The subject of this study was the effect of surrounding vegetation on the species composition of the dumps after black coal mining. The species data from dumps and their surroundings up to 100m were recorded during the vegetation seasons 2009-2011 and consequently analysed using ordination methods (DCA and CCA) and univariate statistics. The data on land cover and percent of the old forests (present in the surroundings in years 1836 -1852 up to 100m and 1km from the margins of the dumps) appeared to have significant effect on the present species composition of vegetation on the dumps.

Le monde rural est un secteur clé de notre économie. L'exploitation agricole n'est pas une entreprise comme les autres. La loi protège cette activité dont la transmission peut se révéler délicate. L'entreprise agricole française demeure bien souvent de type familial, même si les techniques les plus modernes y sont employées. Les problèmes humains y sont donc particulièrement importants, notamment dans le cadre de la transmission. Dans la pratique, de nombreuses questions doivent être résolues. Qui prendra la suite ? Un membre de la famille ? Un étranger ? Comment évaluer ? Que faut-il conserver ? Quels impôts devront être payés ? Combien de temps s'y prendre à l'avance ? Quelle personne consulter sur ces sujets très importants pour la survie de l'exploitation, la retraite de l'exploitant et la bonne gestion du patrimoine familial ? Les différents Conseils tels que le notaire sont des accompagnateurs dans cette opération, parfois longue et complexe. L’objectif de cette thèse est de traiter la transmission de l’entreprise agricole et les outils qui lui sont offerts à cette fin en examinant les intérêts d’une préparation en amont de la transmission avec la création d'une structure sociétaire par rapport à la transmission d'une entreprise individuelle (choix de la forme la plus adaptée, modalités de la mise en société et moyens d'adaptation aux objectifs particuliers) et d’observer qu'il peut également s'avérer intéressant d'organiser l'entreprise déjà exploitée sous forme de société, pour transformer sa forme juridique ou restructurer les activités et le patrimoine immobilier, ou adapter les statuts.Ces développements permettront de constater que l’entreprise agricole a un statut juridique en devenir. En effet, d’une façon générale, le Droit Français ne reconnaît pas l'entreprise agricole comme universum jus, sauf à cette entreprise à emprunter la forme d'une société impliquant la naissance d'une personne morale.Des étapes sont nécessaires à la reconnaissance juridique de l’entreprise agricole. Sur un plan juridique, et, jusqu'à 2006, la loi n'utilisait pas le terme d'"entreprise", mais celui d'"exploitation" (mot ambigu désignant à la fois l'activité agricole, et l'unité de production qui la réalise).Or s’il est ardu de définir l’Entreprise agricole, c’est justement cette absence de définition juridique qui rend difficile sa transmission.Le statut du fermage a été un obstacle préexistant à la loi d’orientation agricole du 5 janvier 2006, réforme pouvant paraître incomplète malgré les atouts de nouveaux outils juridiques tels que le fonds agricole (institution comparable au fonds de commerce tant du point de vue de la composition et des fonctions, que de la constitution , de la transmission et du nantissement) et le bail cessible, condition inéluctable du fonds agricole…des remèdes étant ainsi sujets à recherches…l’idéal étant d’aboutir, à terme, à une sorte de « Bien unique» à transmettre / Rural world is a key sector of our economy. The various advises such as the solicitor are guides in this operation, sometimes long and complex.The objective of this thesis is to handle the transmission of the agricultural company and the tools which are offered to him to this goal, by examining the interests of a preparation upstream to the transmission with the creation of a structure member compared with the transmission of a sole proprietorship (choice of the most adapted shape, the modalities of the putting in company and ways of adaptation to the particular objectives) and to observe that he can also turn out interesting to organize the company already exploited in the form of company, to transform his legal shape or restructure the activities and the real estate property, or adapt the statuses.These developments will allow to notice that the agricultural company has a legal status in future.Indeed, generally speaking the French law does not recognize the agricultural company universum juice, except for this company to borrow the shape of a society implying the birth of a legal entity.Stages are necessary for the legal recognition of the agricultural company. On a legal plan, and, until 2006, the law did not use the term of "company", but that of "exploitation"("operation") (ambiguous word indicating at the same time the agricultural activity, and the production unit which realizes it).Now if it is difficult to define the agricultural Company, it is exactly this absence of legal definition that makes difficult its transmission.The status of the farm rent was an obstacle preexisting before the agricultural guidance law of January 5th, 2006, reform which can seem incomplete in spite of the new legal tools such as the agricultural fund (institution comparable to the business both from the point of view of the composition and the functions, and of the constitution, of the transmission and of the pledge) and the transferable lease, the inevitable condition of the agricultural fund… Remedies being so subject to researches, the ideal being to succeed, eventually later, in a kind of "unique property" to transmit

