Způsoby ukončení závazků v podnikatelských vztazích / Methods of obligations termination in business relationships

The goal of the Thesis is to analyze the issue that is related to the extinction of the rights and obligations of business relations. Trading obligations are very specific group of legal relations. Without them it is imposible to imagine a faultless performance and successful business. The author in this thesis attempts to address all relevant aspects of the topic. To achieve the above objectives, the author intends to use a particular method of interpretation of legal norms. This method will be complemented by an authentic interpretation of legal norms, doctrinal interpretation, legal interpretation or the relevant case law. Analysis of these areas can conclude that there is a large area in terms of legislation and legal theory, systematic non-uniform. One of the main complexities of contract law, the author sees in the dualism legislation. From the available case law of the Supreme Court or Superior Courts may conclude that in most practical application of legal problems arose on the fulfillment of commitments and cancellation. These are the most frequent reasons for termination of the legal obligations. Another finding is the inconsistency of terminology and the Civil Commercial Code.

The termination of membership in a Limited Liability Company and Joint Stock Company - abstract The purpose of this thesis is to summarize and analyze selected possibilities of termination of membership in a Limited Liability Company and Joint Stock Company together with related consequences of such termination. I have aimed especially to the actual legal regulation contained mostly in the Czech Commercial Code however taking into consideration the decision making practice of the Czech Supreme Court as well. Within the writing of this thesis I have also reviewed upcoming new regulation contained within the Act on Business Corporation. The thesis is composed of foreword, three chapters and conclusion, where the second and third are most important ones as they deal with the two most usual kinds of business corporation in the Czech Republic - Limited Liability Company and Joint Stock Company. 1 ABSTRACT Implications of Termination of International Investment Agreements The international investment arbitration proceedings under the Washington Convention on the Settlement of Investment Disputes between States and Nationals of Other States ("ICSID arbitration proceedings" and "ICSID Convention") represents predominantly used mechanism of Investor-state dispute settlement. The adjudicative system of investment arbitration resolving disputes concerning breaches of foreign investment protection within the territory of the host states granted by bilateral investment treaties ("BITs") faces increasing criticism. The reluctance to abide by the binding awards of the arbitral tribunals on behalf of the host states and evolving displeasure towards the ICSID arbitration system triggered the wave of terminations of international investment agreements initiated by the states of the Latin America. Termination of international investment agreements significantly disturbs the procedural protection of foreign investments and ultimately deprives the foreign investors of the right to have their claims against the host states heard in designated arbitration forum. Methods: A survey sent to 42 judo trainers and 21 children helped to find out the reasons why children terminate their sport activity at competitions at the age 14 - 18. Results: We have found out that the main reasons are feeling of anxiety before the match, lack of time and demanding studies at high school and university out of the hometown. This thesis deals with design, development and production of a mobile application to support teaching. Android mobile application ”Virtual economic guide” is available through Google Play store. This application is not only for students of PEF MENDELU. Interactive materials presented in this applcation mainly concerns the Microeconomics 1 course. Some parts includes materials used in Microeconomics 2 and Macroeconomics 1 and 2. This application is developed in Java using Firebase cloud platform for authentification, autorisation and database services. Application incorporates gamification for better involvement of target group. Source code is accessible via GitHub platform as an open-source project.

Building savings - legal and economical issues The aim of the thesis is the analysis of selected problematic issues - crucial to the functioning of building savings and also in relation to consumers and protection of its rights. The thesis is composed of six chapters which are dealing with legislation of building savings, especially with amendment in historical development with inheritance, with deposits of minors and valid way of terminating the contract of minors, with the bank charges in the context of preparatory transposition of 2014/17/ EU Directives on housing loans, and compares the economic aspects of both component of building savings with competitive products in the financial market. In the thesis I use the method of analysis, synthesis and induction in chapters in which I work with jurisprudence and in which I advocate a position of building savings in the banking market. In anticipation of the upcoming law on housing loans I require to include information obligation into the proposed legislation with emphasis not only on formal form but the content of communication. Drop out for clients with addiction has an adverse effect on their abstinence - the probability of relapse is very high (Kalina, 2003). By contrast, treatment completion is associated with abstinence, lower criminal activity, fewer relapses and a higher employment rate (Brorson et al., 2013). For effective addiction treatment is crucial to minimize the number of drop outs. Risk factors appear not only on the client side, but also on the side of the service. The study focused on clients who planned to drop out, but at last they decided to stay. Anamnestic data and interviews with clients helped to identify common client traits and answer the questions about the client thinking process during the crisis, what they emphasize, how they evaluate their decision not to drop out and what motivational influences they identify. Frequent common traits of clients who overcame drop out tendencies were a higher age (90 %), criminal record (74 %), contact with psychiatry (84 %) and repeated addiction treatment (74 %). Interpersonal conflicts with staff and clients (50 %) and craving (22 %) were the most frequent reasons to drop out. Nearly 2/3 of clients appreciated the improved mental and physical health.
