Silent partnership - rights and obligations of the contracting parties ABSTRACT This thesis deals with a silent partnership while focusing on the rights and obligations of the contracting parties. It is divided into three chapters. In the first chapter, the author at first presents the general characteristics of the silent partnership agreement, including a brief historical excursion. Great scope is given to comparing a silent partnership and a partnership. The conclusion that a silent partnership is a special kind (lex specialis) of partnership is reflected in the following chapters. Next two chapters describe the mutual rights and obligations of the contracting parties; the second chapter deals with the rights and obligations of the silent partner and the third chapter deals with the rights and obligations of the entrepreneur. These are the most significant chapters of the thesis, in which the individual rights and obligations of the contracting parties are analysed while the author identifies some problematic aspects that can lead to interpretative and application difficulties and then offers possible solutions. Esta dissertação visa investigar a agência da câmera na criação fotográfica e a emergência de uma estética da precariedade nos dias atuais, tendo como estudo de caso o trabalho do fotógrafo checo Miroslav Tichý (1926-2011). A partir da descrição e classificação das câmeras de baixa fidelidade, buscou-se compreender como elas teriam contribuído para a subversão dos cânones da fotografia tradicional e para a consolidação de uma estética permeada por falhas denominada como estética da precariedade. As fotografias de Tichý, com seu aspecto ruidoso e deteriorado, decorrente de seu processo fotográfico peculiar, mostraram-se particularmente propícias para evidenciar, de forma concreta, a agência de elementos humanos e não-humanos na configuração dessa estética da precariedade. Além disso, será investigado como a obra de Miroslav Tichý e a estética da precariedade passaram pelo processo de artificação e foram alçados ao estatuto de arte por diversas instâncias de legitimação, como curadores e historiadores da arte. A pesquisa reflete, ainda, sobre a a apropriação, pasteurização e mercantilização da estética da precariedade por parte da indústria da fotografia digital, por meio de aplicativos e softwares voltados para a edição de imagens. Por fim, cabe ressaltar a intenção de abordar esses fenômenos a partir de um viés crítico, buscando identificar suas contradições e seus desdobramentos no campo da cultura contemporânea. / This dissertation aims to investigate the agency of the camera in the photographic creation and the emergence of an aesthetics of precariousness. The Czech photographer Miroslav Tichý (1926-2011) will be used as a case study. Beginning with the description and classification of \"low fidelity\" cameras, we sought to understand how they contributed to the subversion of the canons of traditional photography and to the consolidation of an aesthetic permeated by failures called the \"aesthetics of precariousness\". The photographs by Tichý, with their noisy and deteriorated appearance due to his peculiar photographic process, were particularly propitious to concretely evidence the agency of human and nonhuman elements in the configuration of this aesthetic of precariousness. In addition, it will be investigated how the work of Miroslav Tichý and the aesthetics of precariousness went through the process of artification and were elevated to the status of art by various instances of legitimation, as curators and art historians. This research also reflects about the appropriation, pasteurization and mercantilization of the aesthetics of precariousness by the digital photography industry, through image editing applications and software. Finally, it is worth emphasizing the intention to approach these phenomena from a critical point of view, seeking to identify their contradictions and their development in the field of contemporary culture.

It also describes a relationship between literature and musical text. The result is compacted work about their production from 60s till today.

The sedimentation of historical and social content objectified in the form of artistic objects is, therefore, the material adopted to explore philosophically the specters of the individual's perception, which manifest themselves in reason, emotion, senses, memory and consciousness. In order to examine these propositions, this research focuses on the prospect of Miroslav Tichý (1926 - 2011), plastic artist and photographer from the Czech Republic. Miroslav Tichý wandered around the streets of the small town where he lived, collecting some discarded objects to manufacture his rudimentary cameras that allowed him to capture a peculiar perspective of a modernity facet. The research elements were presented in four dimensions: material, immaterial, aesthetic and dramatic. This formal organization, which contemplates the theoretical concepts, the method and the analysis of the object of study, had the objective of reproducing the logic of the antagonistic spheres of society, which interact at the same time as they collide. The theoretical reference adopted for this study is the Critical theory of society, considering mainly the concepts of experience and its impoverishment, the individual and pseudo-individuation, developed by Walter Benjamin, Theodor W. Adorno, Max Horkheimer and Herbert Marcuse. The information extracted from the photographs of Miroslav Tichý were organized in four categories of analysis: city, people, bodies and objects. In association with the theoretical perspective presented, the data obtained allowed to explore the experience of the individual in the urban environment, the exaltation and depreciation of the woman, the decrepitude of corporeal matter and the new and more effective forms of repression, indicative elements of the hazy character of the individual in modernity. The themes developed focused on the movement of antagonistic social forces that, while promoting art for emancipation, reinforce the ideological prisms of domination proper of capitalism in the process of transforming culture into merchandise. The reflections raised allowed to criticize the way the social structure expresses itself in the objects of culture and determines the relationship between subject and object / Esta pesquisa toma a arte como fonte empírica para analisar a experiência do indivíduo na modernidade. A sedimentação do conteúdo histórico e social objetivado na forma dos objetos artísticos é, portanto, o material adotado para explorar filosoficamente os espectros da percepção do indivíduo, que se manifestam na razão, emoção, sentidos, memória e consciência. A fim de examinar essas proposições, analisou-se a perspectiva apresentada na obra de Miroslav Tichý. Miroslav Tichý (1926 – 2011) foi artista plástico e fotógrafo oriundo da República Tcheca. Miroslav Tichý vagava pelas ruas da pequena cidade onde morava, recolhendo alguns objetos descartados para fabricar artesanalmente máquinas fotográficas rudimentares que lhe permitiram captar sob uma ótica peculiar uma faceta da modernidade. Os elementos que compõem o conjunto da pesquisa foram apresentados em quatro dimensões: material, imaterial, estética e dramática. Esta organização formal, que contempla os conceitos teóricos tratados, o método e a análise do objeto de estudo, teve como objetivo reproduzir a lógica das esferas antagônicas da sociedade, que interagem ao mesmo tempo que se chocam. O referencial teórico adotado é a Teoria crítica da sociedade, utilizando-se, principalmente, os conceitos de experiência e seu empobrecimento, indivíduo e pseudoindividuação, desenvolvidos por Walter Benjamin, Theodor W. Adorno, Max Horkheimer e Herbert Marcuse. As informações extraídas das fotografias de Miroslav Tichý foram dispostas em quatro categorias de análise confeccionadas à posteriori: cidade, pessoas, corpos e objetos. Em articulação com a perspectiva teórica, os dados obtidos permitiram explorar a experiência do indivíduo no meio urbano, o enaltecimento e depreciação da mulher, a decrepitude da matéria corpórea e as novas e mais eficazes formas de repressão, elementos indicativos do caráter obnubilado do indivíduo na modernidade. Os temas desenvolvidos focalizaram o movimento de forças sociais antagônicas que, ao mesmo tempo que promovem a arte com vistas à emancipação, reforçam os prismas ideológicos da dominação próprias ao capitalismo no processo de transformação da cultura em mercadoria. Background: Cerebral complications of coronary catheterizations are transient ischemic attack (TIA) and stroke. Silent stroke (SCI) does not cause acute neurological dysfunction. It might cause many disorders including dementia. Sonolysis is therapeutic method. Sonolysis should be the method for reducing the risk of symptomatic and asymptomatic brain ischemic lesions in patients undergoing elective coronary angioplasty or stenting. Aims: To analyse patients with cardiac disease indicated for elective coronary catheterization: 1) Assess the incidence of acute/subacute SCI on brain magnetic resonance (MR) imaging; 2) Investigate factors influencing the frequency and type of microembolic signals (MES) detected using transcranial Doppler (TCD) in patients undergoing elective coronary intervention, and to correlate the frequency and type of MES with detection of new brain ischemic lesions using MR. Examine changes in cognitive function at 30 days post procedure in relation to pretreatment scores; 3) Test the clinical efficacy and safety of perioperative sonolysis in patients undergoing elective coronary catheterization. The diploma thesis focuses on the employment of persons with hearing impairments. In the theoretical part, the introductory chapters pay attention to the terminological definition from the perspective of surdopaedia, classification of hearing impairments and the possibility of communication of persons with hearing impairments. Furthermore, the theoretical part is devoted to approaches to education and education systems for persons with hearing impairments. The thesis also describes the situation of employing persons with hearing impairment not only in the Czech Republic, but also in Germany, Slovakia and Great Britain. In the practical part, the situation of work of persons with hearing impairments is analyzed by means of a research survey, which has the character of mixed research. A structured interview for clients of the organization Silent world and a semi-structured questionnaire were used for the research investigation. The main aim of this thesis is to analyze the situation of work of persons with hearing impairment and possibilities of work of persons with hearing impairments in the Czech Republic, this goal is achieved by research investigation. This diploma thesis, Didactic exploitation of the francophonie in the Oceania, resulted from insufficient outcomes of a questionnaire focusing on the francophonie and francophone facts of the overseas territories located in the Pacific Ocean. The diploma thesis consists of three main parts which are subsequently divided into subchapters. The first part explains the choice, focus and targets of the questionnaire and provides its evaluation as well. The theoretical part aims at clarifying and defining receptive and productive competence from a didactic viewpoint with regard to language level A2 and B1, given by CEFRL. The practical part follows with a description of created worksheets always containing exercises that aim firstly at receptive competence - listening, and then at productive competence - speaking. Texts together with exercises focus mainly on culture and tradition, then on language situation and language oddities of the following French overseas territories in the Pacific Ocean: French Polynésia, Wallis and Futuna, Vanuatu and New Caledonia. The subject of this thesis is Slovak mime theatre. It begins with the connections to the period of its foundation and introduces topic about founder of Slovak mime theatre - Milan Sládek. The next part of the thesis focuses on Slovak amateur theatre artists and their work at the time when professional mime theatre didn't exist in Slovakia. These artists used to experiment with different kinds of theatre technics, including mime theatre. Last part is based on analysis work and performances of the modern authors - Miroslav Kasprzyk, Štefan Capko, Juraj Benčík, Tomáš Kasprzyk, Valéria Daňhová, Barbora Debnárová, Pavol Seriš and modern theatre companies - Puppet Thetare Žilina, Debris Company, Teatro Tatro and Theatre Silent Sparks. It describes how the character of Slovak mime theatre has changed within more than fifty years of existence.