The life and political significance of Henry Fitzroy, Duke of Richmond, 1525-1536

This thesis aims to examine Richmond's life in the context of his role as a magnate, a courtier, and the king's only son. As a much neglected subject this includes a good deal of biographical material, in order to present the duke within the context in which he lived. This also allows a re-assessment of his part in the succession crisis, with particular reference to the significance of his elevation in 1525, and the speculation regarding the king's intentions, as represented in the Succession Act of 1536. An examination of his responsibilities, not least as Lord Lieutenant in the north, of Ireland and as Lord Admiral, queries how far his extreme youth and his illegitimacy inhibited or facilitated the role Henry VIII wished him to fulfil. In tandem with this, a special study of the duke as a landlord looks at the relationship between the authority bestowed upon Richmond and the actual freedom of action allowed to the child. A view of his political importance, in matters such as marriage alliances and diplomacy, is considered alongside an appraisal of the personal standing of the duke, both in England and abroad. In order to provide a complete picture of Richmond's circumstances, there is also an account of the fortunes of his maternal relations, the Blounts of Kinlet, tracing their wealth and descent, and in particular those connections and alliances which assisted their daughter's acceptance at court. An analysis of Elizabeth Blount's relationship with Henry VIII leads into a consideration of how her royal liaison affected her life. In discussing the overall legacy left by Richmond's demise, the right and title of his widow, Mary Richmond, to her agreed jointure, and her subsequent fortunes, are weighed against the priorities of the king.

The subjects of this study were the plant succession of the regrassed and spontaneously revegetated fields in the Bohemian Forest foothills and the effect of grass cutting management on vegetation changes in time and some of the important soil microbial characteristics. The main aims of this study were to assess i) the phytocoenose differences between the re-grassed and spontaneously revegetated fields, ii) the effect of abandoned field surroundings on the field grassing, iii) the possible correlations between the successional age of fields and characteristics of meadow plant species. The data for the landscape view were collected during the season 2008 and were analyzed by ordination methods (DCA, CCA) and by the ANCOVA. The second data for the detailed view were collected during three seasons (2006-2008) from ten experimental squares and were analyzed by the ordination method (RDA) and the methods Repeated Measures ANOVA and One Way ANOVA. The significant difference between regrassed and naturally revegetated fields was not found. The effect of surrounding was important, while most of the plant species (86% in average) occurring in the surroundings were also found on the studied fields. The field age was positively correlated with particular characteristics of presented meadow plant species. Although the effect of grass cutting on the phytocoenose was not significant, the effect on the microbial biomas was significant in the mineralization rate of soil organic mater.

The impact of CEO turnover on the share price performance of South African listed companies

International research into the impact of CEO turnover on organisational share price performance has yielded inconsistent results. This research aims to study the impact of CEO turnover on the South African environment, and in particular on South African listed companies. The study is conducted looking at both the impact at the date of the announcement of the CEO change, and examines the impact of forced versus voluntary turnover, as well as internal versus external CEO replacement. There were 74 turnover events between 2001 and 2003, which were included in the study at announcement date. Only 28 of these resulted in the CEO remaining in office for a period of at least three years, and this smaller sample was used to examine the effect of CEO turnover over the three years after appointment. Event study methodology was used in the research. The research observed a statistically significant negative impact on share prices at the date of announcement of CEO turnover, but this was negated by statistically significant positive returns when looking at the day prior to the announcement. No statistically significant results were observed for internal versus external CEO replacement. Forced CEO turnover had a negative effect on share price performance when compare to voluntary turnover, but this was not statistically significant. No significant results were observed for the three years post the appointment of the new CEO.
