school finance issues that originated with Brown v. the Board of Education (1954), Serrano v. Priest (1971), and the San Antonio Independent School District v. Rodriquez (1973). Unlike many of the other school finance cases that have been adjudicated, Abbeville has not been the subject of much academic scrutiny. This case study documented Abbeville's origins in an effort to begin the process of academic examination and understanding. To document the inception of this case, five research questions were developed to guide the efforts. These five research questions were: 1) What political and economic conditions were present in South Carolina in the early 1990s that led to the decision to file the lawsuit?; 2) How were the eight lead school districts selected to be a part of the plaintiffs' case?; 3) What legal arguments did both the plaintiffs and defendants use in Abbeville?; 4) Why did the state choose to contest the lawsuit?; and 5) What was the 2005 ruling in the Abbeville case and how did people closely associated with the case react to the decision? The data used to answer these research questions included analysis of primary documents and eighteen qualitative interviews. The primary documents included the state constitution, current legislation in South Carolina affecting public education, previous school finance oriented court cases in South Carolina, and student achievement data. The eighteen participants in this study all shared a high degree of familiarity with Abbeville. Eleven were directly involved in the case (testified, heard and/or made legal arguments), four were deposed, and the remaining three followed the case closely. The credibility of this study increased through the use of triangulation, or the use of multiple data sources related to an issue of uncertainty, which produced the conclusions to the study found at the end of this document. As a result of the data collected, conclusions related to Abbeville are presented along with a discussion on the implications of this study. There are also suggestions for future studies. / Ph. D.

Use of the mini-cone penetrometer for evaluating the liquefaction potential of sands associated with Charleston, S.C. seismic events

First-hand reports on the 1886 Charleston earthquake contain numerous accounts for the widespread occurrence of liquefaction related features in and near the meizoseismal zone. Recent geologic studies have found evidence for the repeated liquefaction of sandy soils in the Charleston area due to recurring large seismic events. In the course of this investigation 24 mini-cone penetration tests were performed at seven sites in or near the meizoseismal zone of the 1886 earthquake to determine the factors influencing ground failures due to liquefaction. These tests were supplemented with soil borings, sieve tests and a limited number of standard penetration tests to aid in characterization of the sandy soils. Additionally, soil boring records in Charleston were obtained which provided in-situ testing data in an area with documented historical damage. The range of sites at which testing was done, or information was available, represent locations experiencing various levels of liquefaction and distances from the zone of seismic energy release. Penetration data were used to evaluate resistance of the sandy soil to cyclic loading and fonned the basis for assessing the effects that the lateral extent and distribution of loose sand layers has on the surficial manifestation of liquefaction. With the absence of cementation and extensive soil development, soils as old as late Pleistocene age have been found to be very susceptible to liquefaction. At several sites these soils have undergone at least three episodes of liquefaction and presently exhibit low penetration resistances, indicating that the progressive densification of a liquefiable soil layer can be minor unless it is in very close proximity to a large venting feature. The size and density of occurrence of vents and sand blows has been found to be primarily dependent on the extent of both the liquefiable layer and any overlying resistant layers. Layered system relations utilized with field performance data, and historical and geologic evidence for the occurrence of liquefaction features to suggest that the near surface peak horizontal accelerations induced by the 1886 earthquake were approximately O.3g in the meizoseismal zone and O.2g in the city of Charleston. This is in contrast with previous estimates of seismic shaking all of which point toward values in the range of 0.5 to O.6g. The reason for the different acceleration estimates is not clear at this time, and will be further studied in future extension of this work. / Master of Science

Crustal Structure in a Mesozoic Extensional Terrane: The South Georgia Rift and the Epicentral Area of the 1886 Charleston, South Carolina, Earthquake

