Previous issue date: 2010-10-15 / The purpose of the presente paper is to study the accident benefit, whit the objective of reflecting on the protection by means of the social security benefits, on the various legislative changes since it s creation.
The study offers a reflection of need when the situation arising fron diseases that have no occupation origin., understanding that should also be protected by accident benefits.
Devoted a chapter to present the concepts related to labor accidents, bringing the diferentiaton when the accident benefit is caused by accident labor and when it s no labor origen. Worked up, too, the individuals protected by the chosen benefit.
This study followed the deductive method, based on systematic analysis of law, in its constitutional and legal dimension, based on several law doctrinal of the native and foreign, especially Spanish authors, and, when necessary, presenting difficult question present in the jurisprudence / A finalidade do presente foi a de realizar um estudo do auxílio-acidente, com o objetivo de refletir sobre a proteção por meio deste benefício previdenciário, diante das diversas alterações legislativas ocorridas desde a sua criação.
O trabalho traz uma reflexão quando a situação de necessidade decorrente de doenças que não tenham origem ocupacional, entendendo que também deveriam estar protegidas por meio do auxílio-acidente.
Dedicou-se um capítulo para apresentar os conceitos relacionados aos acidentes do trabalho, trazendo a diferenciação quando o auxílio-acidente é decorrente de acidente do trabalho e quando tem origem não ocupacional. Trabalhou-se, também, os sujeitos protegidos pelo benefício escolhido.
O presente trabalho seguiu o método dedutivo, partindo da análise sistemática da legislação vigente na sua dimensão constitucional e legal, com o amparo na doutrina do direito pátrio e estrangeiro, especialmente o espanhol, apresentando as questões tormentosas que estão sendo discutidas na jurisprudência
