Municipal Solid Waste Management In India: Finding Sustainable Pathways For The City Of Bangalore

abstract: During the months from June to November 2012, the city of Bangalore was faced with a serious solid waste management (SWM) crisis. In the wake of the upheaval, the state court declared source segregation to be mandatory. Yet, while the legislation was clear, the pathway towards a course of action for the transition was not clear and hence, Bangalore was stuck in a state of limbo. The objectives for this thesis spiraled organically from this crisis. The first objective was to examine the gaps in Bangalore's transition to a more sustainable SWM system. Six particular gaps were identified, which in essence, were opportunities to re-shape the system. The gaps identified included: conflicting political agendas, the exclusion of some key actors, and lack of adequate attention to cultural aspects, provision of appropriate incentives, protection of livelihoods and promotion of innovation. Opportunities were found in better incentivization of sustainable SWM goals, protecting livelihoods that depend on waste, enhancing innovation and endorsing local, context based SWM solutions. Building on this understanding of gaps, the second objective was to explore an innovative, local, bottom-up waste-management model called the Vellore Zero Waste Model, and assess its applicability to Bangalore. The adaptability of the model depended on several factors such as, willingness of actors to redefine their roles and change functions, ability of the municipality to assure quality and oversight, willingness of citizen to source segregate, and most importantly, the political will and collective action needed to ensure and sustain the transition. The role of communication as a vital component to facilitate productive stakeholder engagement and to promote role change was evident. Therefore, the third objective of the study was to explore how interpersonal competencies and communication strategies could be used as a tool to facilitate stakeholder engagement and encourage collective action. In addressing these objectives, India was compared with Austria because Austria is often cited as having some of the best SWM practices in the world and has high recycling rates to show for its reputation. / Dissertation/Thesis / M.S. The diploma thesis integration of Immigrants in Austria after 1990 on the Example of the Capital City of Vienna" deals with the Austrian integration policy towards immigrants. In the first part, integration, integration policy and the target group of integration are defined. Trends in the policy on the level of the central government since 1990s are described in the following section. The main part of the thesis deals with the integration policy in Vienna, analyzing the activities of the two key institutions of the municipal policy (Vienna Integration Fund and the Municipal Department 17) and summarizing the political discussion on key problems of the Vienesse integration policy (like citizenship, political participation, segregation or education policy) to answer the question, how active is the governing party in Vienna - SPÖ - in this area field and what are the limits of this policy.

Reservations to human rights treaties

This thesis examines the default application of the 1969 Vienna Convention on the Law of Treaties reservation rules to reservations to human rights treaties. The contemporary practice of formulating reservations allows states to unilaterally modify their treaty obligations following the conclusion of negotiations. Though multilateral treaties address a broad spectrum of subjects and are negotiated using a variety of methods, all treaties are governed by the same residual reservation rules of the Vienna Convention when there is not a treaty-specific reservation regime in place. The Vienna Convention system is only engaged if a state seizes the opportunity to determine whether a reservation is valid pursuant to default rules or if a challenge regarding the validity of a reservation is brought before another competent mechanism of review, such as a dispute resolution mechanism. Even when applied, the Vienna Convention rules are ambiguous at best and have been criticised since their inception due to the high degree of flexibility in their application, especially in relation to human rights treaties. In light of the inherent flaws of the Vienna Convention reservation regime and the structural characteristics of human rights treaties, rarely will a reserving state be deprived of the benefit of the reservation even if it is determined to be invalid by another State Party. Though the consequences of an invalidity determination are more concrete when the decision is taken by a dispute resolution mechanism, such as a court, seldom are disputes over the validity of a reservation to a human rights treaty submitted to a competent mechanism. Using the core UN human rights treaties as a case study this research highlights that the past thirty years have revealed a practical impasse in treaty law when the default reservation rules are relied upon to regulate reservations to human rights treaties. Reservations of questionable validity gain the same status as valid reservations because the Vienna Convention rules do not address the consequence for a reservation determined to be invalid outwith the traditional inter se application of the reservation between the reserving and objecting states, which is not logical in the context of a human rights treaty. Against this background, this thesis examines whether the default reservation rules adequately govern reservations to human rights treaties. The conclusion affirms that the Vienna Convention reservation regime can regulate reservations to human rights treaties but only if there is a clearly defined final view on the validity of a reservation taken by an organ other than the state. Therefore, it is argued that treaty-specific supervisory mechanisms attached to each of the core UN human rights treaties should be invested with the competency to serve a determinative function with respect to evaluating reservations to human rights treaties in order to facilitate a stronger basis for the international human rights system.

