Apesar de ter sido Michel Foucault quem apresentou ao público a microfísica do poder, nas histórias de Kafka ela já aparece bem delineada. É com base na obra kafkiana, inclusive, que se pode dar um passo à frente e vislumbrar a culpa daqueles que participam das relações de poder. A novela O Veredicto é importante, nesse sentido, pois marca o duelo entre o pai poderoso e o filho culpado. A partir da constatação de que todos aqueles que exercem poder são culpados, surge a necessidade de se buscar a razão pela qual somente alguns indivíduos que compõem a sociedade são criminalizados, condenados e punidos. Com base em Na colônia penal, e da escrita da letra da lei na carne do homem, é possível vislumbrar não apenas o processo de estigmatização do apenado, mas também do homem comum, que, a partir da punição do outro, recebe a inscrição punitiva em sua alma. Na última parte da dissertação, busca-se analisar a composição do tribunal kafkiano. É que, em O Processo, aparentemente todos são funcionários do tribunal e, ao se manifestarem nos mais obscuros recantos da cidade, vão decretando, aos poucos, a culpa do personagem principal do romance. Mas o que chama mais a atenção é que a atuação dos juristas kafkianos não se dá de forma oficializada: é nos bastidores da vida real, e por meio de um exercício ininterrupto de poder, que o direito é dito, ou, para usar um termo técnico, que é prestada a jurisdição. / This study aimed to investigate, at first, the mechanics of power within the "administered world¡". Although it was Michel Foucault who first presented the microphysics of power, in Kafka's stories it appears well delineated. And it is in Kafka's work that one can move on and sees the guilt of those who participate in power relations. The novel The Judgement is important because marks the duel between father and son. If those who exercise power are guilty, it.s necessary to seek the reason why only some individuals are criminalized, condemned and punished. Based on the written of the law in man.s flesh, the novel In the penal colony indicates that the process of stigmatization occurs not only for the convict but also for the ordinary man. The punishment of the other marks the common man in his soul. In the last part of this study, the composition of the kafkaeske court is investigated. In The Trial everybody seems to work for the court, but they work against the main character of the novel in the darkest corners of the city. But the most incredible is that the kafkaeske agents are not official: the law is revealed or, to use a technical term, jurisdiction is given behind the scenes of the real live, through an uninterrupted exercise of power.
