Navigating the waters : exploring the roles of provincial water NGOs in decision-making

The principles of adaptive water governance blends many of the components of adaptive and comanagement, specifically iterative and social learning to foster adaptation and collective action. While many of the principles of adaptive water governance are still evolving, organizations operating within these contexts can be positioned as boundary or bridging agents concentrating on the science-policy interface or more centrally positioned to facilitate the inclusion and consideration of the multi-stakeholder perspectives at play. This thesis uses a comparative case study combined with a modified grounded theory approach to explore organizational governance arrangements and the roles played by three major water-focused non-governmental organizations (NGOs) in decision-making in British Columbia. An understanding of the challenges and supporting conditions that enhance organizational and actor efficacy within case study NGOs will inform the broader water community of opportunities for collaboration, capacity-building and expanding the roles of NGOs through provincial water governance reform.

Whose water is it anyway? Indigenous water sovereignty in Canada: an Indigenous resurgence analysis of the case of Halalt First Nation v British Columbia

Colonialism is ongoing in Canada and continues to affect Indigenous-state relations in a number of political and social areas, including water governance. Few other studies link colonial and decolonizing concepts to Indigenous water governance including discussions of power as well as structural and political assumptions, which speak to systemic factors and barriers to increased Indigenous water sovereignty. The purpose of this study is to undertake an in-depth decolonial analysis of the dynamics occurring in a legal water management dispute between an Indigenous community and the Canadian state. More specifically, the goal of this investigation is to identify how ongoing colonial factors affect the Halalt First Nation’s sovereignty over their waters. To this end, the research question is: Using an Indigenous resurgence (IR) analysis, what does the Halalt First Nation v British Columbia (Minister of the Environment) (Halalt v BC) caselaw reveal about the state of Indigenous water sovereignty in Canada? I employ a case study methodology where I analyse the Environmental Assessment (EA) and legal court case of Halalt v BC. I seek to provide a decolonial perspective, so in this study I use an IR theoretical framework. I collect data through interviews with ten participants including three Band Council staff members involved in the Halalt v British Columbia EA and court case study. I analyse the findings using three Indigenous resurgence themes of transfer of power from the state to an Indigenous community, increased respect and use of Indigenous worldviews, and Indigenous self-determination in light of the primary data I collected via key informant interviews and case study participants. The data reveals that there was no evidence that Indigenous resurgence is taking place in the case study as per Halalt participants’ experience of the case study nor the other participants’ opinion of the case study. In this thesis, I advocate for decolonization in the form of increased Indigenous political authority for the Halalt and all Indigenous communities in Canada. / Graduate

The capacity of organizations to deliver effective water management through the provisions of the Water Framework Directive : the case of Malta

Effective implementation of the European Water Framework Directive (WFD) is dependent on Member States’ national water institutions and organizations, often designated as ‘competent authorities’. Although substantial research relating to the Directive itself has been carried out, less is known about the extent to which competent authorities have the organizational capacity to deliver it. The literature notes that conceptual understanding of capacity has been hampered by lack of definitional clarity making both its management and assessment challenging. In this contribution, several conceptualizations of organizational capacity found in the literature are used to construct a set of core qualitative organizational components that encourage analysts to consider the ways in which legal authority, information and knowledge, skills, resources and leadership shape a competent authority’s ability to deliver the WFD. Malta, the smallest European Member State, is the case study used to test the application of these components. Qualitative empirical data collected from policy documents, face-to-face semi-structured interviews and online news media articles, provided the evidence to thematically explore and evaluate the Maltese competent authorities’ organizational capacity across the implementation of three main WFD provisions that are in focus: Article 8, 9 and 14. As a result, the core components of organizational capacity are expanded and refined to produce an organizational capacity thematic map. The results show that competent authorities experience influences across the institutional frameworks they work in as well as external factors (primarily political). The results also support the idea of the organizational capacity components being highly interlinked and the presence (or lack thereof) of one component having knock-on effects on others within an organization. The combination of these two factors highly affect management options and outcomes in the implementation of the WFD. In the small state context of Malta these highlight the need to channel support in a coordinated manner from European counterparts to the Maltese water network. In turn, the water network can have positive knock-on effects on the organizational capacity of the Maltese competent authorities, which currently struggle to perform and seize available opportunities due to low possession of human resources and time availability. The approach and findings presented in this research provide a mechanism and evidence base that can facilitate bilateral discussions between Member States as well as with the European Commission, and help inform the WFD review process planned by end of 2019.