Theodor Lotz : a biographical and organological study

This dissertation is a comprehensive study of the life and work of the Viennese woodwind instrument maker Theodor Lotz. Lotz is central to many of the most significant developments in woodwind instrument manufacture and compositions of late 18th century Vienna, and is associated with some of the greatest players and composers of the day. Despite this, no study has been undertaken into his life and many of his surviving instruments have not been studied. This study corrects this by examining both the biographical and organological aspects of this maker. In Chapter 1, the current knowledge of Lotz’s biography is examined for veracity. This has been achieved through consultation of archival sources such as birth and marriage registers and contemporary newspaper announcements. The biographies of the other significant Viennese makers have also been examined in order to determine their relationship to Lotz. Particular attention has been paid to those makers known to have associated with him. Chapter 2 is a comparative study of clarinets. The surviving clarinet by Lotz is the main focus, and it is compared to earlier Viennese instruments as well as other contemporary instruments in order to place Lotz’s instruments in context. Basset horns are the instruments for which Lotz is best known. Chapter 3 is a comparative study of the surviving basset horns, and includes instruments by Lotz which have not previously been studied. The comparative aspect of the study focuses most particularly on instruments by Doleisch, who also made significant numbers of basset horns in nearby Prague during Lotz’s lifetime. This chapter also includes a discussion on the basset clarinet. Chapter 4 studies Lotz’s work with bassoons and contrabassoons. As with Chapter 3, it includes a number of Lotz’s instruments which have not been studied before. It continues the comparative theme and examines not only Viennese instruments, but particularly those by August Grenser, whose bassoons are widely copied by modern makers. The attribution of the surviving flute by Lotz is examined in Chapter 5. Lotz’s involvement with the flute is examined through documentary evidence and the output of his students is examined in order to determine his level of influence on this instrument. Chapter 6 is a study of the two surviving oboe fragments by Lotz as well as the surviving cor anglais. As internal measurements have been impossible to obtain for many of these instruments, the comparative study has instead focussed on external aspects of decoration and design. The conclusion gives a summation of the evidence presented in the preceding chapters and is used to demonstrate Lotz’s unique contributions as an instrument maker and his impact on the future and design of woodwind instruments.

Drawing upon a periodisation of socio-economic development based on the regulation approach, the paper conducts a historical spatial development analysis of Vienna in its broader territory and multi-level perspective. The National context and the East-West cleavages mark the geography of the study. This periodisation is the basis to understand the strategies of Vienna in changing territorialities, the social forces and discourses that are reflected in the present context of Europeanisation, internationalisation and integration of border regions. A critical institutionalist approach is used to analyse the hegemonic liberal and populist discourses and strategies. The lessons taken in this section build the path to outline windows of opportunity for progressive politics, which are sketch out in the last section of the article. L’école viennoise de contrebasse : genèse et réception

