私有地保育的公私協力: 以八煙聚落及清水濕地為例 / Public-Private Partnership in Conservation on Private-Owned Lands

因牽涉私人財產權,私有地上的保育難度極高,公部門喜歡用徵收方式來進行保育,但為避免發生官民間的衝突,多選擇公有地比例較多的地方做起。在管理制度上,單方面的努力是不夠的,必須透過公、私部門的協力,各自發揮所長,除了公部門的保育政策與私部門的保育策略並行外,也需要站在農民的角度,配合適當的誘因。本研究以位在金山區的「八煙聚落」以及「清水濕地」作為個案分析,兩者產業主要為農業,但隨人口老化,農田荒廢,改變了原有的生態,公部門與私部門聯手復興生態農業,但因其屬私有地,在計畫執行時面臨困境,不過因有台灣生態工法發展基金會積極協助,使得這兩地皆發揮其潛在的價值,吸引第二代回流,增加工作機會。同時也藉由公部門與之合作,推展友善耕作概念,在八煙聚落這邊,延續里山倡議的精神,以生態體驗、社區營造等方式,提供一般民眾農村的體驗課程,將自然與生活合而為一;在清水濕地部分,雖一開始的推展遭逢困境,但因為一隻西伯利亞來白鶴意外到訪,吸引全台與國際間目光,促使在地老農改變慣行農法,建造一個無毒環境。雖說八煙聚落並非完全成功的案例,但這是一個勇敢的開始,也讓人省思生態與經濟共存概念;清水濕地的計劃正在執行,沒有人能確保它是絕對成功或失敗,不過2016年時基金會代表居民與政府一起簽署的「金山倡議」目前持之不輟進行,希望政府、私部門能與居民共同努力,延續倡議精神。 / Exercising conservation on private lands is difficult mainly because of the intensive conflicts in interests. Different policy tools applied by the governments, such as zoning and eminent domain tend to encounter problems of high implementation costs, while market solutions tend to fail owing to inadequate values in transactions. By examining the cases of Bayien Village and Qingshui Wetlands, this thesis demonstrates how a nonprofit organization, Taiwan Ecology Engineering Development Foundation, can serve as a mediator among land owners/users and the regulators to pursue conservation goals. Both cases involve social campaigns and restructureof interest distribution that can eventually change the behaviors of stakeholders. While both cases are still evolving and hard to define its successfulness, they indicate the potential of public-private synergy through deep-rooted conservation efforts of non-profit organizations.
