The aim of this Master's Thesis is to explore, analyze and discuss of the role and position of the innovation policies' ecosystems, the role of incentives in general and particularly within the sphere of intellectual property rights (IPR). The paper consists of two key parts. Firstly, it discuss the role of innovation, justification of incentives and purpose of the IPR protection as the means of addressing market failures, which hinder the innovation process, especially for the small and medium enterprises. Secondly, analysis was conducted within the series of case studies, including Czech Republic, Finland, Germany, United States, China and India. The divergence of the list of countries should provide representative list of measures and incentives employed and utilized in various systems of Innovation governance. Overall findings are compared with the system in the Czech Republic in order to provide prospects for the potential adjustments.

This master's thesis deals with a topical subject of intellectual property rights infringements as an example of a misleading commercial practice. The aim of the theoretical part is an analysis of the available data covering the topic. The paper also contains Czech and European statistics of goods infringing intellectual property rights. The thesis then focuses mainly on the issue of an illegal alcohol trade. The objective of the practical part is an analysis of consumer preferences and behaviour of Prague residents in the purchase and consumption of spirits. Another objective is an analysis of a change of consumer preferences and behaviour of Prague residents as an impact of recently revealed cases of a sell of harmful alcohol. The objectives are met via a quantitative questionnaire survey.

Vybrané právní formy podnikání zahraničního subjektu v ČR / Selected legal forms of business of foreign entities in the Czech Republic

The work deals with the topic of entry of foreign entrepreneurs to the Czech market on the background of two different forms of business - franchising and a limited liability company. The main topic concentrates on the comparison of legislation and contractual framework of these two business forms, primarily focusing on intellectual property and the protection of intangible assets. The work presents general legal provisions related to contracts in the field of intellectual property rights, including licensing agreements. The work is further devoted to franchising and limited liability companies. The business of foreign entrepreneurs is related to the internationality of the contractual process. Contractual cooperation of more entrepreneurs also requires the existence of statutory regulation of competition law, with a special focus on franchising in this work. The application part of the thesis is dedicated to the protection of intellectual property rights, rendering an example of a particular foreign entrepreneur doing business gradually through franchising, and then through a limited liability company founded as a subsidiary of a foreign parent company. Access of entrepreneurs to intellectual property protection during the expansion of their business is analyzed by individual types of intangible assets, such as trademark or know-how. The aim of the work is to highlight the specifics of each business forms and identify problems associated with the provision of intellectual property rights.

In this part are also given reasons of valuation of trademarks and methods suited for this valuating. The second part contains case study representing legislation and methods of valuation of trademarks on specific example.

Faktory měnícího se tržního podílu přístavů EU využívaných zákazníky z České a Slovenské republiky / Factors of market share changes of ports in EU used by clients from Czech and Slovak Republic

The thesis is focused on factors influencing port customers in their choice of the most convenient port. Port customer is primarily freight forwarder but ship operators and multimodal transport operators are also involved in decision making process. Principles of port functioning system reflected in port ownership and port governance with connection to individual subject in port organizational structure are introduced in the theoretical part of the thesis. The following part describes volumes of transported TEU in relation between specific port and Czech and Slovak Republic. The main goal of this thesis is to identify and analyze the key endogenous and exogenous factors which were affecting performance of selected ports. Factors with highest influence on freight forwarder choice are described in detail. Emphasis is placed on the Port of Hamburg because of its ongoing highest performance on the market with highest TEU volumes and also on the Port of Koper because of its growing performance profile.

The Role of State Ownership in Commercial Banks: Experience of CEE Transition Countries

Central and Eastern Europe(CEE) is the region where the ownership of banks has been through the most fundamental and massive changes during the past two decades. This paper analyses the role of state-ownership in commercial banks, whether and why state ownership imposes negative effects on commercial banks in CEE transition countries, through both theoretical arguments and empirical testings. The thesis summarizes previous literature and analyses the role of banking ownership and performance, particularly though a dynamic view of the banking privatisation process. It investigates the reasons why state-owned banks are harmful in CEE countries from a corporate governance point of view. Followed by empirical tests on this topic, including banking production efficiency measurement using Stochastic Frontier Analysis and second-stage regression analysis about the effects of ownership on banking efficiency and asset quality. This paper finds out that the state ownership of banks imposes negative effects on bank performance and hinders successful privatisation of enterprises. Banking production efficiency has been improving greatly in late 1990s and stayed at a constant high level in 2000s. As the general concept and the issue of liability have already been addressed in previously published academic works, this text focuses mainly on aspects of copyright law. The main goal is to explain the current concept of the role of artificial intelligence in Czech copyright regulation and its pitfalls. Violation of Authors' Rights Using Cyberspace Abstract This diploma thesis describes violation of authors' rights in cyberspace, especially the most common ways of committing this crime. The thesis is divided into five parts. The first chapter contains a general introduction to the topic, it defines the basic concepts (such as computer and related terms of hardware and software, internet, cyberspace and cybercrime), which serve as a basis for other parts of the work. The second chapter deals with copyright as such. It explains the concept of copyright work and describes the individual rights of the author. Given the nature of this criminal activity, it is not possible to limit the interpretation to the criminal law regulation. The second chapter thus indicates what rights of the author are affected, which works are subject to copyright infringement, which works are excluded from copyright protection and, finally, what are the limitations and exceptions to copyright.