On August 31, 1886 a large scale earthquake occurred in Summerville, S.C. causing severe damage in the coastal city of Charleston. Although intensive geological and geophysical studies have been conducted in the area, uncertainty remains about the details of the event. Recently evidence from seismic reflection profiles have shed light on the tectonic environment of the area. The epicentral area of the 1886 event lies within the South Georgia Rift, a Mesozoic rift terrane. Previous studies have revealed clues to the geologic structure and evolution of this feature. SEISDATA4 is the largest seismic reflection profile recorded in the area. By re-processing the line, information about the tectonic structure of the area was revealed. The early Mesozoic extensional basin that hosted the 1886 earthquake and is host to the modern seismicity recorded in the area, extends several kilometers to the south and west of Charleston, along SEISDATA4. Cenozoic and Mesozoic faults were resolved within the basin and along its northwestern boundary that is distinguished by a strong gradient in the magnetic field. However, the question as to which fault was responsible for the rupture of 1886 still remains. The refraction analysis provides better resolution of the lithology in Lower Mesozoic section. The termination of the strong reflection at the base of the Atlantic Coastal Plain occurs in a section of the profile that shows major disruption of the underlying reflections, and suggests that the termination of a lower Mesozoic basalt flow responsible for the reflection may be related to tectonic deformation. / Master of Science

A House in Charleston

This project began with the desire to design a house in a town for which I have always had a personal affection: Charleston, South Carolina. The house is designed for a an artist and his family of four and includes a studio for the artist. This design gained its own identity through the research of several historical Charleston housing typologies and acknowledgment of its place in the city. Structure and a panelized system of construction were major factors in the development of the house. As the project progressed, the design of the house moved from a strictly instrumental approach towards a more nuanced design that told a story about how the owners would live in the house. / Master of Architecture

Implications from a geotechnical investigation of liquefaction phenomena associated with seismic events in the Charleston, SC area

First-hand accounts of sand boils and other liquefaction-related phenomena associated with the Charleston, SC earthquake of 1886 provide clear evidence that liquefaction was common in this event. Recent geologic investigations in the Charleston area have found evidence for the repeated liquefaction of sandy soils in the Charleston area due to recurring large seismic events. Although this information has led to an improved understanding of seismicity in the Charleston region, little hard data exists in terms of ground motion characteristics or levels of seismic loading. A two-year field investigation was undertaken by Virginia Tech to study the liquefaction findings associated with the 1886 event from the perspective of geotechnical engineering. This involved defining the engineering parameters of the Charleston soils on the basis of in-situ and laboratory tests, and estimating the levels of seismic loading required to produce the observed liquefaction phenomena. Of the sites where field tests were performed, the surficial soils were largely formed from ancient beach ridge deposits. The findings showed that soil conditions within these deposits are appropriate for liquefaction. Also, there is clear evidence that soils as old as 230,000 years have liquefied multiple times in the past 10,000 years. Many of these soils remain susceptible to liquefaction at relatively low levels of seismic shaking, although there is some evidence for progressive densification. With respect to the seismic loadings, evidence is presented which suggests that both the magnitude and peak acceleration of the 1886 earthquake were less than what has been proposed by the seismological community (M = 7.7 and 0.5 - 0.6g peak acceleration). The findings of this study indicate that for an M = 7.5 event, peak accelerations in the 0.3 to 0.4g range would serve to explain the observed 1886 liquefaction phenomena. If it is assumed that the magnitude of the 1886 earthquake was less than 7.5, then the estimated peak accelerations increase. / Ph. D.

Ecologically sensitive planning for recreational communities in the southeastern low country

This creative project will develop a planning method for implementing concepts of ecologically sensitive recreational community design in America's southeastern low country (the coastal regions of South Carolina and Georgia). The first step in developing the method will be identifying a list of indicators measuring the ecological impact of recreational community design in the area. Secondly, the environmental impacts of planning methods if recreational communities in the low country will be analyzed and the most effective planning techniques relative to minimal environmental impact will be cultivated and integrated to formulate a single planning method. This method will subsequently be used to design a recreational community on Hutchinson Island, located on the Savannah River in Savannah, Georgia. The Hutchinson Island recreational community design will then be measured against the set of ecological indicators, and the results will then be compared against the aforementioned existing recreational communities.In the past thirty years, the popularity of the southeastern low country as both vacation destination and place of residence has increased dramatically due to a combination of factors, a beautiful environment with a favorable year-round climate, landmark developments in the area of recreational community design, and a steady growth in the wealth of our nation. As developers continue to meet the demand for housing and amenities (both recreational and commercial) in the area, the ecology, rich in biodiversity and aesthetic character is being compromised. Since development of the area shows no sign of slowing, there is a need for a planning and design methodology that is accountable for its impact on the natural environment. To thoroughly investigate the ecological realm of recreational community planning, this creative project will be limited to that area, although it is recognized that effective community planning addresses social and economic sustainability, as well as that of the environment. / Department of Landscape Architecture

