Builiding Savings - legal and economic issues Supervision enforcement in the area of building savings Abstract The aim of the thesis was to summarize supervisory procedures in building savings with a special focus on the scope of the Ministry of Finance of the Czech Republic. The first part of the thesis defines basic concepts, the relevant basic theoretical issues of supervisory procedures in the field of financial law and the purpose of general terms and conditions are also mentioned. The third and fourth parts of the work are crucial. The third part focuses on the competence of the Ministry of Finance in the field of building savings. Separate chapters are devoted to the approval of the general terms and conditions of building savings banks, the implementation of the agenda related to the payment and return of the state support of building savings, as well as the actual exercise of state supervision of compliance with the state support conditions laid down by the Building Savings Act. Special attention is paid to the information system, the operation and administration of which is essential for the performance of the Ministry of Finance's competence in building savings. В первой главе определена роль малого предпринимательства в экономическом развитии и рассмотрены особенности системы государственного регулирования и поддержки малого предпринимательства. Во второй главе произведен анализ функционирования малого предпринимательства в РФ и Свердловской области, определено место малого предпринимательства в экономике Свердловской области, выявлены проблемы малых предприятий в регионе. Третья глава исследованы механизмы государственного регулирования и поддержки малого предпринимательства в региональной экономике, сформулированы основные положения, выносимые на защиту, дан ряд методических рекомендаций по совершенствованию системы государственного регулирования и поддержки малого бизнеса, предложен интегральный критерий эффективности государственной поддержки малого предпринимательства, обоснована научная новизна и практическая значимость. / The master's thesis is devoted to the directions of improving the mechanisms of state stimulation of the development of small business in the regional economy. The final qualifying work consists of an introduction, three chapters, a conclusion, a list of sources and applications. The first chapter defines the role of small business in economic development and examines the features of the system of state regulation and support of small business. The second chapter analyzes the functioning of small business in the Russian Federation and the Sverdlovsk region, defines the place of small business in the economy of the Sverdlovsk region, identifies the problems of small businesses in the region. The third chapter explores the mechanisms of state regulation and support of small business in the regional economy, formulates the main provisions for the defense, gives a number of methodological recommendations for improving the system of state regulation and support of small business, proposes an integral criterion for the effectiveness of state support for small business, substantiates scientific novelty and practical significance.

State responsibility for support of armed groups in the commission of mass atrocities

Since 1945, there has been a proliferation of armed groups in conflict theatres across the globe. Although these groups exist outside of the regular forces of States, they are in most instances supported and controlled by States. Despite this, the complicit support of States in the commission of international crimes by armed groups is not recognised under international law and the tests of control through which the conduct of individuals could be attributed to States are almost impossible to meet. This allows States to maintain compelling roles in international crimes committed by armed groups with impunity. Despite this, the role played by States in modern international conflict has received only intermittent attention in the literature. This thesis seeks to address this disparity by addressing the critical role of State support of armed groups in the commission of international crimes by challenging the existing tests of attribution of conduct to States under the present rules of international responsibility. Therefore this thesis asks whether there can be variation to the current tests for attribution of conduct of individuals who are members of non-State armed groups to States which provide support to them, by approaching the interpretation of "control" in a purposive, less literal manner. It argues this by analysing the limitations of the current law through selected case studies. It further examines alternative approaches in the fields of international human rights law and international criminal law, again through selected case studies with a view to determining whether they can assist in crafting more purposive approaches towards the determination of State control over armed groups. This will augment the current corpus of literature by suggesting improvements that can, hopefully, pass into the lex lata and stymie continued State impunity in this area.

Legal Regulation of Activities of the Export Guarantee and Insurance Corporation The subject of this thesis is an analysis of regulatory instruments which affect the working of the Export Guarantee and Insurance Corporation (abbreviated as EGAP in Czech). While the main point of focus are the legal instruments, non-legal tools needed to be considered as well for a full understanding of the topic. The first chapter covers the historical development of the corporation and its importance for the economy of the Czech Republic. Other institutions supporting export are also mentioned in short - the Czech Export Bank and the CzechTrade agency. In the second chapter I analyse relevant legislation of the Czech Republic and the European Union and international agreements as well. The next chapter consists of a description of insurance products in EGAP portfolio and their comparison. In the fourth chapter, I first outline the export policy of the Czech government and I follow to explain the means of financing the corporation and the capital requirements that are put on it. This diploma thesis is centred on the importance of State support for exports. It defines the international rules which must be respected by State export policies, and deals with the basic principles and activities of institutions which together form the integrated system of State support for exports in the Czech Republic. Within this overall context, the practical component of this diploma thesis examines the work of the Czech State Export Credit Agency (EGAP), and describes their newly created Export Promotion Effectiveness methodology (EPE) which aims to evaluate the economic risk-benefit of a each business case. It goes on to describe the phases and steps of the underwriting process which every business case must go through. The underwriting process is illustrated with the help of a process map, and defines points at which the EPE model can be used. An important part of this diploma thesis represents a case study which demonstrates the application of the EPE model to a real business case.

The aim of the diploma thesis is to propose and evaluate the political and credit risks management associated with the export of medical equipment to countries outside the European Union, including the short and long term analysis of financing options. Alternative solutions are based on well-known approaches of state organizations, which are experienced with the issue and commercial solutions offered by London Market in cooperation with the London insurance market. The main output is comparison of the proposed solutions and evaluation of the optimal solution according to the established criteria by Czech exporter.
