No. of bitstreams: 0 / A presente dissertação tem por objetivo o estudo dos obstáculos ao reconhecimento e efetivação do direito humano ao ambiente ecologicamente equilibrado à luz de uma visão pluralística dos direitos de solidariedade, de modo a contribuir para sua compreensão e superação. O estudo está dividido em três capítulos, acrescentados da introdução e considerações finais. O capítulo inicial trata da concepção pluralística dos direitos de solidariedade no contexto da crise ambiental planetária que fez despontar a solidariedade como novo paradigma do Direito Internacional. Nesse capítulo, os princípios da indivisibilidade e interdependência; da solidariedade e do interesse comum da humanidade e da herança coletiva do patrimônio comum da humanidade são abordados à luz da solidariedade intergeracional. O capítulo é encerrado fazendo-se uma breve análise a respeito do reconhecimento internacional do direito ao ambiente ecologicamente equilibrado. O segundo é dedicado à caracterização do direito ao ambiente ecologicamente equilibrado e sua implementação, estudando sua natureza jurídica, definição, sujeitos ativos e passivos, objeto, conteúdo, fundamento, foro e implementação. No último capítulo,
discorre-se sobre a superação dos óbices ao reconhecimento e efetivação do direito humano ao ambiente, abordando a incerteza na definição do conteúdo, a predominância de uma arraigada concepção antropocêntrica no âmbito jurídico, os conflitos com outros direitos humanos, a dificuldade de justiciabilidade, a falta de foro apropriado e a prevalência do paradigma da soberania dos Estados sobre o uso dos recursos naturais.
To present dissertation has as objective to study the obstacles to the recognition and effectiveness of the humane right to an ecologically balanced environment under the light of a pluralistic vision of the solidarity rights, so as to contribute for its understanding and overcoming. The study is divided into three chapters, having the introduction and final considerations being added to. The initial chapter tackles the pluralistic conception of the solidarity rights in the context of environmental crisis in the world that has made the solidarity rise as a new paradigm of the International Law. In this chapter, the principles of indivisibility and interdependence; solidarity and common interest of humanity, and collective inheritance of the common assets of humanity are approached to the light of intergenerational solidarity. The chapter finishes showing a brief analysis about the international recognition of the right to an ecologically balanced environment. The second one is dedicated to the characterization of the right to an ecologically balanced environment and its implementation, studying its juridical nature, definition, active and passive subjects, object, content, foundation, forum and implementation. The last chapter talks about the overcoming of the obstacles to the recognition and effectiveness of the humane right to the environment, approaching the uncertainty in the definition of the content, the predominance of a fixed anthropocentric conception in the juridical field, the conflicts with other human rights, the justiciability difficulty, the lack of appropriate forum and the paradigm prevalence of sovereignty of Nations on the use of the natural resources.