Opening Pandora's box : Richard Nixon, South Carolina, and the southern strategy, 1968-1972

Much discussed and little understood, Richard Nixon's southern strategy demands scrutiny. A brief survey of the literature suggests that study on this controversial topic has reached an impasse. Southern historians keen to emphasise the importance of class in the region's partisan development over the last fifty years insist that any southern strategy predicated on racialised appeals to disaffected white conservatives was doomed to failure. Conversely, conventional accounts of the Nixon era remain wedded to the view that the southern strategy represented a successful devil's bargain whereby an avaricious Californian exchanged the promise of racial justice for black southerners in return for white Dixie's electoral votes. Most sobering of all are political scientists concerned with executive power, who evidence the limited discretion enjoyed by presidents to implement any agenda inimical to the corporate will of the federal bureaucracy. Since Nixon's executive departments were brimming with Democratic holdovers from the Kennedy and Johnson years, the question of whether or not the President demanded concessions to southern racists apparently becomes more or less irrelevant: the 'fourth branch' of the federal government inevitably ensured that a southern strategy was simply impossible to execute. In reality, much of this stalemate is the product of academic territorial warfare on the battleground of a subject wide open to multiple interpretations. A southern historian keen to showcase the importance of his local research is likely to show little interest in evidence that a President based in Washington D.C. could initiate social change in Tuscaloosa, Alabama. Similarly, political scientists fighting an unrewarding battle to emphasise the autonomy of federal departments are naturally disinclined to highlight examples of presidential willpower altering bureaucratic culture. Nevertheless, an intriguing paradox remains in evidence. Despite leaning more towards the political philosophy of antediluvian white southerners than the demands of black Americans, Richard Nixon presided over a period of such fundamental social reconstruction below the Mason-Dixie line that he could legitimately claim to have desegregated more southern schools than any other President in history. Whilst a raft of excellent monologues demonstrating the impact of local movements down South on national politics have been published over the last decade, few have even attempted to explain this peculiar phenomenon. As Matthew Lassiter observed in a Journal of American History roundtable on American conservatism in December 2011, 'the recent pendulum swing has overstated the case for a rightward shift in American politics by focusing too narrowly on partisan narratives and specific election cycles rather than on the more complex dynamics of political culture, political economy, and public policy.' The purpose of this thesis is to explain how a President notorious for pursuing the votes of white segregationists rested at the head of a federal government that ruthlessly dismantled Jim Crow. By incorporating the range of methodologies elucidated above, it will identify exactly how much influence President Nixon and his executive officers exerted over civil rights policy. Was Nixon's reactionary agenda thwarted by over-mighty bureaucrats? Or did the President act more responsibly than the majority of commentators have admitted?

Gender Segregated Learning Environments An Analysis Of The Perceived Impact Of Single-sex Classrooms In South Carolina

Educating male and female students in separate learning environments has been a common practice since the early inception of educational programs. However, this practice was heavily debated in the 20th century for its perceived inequalities in the treatment of students based on their gender resulting in today's coeducational classroom structure. Recently, interest in single-sex classrooms returned as an alternative for educating America's youth. Political support for this educational approach was evident in modifications to the 2006, No Child Left Behind Act which in turn led to increased availability and popularity of this educational venue. Despite same-sex classrooms' acceptance, research results on the effectiveness of single-sex classrooms have been mixed contributing to inconclusive findings that do little to support the use of public funds for such initiatives. The purpose of this research is the analysis of data to clarify the outcomes of single-sex classroom environments and their effects on students. South Carolina Department of Education survey results (2008) were examined using ANOVA analysis to identify differences in the group means between the male and female students and regression analysis was used to test the influence of the control (independent) variables on the dependent variables. The statistical analysis did not find significant differences in how the single-sex classrooms impact males and females in terms of academic achievement. However, motivation and self-esteem were found to have significant differences for male and female students in single-sex classrooms. Notably the analysis results iv indicated 4th, 5th, and 6th grade levels demonstrated the greatest disparities between the genders. Regression results highlighted the inability of the independent (control) variables of grade level, gender, or ethnicity in explaining the variation in any of the dependent variables, failing to confirm the model used in analysis. Likewise, grade level was generally found to have a greater impact than gender or ethnicity on the academic achievement, motivation and selfesteem dependent variables. It is recommended that additional research be conducted to further consider these variables and their effects on students utilizing a wider range of control (independent) variables.
