Este trabalho tem como objetivo examinar criticamente, através da utilização de operadores teóricos da psicanálise, as políticas públicas de assistência ao fenômeno da violência entre homens e mulheres no ambiente doméstico, sobretudo naquilo que se refere às mulheres. Esse exame indica que tais políticas abordam o fenômeno com base em uma concepção de que há uma relação binária agressor/vítima claramente delineada, e na qual a mulher é tida como vítima de condições desfavoráveis e merecedora de uma assistência judiciária específica. Não se trata de negar que as vítimas existam, mas sim de interrogar o quanto um discurso articulado em uma lógica binária de opostos - forte/fraco, vítima/agressor - acaba por perpetuar aquilo que visa combater: a visão da mulher como um ser fraco e vulnerável, que necessita de proteção. O trabalho se desenvolve em duas vertentes. A primeira, de base teórica, consiste em examinar a construção da mulher como vítima ao longo da história, bem como discorrer sobre os subsídios que a psicanálise oferece para a compreensão da construção da vítima do ponto de vista subjetivo. A segunda vertente, de base prática, consiste na apresentação e discussão de um caso atendido em uma entidade nãogovernamental sediada na cidade de São Paulo, a Pró-Mulher Família e Cidadania, e tem como intuito propor ações alternativas à via estritamente jurídica que hoje prepondera. / The goal of this dissertation is to conduct a critical analysis, through the theoretical concepts developed in the field of psychoanalysis, of public policies that address the phenomenon of domestic violence between men and women, especially as regards the latter. This examination shows that such policies address the issue based on a concept clearly involving an aggressor/victim binary relation, in which the woman, considered as a victim of unfavorable conditions, deserves specific legal assistance. Our intention is not to deny that victims exist, but rather to raise the question of whether a discourse articulated around the logic of binary opposites - strong/weak, victim/aggressor - contributes to perpetuate a view it aims to fight: women as weak and vulnerable beings in need of protection. The dissertation has two dimensions. The first one, theoretical, consists in examining both the construction of women as victims in the course of history and the insights psychoanalysis offers to help understand the construction of the victim from a subjective point of view. The second approach, of a practical nature, entails the presentation and discussion of a case assisted in a non-governmental organization located in the city of São Paulo called Pró-Mulher Família e Cidadania [Pro-Woman, Family and Citizenship] and aims at proposing alternatives that transcend the strictly juridical means prevailing today.
