Previous issue date: 2016-10-28 / Since the creation of international environmental law, the main discussion was the concept of
economic development and environmental preservation. In developed countries, it began to
emerge ecological movements that denounced the negative consequences of industrialization.
In the other hand, in developing countries, governments were concerned that the imposition of
rules to limit environmental degradation was a constraint to economic and social
development. Consequently, it would not allow the reduction of poverty. In the WTO, the
discussion between trade and environmental protection is to analyze the impact of
environmental policies on trade and the effect of trade on the environment. Within this
organization, much has been done for the sake of sustainable development. Although some
panels have been opened based on the exceptions provided in Article XX, the creation of
many non-tariff barriers can be a subterfuge to mask the free barriers trade. After more than
50 years of discussions, the only consensus on the preservation of the environment is that the
Earth's temperature can not rise more than 2 ?? C in the coming years, as this would cause an
environmental imbalance. For this, the United Nations launched the Sustainable Development
Goals (SDGs), in order to promote clean economy and sustainable economic growth. / Desde o surgimento do direito internacional ambiental, a principal discuss??o seria o conceito
de desenvolvimento econ??mico e a preserva????o do meio ambiente. Nos pa??ses desenvolvidos,
come??aram a emergir movimentos ecol??gicos que denunciavam as consequ??ncias negativas
da industrializa????o. Nos pa??ses em desenvolvimento, os governos estavam preocupados com
que a imposi????o de regras que limitassem degrada????o ambiental fosse uma restri????o ao
desenvolvimento econ??mico e social e, consequentemente, ?? redu????o da pobreza de suas
popula????es. No ??mbito da OMC, a discuss??o entre com??rcio e prote????o ambiental consiste em
analisar o impacto das pol??ticas ambientais no com??rcio, bem como o efeito do com??rcio no
meio ambiente. No ??mbito dessa organiza????o, muito tem se feito em prol de um
desenvolvimento sustent??vel, mas, embora alguns pain??is tenham sido abertos com base nas
exce????es previstas no Artigo XX, observa-se a cria????o de barreiras n??o tarif??rias como
subterf??gios para mascarar os entraves ao livre com??rcio. Ap??s mais de 50 anos de
discuss??es, o ??nico consenso quanto ?? preserva????o do meio ambiente ?? que a temperatura da
Terra n??o pode subir mais que 2??C nos pr??ximos anos, visto que isso causaria um
desequil??brio ambiental. Para isso, as Na????es Unidas lan??aram os Objetivos do
Desenvolvimento Sustent??vel (SDGs), com o intuito de promover a economia limpa e um
crescimento econ??mico sustent??vel.
