[pt] Esta tese de doutorado objetivou analisar o protagonismo do Poder Judiciário no enfrentamento da questão social na cena contemporânea, a partir do estudo realizado nos processos de interdição civil das pessoas com transtornos mentais que tramitavam em uma das Varas de Família da Comarca de Volta Redonda, inteiro do Rio de Janeiro. Os resultados indicaram, em linhas gerais, que as demandas que emergem nos processos de interdição traduzem as diversas expressões da questão social vivenciadas pelas pessoas com transtorno mentais, cujo enfrentamento revela a transferência de responsabilidade do Poder Executivo para o Poder Judiciário ao que se refere à garantia de direitos sociais e à proteção social. Entretanto, o protagonismo do Poder Judiciário se constrói no âmbito de um processo judicial que priva o sujeito do gozo dos seus direitos civis e políticos, o que evidencia a face coercitiva do Estado para efetivar o controle dessa parcela da população. Os muros dos hospícios foram substituídos pelas invisíveis amarras da interdição civil, o que não alterou a condição de cidadania do louco conforme almejado pelo movimento da reforma psiquiátrica. Tal transferência de responsabilidades configura, dessa forma o fenômeno da judicialização da questão social. Num contexto marcado por mudanças significativas na relação Estado-Sociedade, processadas desde as últimas décadas do século XX, consideramos que a judicialização da questão social se constitui como efeito da reconfiguração dos mecanismos de enfrentamento da questão social, conduzidas em especial pelo Estado, que revigoram práticas de caráter punitivo e repressivo contra a classe trabalhadora para conter suas movimentações, rebeldias e reações frente às desigualdades sociais vivenciadas. / [en] This doctoral thesis aimed to analyze the role of the Judiciary in confronting social issues in contemporary scene, from the study in civil interdiction processes of people with mental disorders which were transating in a Family Court of Volta Redonda, in Rio de Janeiro. The results showed, in general, that the demands that emerge in interdicition processes translate the various expressions of social issues experienced by people with mental disorders, whose confrontation reveals the transfer of the Executive responsibilities to the Judiciary regrading the guarantee of social rights and social protection. However, the role of Judiciary is built under a judiciak process that deprives the subject of the enjoyment of their civil and political rights, which highligghts the coercive face of the state in order to control this part of the population. The walls of asylums were replaced by the invisible bonds of civil interdiction, which did not alter the Mad citizenship status as desired by the psychiatric reform. Such transfer of responsibilities sets, thus, the phenomenon of the judicialization of Social Issues. In a context marked by significant changes in the relationship State-Society, processed since the last decades of the 20th century, we belive that the judicialization of social issues is the effect of the reconfiguration of the coping mechanisms of the social question, led in particular by the state, which energize punitive and repressive practices against the working class to contain their movements, rebellions and forward reactions to experienced social inequalities.
