Previous issue date: 2013-05-08 / This research was held in order to present how the implementation of restorative
practices can be a less damaging to society from the point of view of application
justice of men, full of new ideas, but without abandoning the important achievements
already reached the Brazilian courts. Dialogue between Science and Religion other
areas of knowledge, perception and processing guarantees for various fields of
science, establishing the integration of scientific vision with the vision of religious
traditions. It also allows to determine the transdisciplinary nature of this research,
establishing connection proven by history, between religion and law. The current
Brazilian social landscape, and international are not watertight. Instead, the world
has undergone constant changes natural, religious, social, political and economic,
primarily because of the evolution of man. It is inevitable that changed the perception
of reality, the notions of law and justice also undergo changes, as well as how to
administer justice. This work was divided into three chapters, plus introduction and
conclusion. The cut-outs occur from the conceptual search brotherhood, sin,
forgiveness, and love of neighbor, and then travels through the pursuit of democracy,
human rights and respect for human dignity, to achieve restorative justice. We study
issues of criminology, victimology, and feathers. With the ultimate goal of explaining
Restorative Justice, this is contextualized in detailed aspects of non-violence,
dialogue, and reconciliation. Lastly there is the presentation of experiences of
restorative practices in Brazil and abroad. Is the pursuit of social peace through
Restorative Justice. / Esta pesquisa intitulada foi realizada com a finalidade de apresentar como a
implantação de práticas restaurativas pode ser uma solução menos danosa para a
sociedade sob o ponto de vista da aplicação da justiça dos homens, repleta de
novas ideias, porém sem abandonar as importantes conquistas, já alcançadas pela
justiça brasileira. O diálogo entre as Ciências da Religião e outras áreas de
conhecimento, garantem a percepção e tramitação por diversos campos das
ciências, estabelecendo a integração da visão científica com a visão das tradições
religiosas. Permite ainda, determinar o caráter transdisciplinar desta pesquisa,
estabelecendo conexão comprovada pela história, entre religião e direito. O
panorama social brasileiro atual, e o internacional não são estanques. Ao contrário,
o mundo vem sofrendo constantes mudanças naturais, religiosas, sociais, políticas e
econômicas, principalmente em razão da evolução dos homens. É inevitável que,
alterada a percepção sobre a realidade, as noções sobre o Direito e a justiça sofram
também alterações, bem como o modo de se administrar a justiça. Este trabalho foi
dividido em três capítulos, mais introdução e conclusão. Os recortes ocorrem desde
a busca conceitual da fraternidade, pecado, perdão, e amor ao próximo, e
posteriormente trafega pela busca da democracia, dos Direitos Humanos e do
respeito à dignidade da pessoa, até alcançar a Justiça Restaurativa. Estudam-se
questões de criminologia, vitimologia, e penas. Com o objetivo maior de explicar a
Justiça Restaurativa, esta é contextualizada, pormenorizada em seus aspectos de
não-violência, diálogo, e reconciliação. Para finalizar há a apresentação de
experiências de práticas restaurativas no Brasil e exterior. É a busca da paz social
por meio da Justiça Restaurativa.
