TruMet: An approach towards computing trust in multi-agent environment.

The growing popularity of multi-agent based approaches towards the formation and operation of virtual organizations (VO) present over the Internet, offer both opportunities and risks. One of the risks involved in such community is in the identification of trustworthy agent partners for transaction. In this paper we aim to describe our trust model which would contribute in measuring trust in the interacting agents. Named as TruMet, the trust metric model works on the basis of the parameters that we have identified as relevant to the features of the community. The model primarily analyses trust value on the basis of the agent¿s reputation, as provided by the agent itself, and the agent¿s aggregate rating as provided by the witness agents. The final computation of the trust value is given by a weighted average of these two components. While computing the aggregate rating, a weight based method has been adopted to discount the contribution of possibly un-fair ratings by the witness agents.

The main premise of this treatise is to discuss the Mauritian Law of Procedural Fairness within the context of Dismissal for Misconduct: A comparative study with the South African Doctrine of unfair Labour Practice. It analyses in detail the types of misconduct that eventually leads to the dismissal of an employee. The dismissal has not only to be substantively fair but also procedurally fair. To support the views expressed in the research, reference has been made to labour law cases decided mainly in Mauritius and South Africa. There are, however, references to other jurisdictions such as India, England, Australia, Namibia. The major constraint that the researcher encountered was the unavailability of decided cases referred from the Industrial Court of Mauritius. Most of the cases referred to in the Mauritian context are the Supreme Court decisions on dismissals due to misconduct. Thus for lack of relevant cases in Mauritius, there is a heavy reliance on cases decided in South Africa and other jurisdictions. Online Advertising Specifics with regards to Unfair Competition Law Abstract This thesis analyses advertising which is strictly connected to the internet environment with regards to the unfair competition law. The importance of unfair competition regulations in the dynamic internet environment is emphasized by presenting the most problematic areas of online advertising. The great flexibility of the general clause is often the only possible way how to prosecute the new methods of online advertising. Due to the insufficient development of the Czech jurisprudence in online advertising, there are judgments of the European Court of Justice and the judgments from other member states presented in this thesis. There are detailed analyses of six different advertising practices - keywords abuse, metatags abuse, linking, fake online reviews, advertisements on online platforms, and ad blocking software. The main goal of the paper is to draw the limits of these six advertising practices by analysing and comparing various fact patterns in foreign judgments. Some of the judgments presented in the thesis are introduced in the Czech legal environment for the first time. Šiame baigiamajame magistro darbe, analizuojant Lietuvos teisės aktus, mokslinę literatūrą bei Lietuvos ir ETT praktikoje suformuotas su darbo tema susijusias atitinkamų klausimų ir teisės aktų nuostatų aiškinimo ir taikymo taisykles, atskleidžiamas nesąžiningos konkurencijos sąvokos turinys ir įvardijami atskirų nesąžiningos konkurencijos atvejų kvalifikavimo ypatumai. Šio tyrimo tikslas – išanalizuoti nesąžiningos konkurencijos reglamentavimo Lietuvos konkurencijos teisėje ypatumus bei nustatyti taikymo praktikoje problemas – pasiektas įgyvendinus tokius uždavinius: pirmiausia, išanalizavus mokslinę literatūrą, Lietuvos teismų praktiką, Lietuvos Respublikos teisės aktus, aptariančius nesąžiningos konkurencijos sampratą, atskleidžiant jos turinį; po to yra nustatoma nesąžiningos konkurencijos instituto Lietuvos teisės aktuose įtvirtinimo raida ir reikšmė, aptarti pagrindiniai unifikavimo su ES teise aspektai; ir galiausiai identifikuojami nesąžiningos konkurencijos atvejų kvalifikavimo ypatumai, įvertinamas nesąžiningą konkurenciją reglamentuojančių teisės normų veiksmingumas bei atskleidžiami teisinio reguliavimo netikslumai ir dėl to iškylančios problemos. [toliau žr. visą tekstą] / In this master thesis the concept of unfair competition is revealed and qualification features of individual cases of unfair competition are presented by analyzing the Lithuanian legislation, scientific and legal literature as well as analysing Lithuanian and ECJ juridictions’ legal acts, legislation and legal practice. The objective of this master thesis - to analyze the regulation of unfair competition in Lithuanian’s competition law and to determine practical application problems- has been achieved through the following tasks. First, scientific literature, legal practice, legal acts of the Republic of Lithuania discussing the concept of unfair competition and its content are analyzed, then the development and the importance of unfair competence institute setting in Lithuanian legal acts is determined, the main aspects of unification with EU law are discussed, finally, classification features of cases of unfair competition are identified and the efficiency of unfair competition legislation is evaluated, also regulatory uncertainties and the problems it may cause are indicated.
