Previous issue date: 2018-08-17 / The contemporary democratic scenario demonstrates the projection of the role of the Brazilian magistrate in the most diverse social sectors, especially after the 1988 Constitution. The judge, who previously was solely responsible for analyzing legal texts, through simple hermeneutical mechanisms, is now covered the responsibility of solving more complex demands. What seems, at first, virtuous and innovative, must be analyzed with caution. The growing litigation of political and social demands before the Judiciary is the first indication of the inexpressive performance of the other powers, as well as evidencing the gap between representatives and represented, who place their trust in the Judiciary. But such a circumstance is not conclusive in itself. The political panorama analyzed also indicates that when the costs of dealing directly with social issues overlap with the maintenance of power, those responsible for political debates tend to pass on the decision-making burden to the courts. The work has, therefore, as object of study the investigation of factors that indicate the occurrence, or not, of the judicalization of politics in Brazil. For that, a bibliographic methodology was used, based on Brazilian and foreign doctrinal and jurisprudential analysis, especially the American one. Research was also carried out based on concrete cases brought before the Federal Supreme Court under the perspective of the study of democracy, the separation of powers and the institutional function of the courts. It was concluded that there are elements of judicialization of politics in Brazilian democracy and, through the analysis of concrete cases, it was observed that the courts behaved circumstantially as substitutes for the majority institutions through argumentative representation

Democracy. / O cenário democrático contemporâneo demonstra a projeção do papel do magistrado brasileiro nos mais diversos setores sociais, especialmente após a Constituição de 1988. O juiz, que, antes, utilizava mecanismos hermenêuticos simples, atualmente acoberta-se da responsabilidade da solução de demandas mais complexas. Entretanto, o que parece, em um primeiro momento, virtuoso e inovador, deve ser analisado com cautela, pois a crescente litigiosidade de demandas político-sociais perante o Judiciário representa o primeiro indício da deficiência da atuação dos demais poderes, além de evidenciar o hiato existente entre representantes e representados, que depositam sua confiança no Judiciário. Mas tal circunstância não é conclusiva por si só. O panorama político analisado indica, ainda, que quando os custos de lidar diretamente com as questões sociais se sobrepõem à manutenção no poder, os responsáveis pelos debates políticos tendem a repassar o ônus decisório para os tribunais. O trabalho tem, portanto, como objeto de estudo a averiguação de fatores que indiquem a ocorrência, ou não, da judicialização da política no Brasil. Para tanto, utilizou-se de metodologia bibliográfica baseada na análise doutrinária e jurisprudencial, brasileira e estrangeira, especialmente a americana. Foi feita, também, pesquisa a partir de casos concretos levados à apreciação do Supremo Tribunal Federal, sob a perspectiva do estudo da democracia, da separação de poderes e da função institucional dos tribunais. Chegou-se à conclusão de que há, sim, elementos de judicialização da política na democracia brasileira e, pela análise dos casos concretos, observou-se que o Tribunal se comportou circunstancialmente como substituto das instituições majoritárias, por meio da representação argumentativa.
