Promoting gender equality and equity remain an important goal for schools in South Africa, and strides have been made in many areas to reduce inequalities. Local and international legislative and policy frameworks create a context within which unfair discrimination can be curtailed, but these, albeit important, are not entirely sufficient, and inequities persist based on perceptions regarding motherhood and teaching. There is a need to address practices at grassroots level, where historical stereotyping and procedures have become entrenched in the system. For female teachers to experience meaningful equality, these underlying issues need to be addressed and this cannot be achieved through legislative processes. What is required is that the whole process of socialisation into sex roles needs to be addressed. This study sets out to analyse and describe the world of mother teachers, and to explore how entrenched assumptions, cultural values and beliefs impact on the meaningful construction and harmonisation of the dual role of mother and teacher. The professional woman who becomes a mother finds herself faced with the dual role of mother and professional and the result is that conflicting and complementary dimensions emerge that makes the pressure to meet all expectations overwhelming. These mother teachers consistently try to be what they think ‘others’ want them to be and, therefore, they often have not come to terms with who they are. Their life become a life to please ‘others’ and because they cannot please everybody, they experience feelings of failure. This study came to understand that the mother teachers’ will experience ambivalence and discomforts concerning their attempts to balance their personally constructed multiple roles successfully when they do not accept themselves fully as women with special talents, competencies and attributes. Supportive behaviour from the state, school principals and fathers is needed. However, mother teachers themselves are the main source for self-actualisation. Unfortunately, when mother teachers cannot accept themselves for who and what they are, no support system will be able to help them to feel successful about being both homemakers and professionals. I was interested in what each participant’s experiences of motherhood and teaching were; how she expressed herself in conveying these experiences; and consequently, the meaning she attached to her experiences. The research problem, and the nature of the information sought, suggested the use of three distinct methods, namely (1) the narrative interview; (2) reflexive journal entries; and (3) observational field notes. After these three data collection methods had been conducted, coding of the information gathered took place to facilitate analysis and interpretation. O presente estudo tem como tema central a análise do tratamento diferenciado entre os credores sujeitos à recuperação judicial, disciplinada pela Lei 11.101/2005. A necessidade de tratar credores de forma igualitária encontra-se prevista no princípio clássico do direito concursal chamado par condicio creditorum. Assim, busca-se analisar a aplicabilidade desse princípio na recuperação judicial, bem como os elementos que permitam uma compreensão do instituto a fim de construir uma base teórica, problematizar a funcionalidade da Lei através do exame da jurisprudência e doutrina e estabelecer critérios. A relevância do tema justifica-se em razão da matéria ser controvertida e de grande aplicação prática pela existência de diferenciação de tratamento entre credores na maioria das recuperações judiciais. Para tanto, no primeiro capítulo, analisa-se os conceitos básicos e origens para estudo da par condicio creditorum e o contexto dos princípios que norteiam o direito concursal. No segundo capítulo é abordada a importância da jurisprudência e dos credores na construção da recuperação judicial, destacando a problemática existente nas classes de credores originalmente previstas na legislação e a natureza jurídica do plano de recuperação judicial. No terceiro capítulo são analisados os principais casos em que ocorre o tratamento diferenciado entre credores na recuperação judicial, como a criação de subclasses, a existência de credor estratégico ou colaborativo que financie a empresa devedora e a consolidação substantiva de grupos societários, objetivando estabelecer critérios. Finalmente, no quarto capítulo discute-se a soberania da assembleia-geral de credores, o papel do juiz na homologação do plano de recuperação judicial e as hipóteses de controle de legalidade pelo judiciário. Thus, the study seeks to analyze the applicability of this principle in reorganization, as well as the elements that allow an understanding of the institute in order to build a theoretical basis, problematize the functionality of the Law through the examination of jurisprudence and doctrine and establish criteria. The relevance of the topic is justified because the matter is controversial and of great practical application by the existence of different treatment between creditors in most reorganization process. To do so, the first chapter analyzes the basic concepts and origins for the study of par condicio creditorum and the context of the principles that guide bankruptcy law. The second chapter deals with the importance of jurisprudence and creditors in the construction of the reorganization process, highlighting the problems existing in the classes of claims originally foreseen in the legislation and the legal nature of the plan of reorganization. The third chapter analyzes the main cases in which unfair discrimination occurs between creditors in reorganization process, such as the creation of subclasses, the existence of essential venders that finances the debtor company and the substantive consolidation of corporate groups, aiming to establish criteria. What is unfair discrimination? : a study of the South African Constitutional Court's unfair discrimination jurisprudence

This thesis offers an original account of the South African Constitutional Court's reasoning in identifying unfair discrimination perpetrated by the state. I use this account to develop proposals for improving the Court's jurisprudence, in line with its stated aim of addressing patterns of group disadvantage. The Court's Harksen test for unfair discrimination makes dignity the touchstone for identifying this wrong. However, the Court has not explained what is required to prove a violation of dignity or how dignity fits with its concern for group disadvantage. I demonstrate that three necessary conditions must be satisfied for the Court to conclude that dignity has been violated: there must be a) unfavourable treatment on the basis of protected grounds; b) that threatens to create or perpetuate patterns of group disadvantage; and c) that lacks adequate justification. I also investigate important features of the Court's reasoning that have been overlooked in the existing literature, including its concern for messages expressed by discrimination and the fluctuating intensity with which it reviews justifications. Among my proposals for developing this reasoning, I argue that the Court should remove human dignity from the Harksen test and openly acknowledge the considerations doing the work in its decisions. I also provide a detailed critique of five of the Court's most controversial decisions where it found discrimination to be fair despite clear indications that it entrenched patterns of disadvantage. I show that in all five cases the Court applied an indefensibly weak intensity of review, falling below the baseline level of scrutiny which ought to be applied in unfair discrimination cases. I contend that consistent application of this baseline will help to make the Court better at preventing and addressing patterns of group disadvantage. I conclude with a restatement of the Harksen test that consolidates the Court's reasoning and my proposals.

The use of HIV testing in the workplace as the basis for possible unfair discrimination / Lerato Hycenth Thejane

Human immunodeficiency virus and acquired immune deficiency syndrome (hereafter HIV/AIDS) in South Africa are epidemic virus and disease respectively, item 1.1 of the EEA Code of Good Practice on Key Aspects of HIV/AIDS and Employment, 2000 states that HIV/AIDS are serious public health problems, which have socio-economic, employment and human rights implications on the society, employees inclusive. The Constitution of the Republic of South Africa, 1996, Employment Equity Act 55 of 1998, Labour Relations Act 66 of 1995 and Promotion of Equality and Prevention of Unfair discrimination 4 of 2000, international and regional instruments and standards provide protection to HIV positive employees in the workplace. Notwithstanding this plethora of legislation, employees are still faced with the problems of being stigmatised, unfairly discriminated against and ultimately dismissed from work for being HIV positive. Employees are subjected to HIV testing and the information about their HIV statuses is still being disclosed without their informed consent and their right to privacy and confidentiality may be violated. These possible violations of employees’ rights may affect the economy of the country. When employees are dismissed, the amount of production and profits for the employers decrease and as a result the government loses tax revenue, the unemployment and poverty rates increase. Hence it is imperative to investigate the problems of stigmatisation, unfair discrimination and dismissals in order to see to what extent are employees’ rights protected.
