Trestný čin nebezpečného pronásledování podle § 354 trestního zákoníku / The crime of dangerous stalking under Section 354 of the Criminal Code

This thesis deals with the crime of dangerous stalking under s. 354 of the Criminal Code and also with the phenomenon called stalking, which is directly linked with the merits. In introduction of the thesis is described a relationships between the concepts - crime of dangerous stalking and stalking. The thesis is composed of three large chapters - first chapter is focused on stalking from psychological viewpoint, another chapter deals with a legislation of the crime of dangerous stalking in the Czech republic and in the last part are outlined the problematic aspects related to this crime and reasoning de lege ferenda. First chapter starts with a short description of history of stalking and includes mentioning of the first cases for introduction the antistalking legislation. Than a significant part of thesis deals with perpetrators of stalking, especially with the types of perpetrators, which were been created over the whole period of time and characteristics for each type of perpetrator. Another key part deals with victims of stalking from the psychological view and also from legal context of Victims of Crime Act, and also from context of Criminal Procedure Code from the viewpoint of the rights of the victims. Invested or Invasive?: Applying the Investment Model to Understanding Obsessive Relational Intrusion

The present study applied the Investment Model (IM) to predict obsessive relational intrusion (ORI). Participants (n=685) were randomly assigned to read vignettes about a hypothetical relationship termination that manipulated 1) type of rejection, 2) level of investment, and 3) quality of alternatives. Next, participants were asked to report how likely it was that they would engage in pursuit (e.g., leaving gifts and calling) and aggressive (e.g., threatening behaviors) ORI. Contrary to predictions, results indicate that although level of investment affected one’s likelihood of engaging in ORI, quality of alternatives did not. Further, it was expected that a more explicit rejection would lead to greater ORI; however, I found that no rejection lead to more pursuit ORI than either internal or external rejection conditions.

Crime of Stalking and Protection of its Victims This diploma thesis focuses on the issue of stalking, or more precisely on its individual aspects and its legislation in the Czech Republic. As for the structure of this thesis, it is divided into five main sections. The first section deals with stalking in general. The individual chapters are devoted to the definition of this term, the historical development of this phenomenon and common forms of stalking, including two specific types of stalking, which are cyberstalking and stalking in the workplace. The second section deals with the characteristics of stalkers and their motives. The third section concerns the victims of stalking. The individual chapters successively analyse the typologies of victims, the impact of stalking on victims, including post-traumatic stress disorder, as well as the main strategies oriented towards helping the victims of stalking and, finally, the issue of false victims. The third section and the fourth one are the most comprehensive of all and together they constitute the core of the thesis. The fourth section focuses on anti-stalking legislation of the Czech Republic, whereas the most comprehensive chapter is devoted to the crime of stalking. Examining Intimate Partner Stalking And Use Of Technology In Stalking Victimization

This research was designed to expand the empirical knowledge and understanding of stalking victimization by examining both intimate and nonintimate stalking and the use of technology to stalk. To accomplish this, the current research examined differences among intimate and nonintimate stalking, stalking types (cyberstalking, stalking with technology, and traditional stalking), and stalking types by the victim-offender relationship. Specifically, this research examined demographic differences, differences in severity, seriousness, victim reactions and responses to and effects of stalking. Findings revealed that overall intimate partner stalking victims experienced greater levels of seriousness and severity of stalking, and expressed more fear than nonintimate partner stalking victims. Additionally, they were more likely to have engaged in self-protective or help-seeking actions. With regard to stalking type, victims who were cyberstalked and stalked with technology experienced a greater variety of stalking behaviors, were more likely to define the behaviors as stalking, and took more actions to protect themselves than victims who were traditionally stalked. Moreover, those who were stalked with technology experienced a greater severity of stalking. And when examining differences among stalking types by the victim-offender relationship, intimate partner stalking victims were still more likely than nonintimate partner stalking victims to have experienced a greater severity of stalking. This research contributed to existing research by being the first to examine cyberstalking and stalking with technology with a national dataset, and adding to the knowledge of differences between intimate and nonintimate partner stalking. Implications for policy and for research are discussed.

Establishing the Reliability and Validity of the Stalking Myth Scale - Revised

Misconceptions about intimate aggression have been found to have serious consequences (Kamphius et al., 2005; Robinson, 2005). These beliefs serve to minimize the crime and blame the victim which can cause individuals to not take the crime seriously (Kamphius, et al., 2005; Sinclair, in press). Initial work combined and updated Sinclair's (2010) Stalking Myths Scale and McKeon's unpublished Stalking Attitudes Questionnaire, but further psychometric analysis is needed (Lyndon, Sinclair, & Martin, 2011). I surveyed 1,200 undergraduates using the Stalking Myth Scale –Revised (SMS – R), a modified version of the Obsessive Relational Intrusion Inventory – Short Form (ORI - SF; Cupach & Spitzberg, 2004), and three intimate partner aggression myth scales. My findings replicated the factor structure of the previous pilot and attitudes regarding stalking were found to be predictors of the likelihood to engage in, the perceived normativity of, and the perceived motivation behind stalking.

Stalking is generally understood as unwanted or unsolicited persistent and continuous following, pursuing, contacting, spying, harassing, threatening the victim, and causing fear and apprehension. Unfortunately, given the seriousness of cyberstalking and its severe and traumatic impacts on the victims, the existence of the law and any legal protection for victims remains elusive and vague in the Malaysian legal landscape for decades until August this year.

Resumé v anglickém jazyce This thesis is focused on the crime of stalking under s. 354 of the Criminal Code no. 40/2009 Coll. This crime affects a phenomenon referred to as stalking in terms of criminal law. The aim of the thesis is to provide a comprehensive view on the issue of stalking in a broader context than just the one of criminal justice, and to compare the crime of stalking under the Czech criminal law with selected foreign laws. The thesis is divided into two major parts. The first part consisting of the first four chapters characterises the above-mentioned phenomenon mainly from the view of criminology and forensic psychology. The second part attempts to analyse the crime of stalking itself. The first chapter deals with the definition of stalking while evaluating and refuting the myths associated to this phenomenon. Then a brief history of the term is mentioned, followed by the descriptions of different types of stalking conduct highlighting mainly the ex-partner stalking, cyberstalking and stalking of celebrities.