Corporations as custodians of the public good? : exploring the intersection of corporate water stewardship and global water governance

This thesis is about Global Water Governance (GWG) – an overarching normative framework by which water management practices across all scales may be guided. More specifically, it seeks to develop an understanding of how Corporate Water Stewardship (CWS), and its facilitation of the inclusion of companies’ perspectives to address water issues, affects GWG. Understood as a form of market environmentalism – a doctrine premised on mutual synergies between environmental conservation and economic growth – CWS provides a channel for companies to participate in, as well as spearhead, a quest for more sustainable water management within and beyond their own operations. Despite a proliferation of activities undertaken by companies, CWS has attracted limited scholarly attention, and an overarching analysis of the effects that mounting corporate involvement has had on the global water discourse has so far been absent from scholarly debates. This research draws on over 500 documents published by companies, NGOs, and other organisations, alongside 50 interviews with key practitioners. It specifically questions: (i) the empirical context through which CWS emerged; (ii) the manner in which companies from various sectors conceptualise water and its management; (iii) the way CWS endeavours are legitimised and; (iv) the mechanisms through which companies exert influence. Chapters 4 to 8 comprise an analysis of the main research findings. Chapter 4 investigates why companies are interested in water issues, how companies frame them, and how CWS could materialise. Chapters 5 and 6 address how companies from different sectors engage in CWS in the contexts of water resources management, and Water, Sanitation, and Hygiene (WASH). Chapter 7 turns attention to how companies draw on non-conventional sources of authority to legitimise their activities, and Chapter 8 analyses how CWS influences GWG. When taken holistically, the thesis attests to the key point that the inclusion of companies in solving water issues matters; their presence changes the status quo of water governance. More importantly, the thesis goes beyond such assertions by pointing towards how it matters. It finds that, as a result of corporate involvement, water is being reconceptualised from an environmental and social risk to society, to an economic risk for businesses. Moreover, although companies may not be doing this in an ill-intentioned way, the research suggests that when they participate in water interventions, they alter GWG by promoting the commercialisation of water management, the valuation of water risk, and the liberalisation of water governance. Thus, although the involvement of companies may contribute to improving the management and governance of water across all scales, their involvement has to be matched with proper ‘checks and balances’ to ensure that CWS serves the public good, rather than simply contributing to private profit.

Women and Water Governance in Peri-Urban settlements : A case study from the community Caltongo in Mexico City

Water insecurity is one of the biggest socio-environmental challenges of our time. As water gets scarce, already disempowered groups become further marginalized. Throughout the last decades “good” water governance has been presented by global institutions and organizations as a key concept to render water management more effective, sustainable and democratic. However, general theories of “good” governance have been criticized for being gender-blind and for failing to recognize how governance is adopted at a local level, leading to different outcomes for people based on their social identity. The aim of this thesis is to identify water governance arrangements in Caltongo, a peri-urban community in Mexico City, and analyze what outcomes these arrangements have for women. The thesis builds on a feminist political ecology framework that cuts through both theory and method. Empirical data is collected through semi-structured interviews with women and community leaders in Caltongo. The analysis builds on a model that uses three concepts to define governance: resources, mechanisms and outcomes. The results of this analysis show that the strategies that women in Caltongo draw from to access water are based around political involvement, cash payment for water services and social networks. The outcomes are different for different women depending on their ability to use these strategies.

Power, porous borders and polycentricity: the changing nature of transboundary water governance

The challenges facing resource management, including transboundary river basins, have become increasingly complex, requiring more holistic readings of governance processes that encompass a range of formal and informal collaborations between diverse actors. Innovation and transformative governance changes hold potential for addressing the increased complexity and multi-scaled nature of the challenges facing the world’s shared rivers. However, significant research gaps exist around this application in practice. This dissertation asks the following questions: Is governance of transboundary waters changing to integrate a more diverse set of actors beyond centralized governments? If so, what is the role of non-central state actors in contributing to innovations and transformative changes to transboundary water governance processes? In working towards answering these questions, the study explores the case of the Columbia River Treaty (North America) and the Lesotho Highlands Water Project (Southern Africa). This study has the following objectives: first, to determine the type of power, albeit conceived from a Euro-western perspective, that non-central state actors mobilize to engage in transboundary water governance processes, and assess if the power these actors mobilize is contributing to changes in governance. Second, to conceptualize the on-going bordering processes for transboundary water governance, and evaluate whether non-central state actors are shaping these processes. And, third, to identify which non-central state actors are involved in transboundary water governance, and examine whether and how these governance systems are becoming more polycentric. This dissertation is composed of five chapters, three of which have been prepared as standalone articles for submission to academic journals. Broadly, the dissertation findings suggest that changes to governance of transboundary waters, away from state-centric processes, may be emerging in some areas, such as the ability of non-central state actors to exercise and mobilize different forms of power to shape water governance processes. Findings illustrate that a clear distinction between international and national processes is no longer sufficient to address transboundary water governance challenges and issues. Further, findings illustrate that some non-central state actors have power and influence in these transboundary water governance processes. However, these insights also highlight that centralized government authority for transboundary waters remains, and evidence of the emergence of polycentric governance systems at the international scale is limited. / Graduate / 2019-04-30

Concerns of Water Scarcity and Water Quality among two Andean Communities in Peru

This thesis sought to explore the perceptions and experiences of Andean women regarding water quality, water scarcity, and health among two communities in Carhuaz province of Ancash, Peru. Household surveys (n=25), semi-structured interviews (n=10), unstructured interviews (n=2), and participant observation were conducted with local women to investigate their concerns and perceptions of water and health. An additional two unstructured interviews were conducted with a local water authority and doctor in order gain another perspective on the issues of water security and health. The pressure of a changing climate and of a problematic water governance system in Andean Peru create an opening in which to explore local women’s experiences with water and health. Additionally, the socio-history of the region, issues of gender and ethnicity, and the various water users at stake must be considered as they help form the women’s perceptions and experiences. The findings suggest there is concern among women in both communities on water scarcity and water quality. Furthermore, the relationship between diarrhea and community was found to be significant. The results of this study help situate the local experiences within the broader economic and social processes of the region.