Cette recherche met en parallèle les cultures germanophone et francophone par l’entremise de l’histoire de la contrebasse. La problématique consiste à expliquer l’absence de littérature en français sur l’école viennoise de contrebasse, qui s’est développée dans la seconde moitié du XVIIIe siècle et qui a eu une certaine incidence sur le développement de cet instrument. La première section propose une biographie des principaux représentants de cette école, tous contrebassistes virtuoses actifs à Vienne autour de 1750. Suivent un tour d’horizon des œuvres pour contrebasse concertante du classicisme viennois, puis un rappel historique sur le déclin de cette école. Dans la deuxième section, un parallèle est tracé entre l’avancée du violoncelle et le recul de la contrebasse au XIXe siècle. Suivent une présentation des instruments les plus appréciés de cette époque, à savoir le piano, le cor français et le violoncelle, puis une comparaison entre l’évolution de la contrebasse en France et dans les pays germanophones au XIXe siècle. Finalement, la troisième section est consacrée à la renaissance de l’école viennoise de contrebasse, amorcée au milieu du XXe siècle. Pour observer le déploiement de cette évolution dans les cultures française, germanophone et anglo-saxonne, cette section comporte un examen des œuvres publiées par les maisons d’édition spécialisées en musique ainsi que de celles enregistrées par les contrebassistes. / This research draws a parallel between the German and the French cultures through the history of the double bass. The problematic consists in explaining the absence of literature in French about the Viennese school of bass playing, which developed in the second half of the 18th century and had a certain impact on the development of this instrument. The first section proposes a biography of the main representatives of this school, which where all virtuosos double bassists in Vienna around 1750. This is followed by an overview of works for solos double bass of the First Viennese School, and a brief history of the decline of this school. In the second section a parallel is drawn between the progress of the violoncello and the decline of the double bass in the 19th century. This is followed by a presentation of the most appreciated instruments of this era, i.e. the piano, the French horn and the violoncello, and a comparison between the evolution of the double bass in France and in the German speaking countries in the 19th century. Finally, the third section is dedicated to the renaissance of the Viennese school of bass playing, which was initiated half way through the 20th century. To look closer to this evolution in the French, German and Anglo-Saxon cultures, this section also includes a review of works published by music publishers and those recorded by double bassists. / Diese Forschung will zwei Kulturen, die deutschsprachige und die französische, in Verbindung mit der Geschichte des Kontrabasses bringen. Die Fragestellung besteht darin, das Versäumnis der französischen Literatur über die Wiener Kontrabassschule zu erklären, eine Schule die sich in der zweiten Hälfte des 18. Jahrhunderts entwickelt und die eine Wirkung auf die Entwicklung dieses Instrumentes gehabt hat. Im ersten Abschnitt wird eine kurze Biographie der Hauptvertreter dieser Schule vorgeschlagen, die alle Kontrabassvirtuose und um 1750 in Wien tätig waren. Es folgt ein Überblick der Werke der Wiener Klassik für konzertanten Kontrabass, dann ein historischer Exkurs über den Niedergang dieser Schule. Im zweiten Abschnitt wird eine Parallele zwischen dem Vorsprung des Violoncellos und dem Rückgang des Kontrebasses im 19. Jahrhundert gezogen. In diesem Abschnitt werden desweiteren die bevorzugten Instrumente dieser Epoche, nämlich das Klavier, das Horn und das Violoncello diskutiert, und die Entwicklung des Kontrabasses in Frankreich und im deutschsprachigen Raum im 19. Jahrhundert verglichen. Schließlich widmet sich der dritte Abschnitt der Renaissance der Wiener Kontrabassschule, die in der Mitte des 20. Jahrhunderts begann. Um eine richtige Betrachtung der Entfaltung dieser Entwicklung in den französischen, deutschsprachigen und angelsächsischen Kulturen zu ermöglichen, findet sich in diesem Abschnitt ebenfalls eine Untersuchung der Werke, die von den Musikverlagen veröffentlicht wurden wie auch derjenigen, die von den Kontrabassisten aufgenommenen wurden.

The work is composed of six chapters, each of them dealing with a different issue of international sales contract. The first chapter deals with the definition of the term international sales contract in view of the practical and theoretical understanding, because the definition of an international sales contract has its own specifics in contrast to the definition of a sales contract in Czech law. The second chapter discusses the basic approaches of legal regulation in private international law and outlines the basic advantages and disadvantages of specific approaches of legal regulation in private international law in view of the international sales contract in this section. The objective of this thesis is to frame the scope of application of the Vienna Convention on the International Sale of Goods and other instruments of private international law relating to the international sales contract. In this field the gaps in the Vienna Convention are analysed and methods to fill them are explored. The first chapter introduces the key terms of international trade law. First, the types of legal provisions are listed and then the sales contract is defined under both, the Czech law and the Vienna Convention. In the second chapter I focus on the overview of the development of international uniform sales law and on further sources of law, which are important for international transactions. Besides the Convention itself, I study the Rome I Regulation, the uniform principles of international contract law and the Common European Sales Law. The third chapter advances to the core of the thesis, the gaps in the Vienna Convention. After defining the gaps and characterising them, I formulate the basic principles underlying the Convention, which are to be used to fill the internal gaps. Because of the scope of this work is purchase agreement in a trade, the scope of these diploma does not represent consumer sales (contract of sale between a business and private person who is not acting in the course of his or her business). To better understanding all relations in this thesis, is necessary to explain certain specifics, which are arising from this work. The first parties of this sales contract could be only business persons (undertakers), they are having their "places of business in different states." Academic Anti-Semitism and the Austrian School: Vienna, 1918-1945

The theme of academic anti-Semitism has been much discussed recently in histories of the interwar period of the University of Vienna, in particular its Faculty of Law and Policy Sciences. This paper complements these studies by focusing in this regard on the economics chairs at this faculty and, more generally, on the fate of the younger generation of the Austrian school of economics. After some introductory remarks the paper concentrates on three case studies: the neglect of Mises in all three appointments of economics chairs in the 1920s; the anti-Semitic overtones in the conflict between Hans Mayer and Othmar Spann, both professors for economics at the faculty; and on anti-Semitism as a determinant of success or failure in academia, and consequently of the emigration of Austrian economists.
