Le détournement d’institution est une notion qui a été consacrée par la jurisprudence de la Cour de cassation au début des années 1990, à propos de l’adoption et du phénomènes des mères porteuses.D’un point de vue chronologique, le détournement d’institution s’est d’abord dégagé des travaux de la doctrine consacrés à l’abus de droit, et a d’abord été utilisée par la jurisprudence en droit du travail, avant d’être consacré par le droit de la famille. Parce qu’il consiste dans le détournement de la finalité d’une institution juridique, il est souvent confondu avec l’abus de droit, le détournement de pouvoir, la fraude à la loi ou la simulation.Pourtant, l’existence de points de contact entre le détournement d’institution et d’autres instruments de protection de l’ordre juridique ne doit pas masquer une réelle autonomie du concept de « détournement d’institution », tant sur le plan de la notion que du régime juridique qui lui est applicable. / The diversion of an institution is a notion which was established by the jurisprudence of the « French Court of Cassation », in the early 1990s, about adoption and the phenomena of surrogate mothers.From a chronological point of view, the diversion of institution first broke away from the studies of the doctrine dedicated to the abuse of rights , and was first used by the jurisprudence in labour law, before being dedicated to family rights. Because it deals with diversion of the finality of a legal system institution, it is often confused with the abuse of rights, the abuse of power, and fraud of the law or similar. Nevertheless, common points between the diversion of institution and other means of protection of the legal system must not hide a real autonomy of the concept of " diversion of institution ", both from the point of view of the notion and of the legal regime which is applicable.