Water Governance in the SDG Era - An Analysis of National Commitments to Water, Sanitation, and Hygiene

The 21st century is marked by the forecast of a frightful set of crises caused by anthropogenic activities. Among them, an emerging water crisis threatens the existence of life on the planet. It is mainly triggered by a lack of good water governance. The concept of water governance refers to a range of different societal systems that are involved in the management of water resources, and the delivery of water services. However, these systems are threatened by several problems causing a mismanagement of water resources, involving corruption, deficits of democratization, or inequalities. This study examines commitments to improved water, sanitation, and hygiene provided by the Sanitation and Water for All partnership through a qualitative content analysis in order to allow an insight in current goal-setting for improved water governance. In this study, we show that even though stakeholders across geographical regions and constituencies aim at efficient governance measures, they neglect the importance of the procedural factors of good governance, for instance participation or adaptiveness. Instead they mostly focus on the outcome. Further, the study reveals that the commitments lack timely and measurable components and often do not include allocation of budgets. Although stakeholders show their intention to commit to action and work collaboratively, they often lack long-term thinking. Against the background of emerging global challenges in the water sector, most stakeholders are not yet prepared to work efficiently with new forms of governance in order to establish sustainable and resilient systems. Nevertheless, multi-stakeholder partnerships provide a basis to start a learning journey and can help to facilitate capacity development and future literacy. This thesis reveals starting points for improvement, gives practical recommendations for action and further research directions, that are necessary to explore the differences between regions and constituencies further and improve the goal-setting process in the following years.

Shaping Transboundary Water Governance - How Learning Spaces Shape Transboundary River Basin Management Practices and Processes in the Omo-Turkana and Zambezi River Basins

This doctoral dissertation provides conceptual contributions to understanding and analysing transboundary river basin management practices and processes. The conceptual framework of this thesis is embedded in the social learning literature. This thesis builds on prior efforts by scholars (see Keen et al., 2005; Muro & Jeffrey, 2008; Newig et al., 2010; Pahl-Wostl, 2009; Reed et al., 2010; Schusler et al., 2003) to evaluate and analyze social learning processes. In particular, the concept of learning space as used in this thesis contributes to a deeper understanding of the context in which social learning occurs by combining an analysis of interactions, deliberations and reframing processes. Three research gaps are identified and addressed in this dissertation. First, conceptualisation and evaluation of social learning in emergent processes. Second, an analysis of how relational features (such as trust and shared identities) impact on social learning outcomes. Third, the lack in understanding of how contextual features (such as frames) shape social learning processes and influence transboundary river basin management practices. To address these gaps, this thesis employed case study approach of two transboundary river basins; the Omo-Turkana and Zambezi river basins in Africa. The two case studies fit a better understanding of transboundary river basin management processes and practices as both river basins are shared by different riparian states with competing interests. This thesis explores the general research question: How do learning spaces shape transboundary river basin management practices and processes? This thesis found that the success of transboundary basin cooperation lies not only in actors solving technical problems but also hugely relates to how actors interact with one another to build the needed capacity to address technical issues. As such, creating trust and shared identities, as well as paying attention to problem framing plays a considerable role in defining how actors learn. Overall, by incorporating concepts such as trust, shared identity and frames into the concept of learning space, this thesis was able to provide a better understanding of transboundary river basin management practices. Such a perspective could provide a deeper understanding of how management practices and institutions can be better designed.

Legal and institutional foundations of adaptive environmental governance

Legal and institutional structures fundamentally shape opportunities for adaptive governance of environmental resources at multiple ecological and societal scales. Properties of adaptive governance are widely studied. However, these studies have not resulted in consolidated frameworks for legal and institutional design, limiting our ability to promote adaptation and social-ecological resilience. We develop an overarching framework that describes the current and potential role of law in enabling adaptation. We apply this framework to different social-ecological settings, centers of activity, and scales, illustrating the multidimensional and polycentric nature of water governance. Adaptation typically emerges organically among multiple centers of agency and authority in society as a relatively self-organized or autonomous process marked by innovation, social learning, and political deliberation. This self-directed and emergent process is difficult to create in an exogenous, top-down fashion. However, traditional centers of authority may establish enabling conditions for adaptation using a suite of legal, economic, and democratic tools to legitimize and facilitate self-organization, coordination, and collaboration across scales. The principles outlined here provide preliminary legal and institutional foundations for adaptive environmental governance, which may inform institutional design and guide future scholarship.
