The present interview makes a recount of some relevant aspects about the New Labour Procedural Law and his main contribution on resolution of labor conflicts. Also, gives the interviewed opinion about two relevant current events: the binding precedent Huatuco and the accomplishments of SUNAFIL, about one year of its lifespan. / La presente entrevista busca hacer un recuento de algunos aspectos relevantes de la Nueva Ley Procesal del Trabajo y su aporte en la resolución de conflictos del ámbito laboral. Además, el entrevistado expresa su opinión respecto a dos temas de actualidad: el precedente vinculante Huatuco Huatuco y los logros de la Superintendencia Nacional de Fiscalización Laboral (SUNAFIL), a puertas de un año de su entrada en funcionamiento.

La creación de la superintendencia Nacional de Fiscalización Laboral constituirá un elemento determinante dentro del sistema de inspección laboral en el Perú, siendo que una de las funciones primordiales del estado es adoptar mecanismos sólidos de protección de los derechos laborales. El presente texto tiene en primer lugar, un recordatorio de las nociones generales y características del sistema de inspección de trabajo previo a la creación de la SUNAFIL, así como también, la forma en la que se han venido aplicando. Posteriormente, se detallan las principales novedades que trae consigo la Ley 29981, ley que crea la SUNAFIL, para poder analizar a partir de esto, si el nuevo sistema propuesto resulta idóneo para un contexto como el nuestro en donde prima la informalidad. Finalmente, esbozaremos algunas propuestas que sirven como camino para alcanzar un sistema de inspección adecuado, toda vez que una entidad no puede abarcar todo y, mucho menos, solucionar la generalidad de problemas existentes. The creation of the National superintendency of Labor inspection will become a key element in Peru’s labor inspection system, being that one of the primary functions of the state is to adopt strong mechanisms for the protection of labor rights. This article is, in first place, a reminder of the general concepts and characteristics of the labor inspection system before the creation of the suNAFiL, as well as the way it has been applied. Afterwards, it explains the main novelties that Law 29981, the law that creates SUNAFIL, brings. From this explanation, we will analyze if the proposed new system is suitable for a context like ours, where informality prevails. Finally, we outline some proposals that serve as a way to reach an adequate inspection system, since an entity cannot cover everything and, even less, solve the generality of existing problems.
