Previous issue date: 2013-09-27 / This dissertation discusses the theme of freedom of expression of thought through the strong spread with unprecedented rapidity, ideas and thoughts through the call electronic communication in all its forms. Significant impact of modern constitutionalism, freedom of thought manifestation, resulting from disputes fought in the last two years and, given the continuous updating and technological evolution, became precious instrument of maintaining democratic regimes. This perspective is that the freedom of expression of thought is studied in this thesis with the historical look of its career in Brazilian constitutionalism; discussed in the context of past and current jurisprudence of the Supreme Federal Court, in order to try to resume the discussion of the limits of this freedom, in the name of human dignity, the impediment to the proliferation of so-called hate speech and the maintenance of a peaceful democracy. To guarantee to Brazilian democracy, the Constitution of 1988, to seal the anonymity and guarantee full freedom of expression of thought, is part of the list of modern constitutions, open and above all attentive to cultural and political of Brazilian society.
Keywords: Brazilian democracy; Hate speeches; Freedom of expression of thought; Freedom of expression on the Internet; Electronic social networks. / O presente trabalho enfrenta o tema da liberdade de manifestação de pensamento mediante a forte disseminação, com inédita rapidez, das ideias e pensamentos por meio da chamada comunicação eletrônica em todas as suas formas. De significativo impacto para o constitucionalismo moderno, a liberdade de manifestação de pensamento resulta das disputas travadas nos últimos duzentos anos e, diante da contínua atualização e evolução tecnológica, tornou-se instrumento precioso da manutenção de regimes democráticos. Nesta perspectiva é que a liberdade de manifestação de pensamento é estudada nesta dissertação com o olhar histórico de sua trajetória no constitucionalismo brasileiro; discutida no âmbito da jurisprudência passada e atual do Supremo Tribunal Federal, para tentar retomar a discussão dos limites desta liberdade, em nome da dignidade humana, do impedimento à proliferação das chamadas falas de ódio e da manutenção de uma democracia pacífica. Como forma de garantir-se a democracia brasileira, a Constituição Federal de 1988, ao vedar o anonimato e garantir a plena liberdade de manifestação de pensamento, insere-se no rol de constituições modernas, abertas e, sobretudo, atenta à diversidade cultural e política da própria sociedade brasileira.
