PNMA), contributing significantly to the singular treatment towards the environment by the Federal Constitution of 1988 (Constitui??o Federal de 1988), can be appointed as a landmark of this awareness. The Law n? 6.938/81, following the line observed on the legislation of
some Brazilian States, predicted on its 9th article the instruments of PNMA, among which the environmental licensing can be highlighted. This instrument presents itself as indispensable to the construction, installation, extension and operation of enterprises and activities that utilize environmental resources, seen as effective and potentially polluter industries, or even to those that can cause environment degradation. On a parallel way and as a consequence of this awareness, the concept of development begins to acquire a new shape. The development of a country or a region begins to consider not only economical factors, but also environmental,
political, cultural and social aspects. Ecodevelopment, or sustainable development, then, arises. In this way, through research on legislation and on theme related doctrine, this work has the intention of analyzing environmental licensing as a PNMA instrument responsible for uniting economical development and the right to an ecologically balanced environment, that is, by the consecution of a truly sustainable development / A partir da segunda metade do s?culo XX, come?ou a aumentar a preocupa??o do ser humano com a qualidade de vida e preserva??o ambiental. Ambiente PNMA, contribuindo significativamente para o tratamento singular dado ao meio ambiente pela Constitui??o Federal de 1988. A Lei n? 6.938/81, seguindo a linha observada nas legisla??es de alguns Estados brasileiros, previu, em seu art. 9?, os instrumentos da PNMA, dentre os quais se destaca o licenciamento ambiental. Este instrumento apresenta-se
indispens?vel para a constru??o, instala??o, amplia??o e funcionamento de empreendimentos e atividades utilizadoras de recursos ambientais, tidas como ind?strias efetiva e potencialmente poluidoras, ou ainda daquelas que possam causar degrada??o ambiental. Paralelamente e como conseq??ncia dessa conscientiza??o, o conceito do desenvolvimento passa a ganhar novos contornos. O desenvolvimento de um pa?s ou regi?o passa a levar em
conta, al?m de fatores econ?micos, aspectos sociais, culturais, pol?ticos e ambientais. Surge, ent?o, o ecodesenvolvimento, ou desenvolvimento sustent?vel. Assim, atrav?s da pesquisa na legisla??o e na doutrina atinente ao tema, o presente trabalho tem por intuito analisar o licenciamento ambiental como instrumento da PNMA respons?vel por aliar o desenvolvimento econ?mico com o direito a um meio ambiente ecologicamente equilibrado, isto ?, pela consecu??o de um desenvolvimento verdadeiramente sustent?vel
